HomeMy WebLinkAbout672 08-11-1981ORDINANCE NO. 672 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A CHANGE OF ZONING FROM "R -2" TWO - FAMILY DWELLING DISTRICT TO "PD" PLANNED DEVELOPMENT FOR SINGLE FAMILY ATTACHED DWELLING DISTRICT FOR CERTAIN PROPERTY OUT OF THE J. E. FIELD SURVEY IN THE CITY OF EULESS; PROVIDING FOR DEVELOPMENT OF SUCH TRACT OF LAND ACCORD- ING TO APPROVED PLANS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. IT IS HEREBY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as hereinafter set forth. The zoning classification of the following described property, now zoned "R -2" Two- Family Dwelling District be changed to "PD" Planned Develop- ment for Single Family Attached Dwelling District. BEING a 25.0084 acre tract of land out of the J. E. Field Survey, Abstract No. 570, Tarrant County, Texas, and being more particularly described by metes and bounds as follows: COMMENCING at a point, said point being the northeast corner of said J. E. Field Survey, said point also being the centerline intersection of County Road 3036 (Glade Road) and County Road 3129 (North Main Street); THENCE West along the centerline of said County Road 3036 (Glade Road) a distance of 572.2 feet to a point; THENCE South 00° - 08' - 01" West passing at 25.0 feet the south line of said County Road 3036 (Glade Road) and travel- ing in all a distance of 40.0 feet to the POINT OF BEGINNING of the herein described tract; THENCE continuing South 00° - 08' - 01" West a distance of 337.50 feet to a point; THENCE South 880 - 58' - 32" East a distance of 295.10 feet to a point; THENCE South 0° - 12' - 56" West a distance of 174.0 feet to a point; THENCE South 89° - 47' - 17" East a distance of 209.70 feet to a point; THENCE South 4° - 52' - 40" West a distance of 780.53 feet to a point; THENCE North 890 - 41' - 56" West a distance of 440.27 feet to a point; THENCE North 89° - 56' - 14" West a distance of 519.83 feet to a point; THENCE North 000 - 16' - 52" East a distance of 1292.38 feet to a point; THENCE West a distance of 516.81 feet to the POINT OF BEGINNING AND containing 25.0084 acres of land; To be known as North Glade Addition, an Addition to the City of Euless, Tarrant County, Texas; as specifically set forth in the plan as submitted by Applicant and dated June 9, 1981, which plan is on file in the City of Euless Zoning Records and file attached to Zoning Case No. 344. Ii. The plan submitted by Applicant and dated June 9, 1981, shall be incorporated in this ordinance by reference and made a part hereof for all purposes as now set forth in full. Such plan dated June 9, 1981, shall be applicable only to the property hereby rezoned. ORDINANCE NO. 672, PAGE TWO OF FIVE III. Open Space - 68.0% TRAFFIC Public Streets - 50 Feet Dedicated R.O.W. - 31 Feet Pavement Back to Back - 6 -inch Curb - 30 -inch Gutter (Curb Inclusive) - 6 -inch HMAC Pavement - 6 -inch Stabilized Subgrade Pedestrian Ways - 3 Feet Wide Concrete Sidewalks Along Both Sides of Public Streets Minimum Off- Street Parking - 2 Per Unit (Screened per Section 10 -104) OTHER Landscaping - No Requirements Signs - Same as for R -1 Masonary Requirements - 80% Per Elevation, Except for Rear Elevation Number of Units - 196 Acres - 24.58 Acres Net Screening Fences - Along North Main and Commercial Tract and Along Glade Road, in Accordance with Section 10 -104 ORDINANCE NO. 672, PAGE THREE OF FIVE NOTES: (1) All building lines shall be 15' front, 10' side, and 15' rear except as shown. (2) All utility easements shall be 7 -1/2 by 15, except as shown. (3) All street intersection shall have a 25' x 25' public open space easement as shown. (4) All corners shall be set with 5/8" iron rods. (5) No driveway shall be permitted access to Glade Road or North Main Street. (6) Sidewalks shall be 3' in width, one foot off property line on all streets. (7) All drive curb returns shall be 5 foot radius and shall terminate within the limits of the subject lot dimensions. IV. Severability Clause. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitu- tionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. \iA Penalty for Violation. Any person violating the provisions of this ordinance, or the amendments to the City of Euless Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more than Two Hundred Dollars ($200.00), and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Chater and the Statutes of the State of Texas. VI. Effective Date. This ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. ORDINANCE NO. 672, PAGE FOUR OF FIVE PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 28th day of July, 1981, by a vote of 4 ayes, 0 nays, and 0 abstentions. GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting of the Euless City Council on the 11th day of August, 1981, by a vote of 4 ayes, 0 nays, and 1 abstentions.
