HomeMy WebLinkAbout674 08-25-1981ORDINANCE NO. 674 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A CHANGE OF ZONING FROM "C -2" COMMUNITY BUSINESS DISTRICT TO "C -2" COMMUNITY BUSINESS DISTRICT WITH SPECIAL USE PERMIT FOR COMMERCIAL AMUSEMENTS AND BEER AND WINE SALES FOR CERTAIN PROPERTY OUT OF THE PUENTE DEL OESTE ADDITION TO THE CITY OF EULESS; PROVIDING FOR DEVELOPMENT OF SUCH TRACT OF LAND ACCORDING TO APPROVED SITE PLANS; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING A PENALTY AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. IT IS HEREBY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as hereinafter set forth. The zoning classification of the following described property, now zoned "C -2" Community Business District be changed to "C -2" Community Business District with Special Use Permit for Commercial Amusements and Beer and Wine Sales. THE FOLLOWING described tract or parcel of land being a portion of Tract 5, PUENTE DEL OESTE, to the City of Euless, Tarrant County, Texas, according to plat recorded on Page 56 of Volume 388 -53 in the Tarrant County Deed Records and being more particularly described as follows: BEGINNING in the North line of Del Paso Street and being S 89° 00' E a distance of 30.0 feet from the Southwest corner of said Tract 5; THENCE S 89° 00' E along the North line of said Del Paso Street a distance of 171.1 feet; I THENCE S 59° 00' E along the North line of said Del Paso Street a distance of 30.0 feet; THENCE S 89° 00' E along the North line of said Del Paso Street a distance of 403.83 feet; THENCE N 0° 07' E a distance of 198.38 feet; THENCE N 89° 53' W a distance of 155.0 feet; THENCE S 0° 07' W a distance of 19.0 feet; THENCE N 890 00' W a distance of 445.99 feet; THENCE South a distance of 161.99 feet to place of beginning, as specifically set forth in the site plan as submitted by Applicant and dated June 3, 1981, which plan is on file in the City of Euless Zoning Records and file attached to Zoning Case No. 338. II. The plan submitted by Applicant and dated June 3, 1981, shall be incorporated in this ordinance by reference and made a part hereof for all purposes as now set forth in full. Such plan dated June 3, 1981, shall be applicable only to the property hereby rezoned. III. The applicable uses of land pursuant to Section 7 -1100, City of Euless Zoning Ordinance No. 347, to be subject to the conditions as here- inafter set forth. SITE Total Site Area - 108,688.47 square feet Maximum Lot Coverage - 19.4% Minimum Front Yard - 445 feet Minimum Rear Yard - 135 feet Minimum Side Yard - 25 feet Minimum Side Yard - 0 BUILDING Minimum Floor Area - 12,000 square feet - Restaurant 3,000 square feet - Office 5,000 square feet - Games Maximum Building Height - ORDINANCE NO. 674, PAGE TWO OF FOUR OTHER Minimum Off- Street Parking - 213 Screening Requirement - Existing 6'0" Stockade fence along east boundary Sign Requirements - Signs will conform to Euless Sign Ordinances USE A. Open seven days a week commencing at 11:00 A.M., closing at 11:00 P.M., Sunday through Thursday, & at 12 :00 Midnight Friday and Saturday. B. No loitering is allowed in or about the premises. C. Persons under eighteen (18) years of age are not admitted unless accompanied by a parent. D. The game space "Fantasy Forest" is a secondary use involving approvimately 2% of the total floor space. Number of games in operation is approvimately 75, with one quarter of these being kiddie rides. E. No food, drink, or smoking is allowed in the game space. "Fantasy Forest" signs will be posted to that effect and personnel will be assigned to maintain those rules. F. Liquor sales will be confined to beer and wine, on premises only, and will remain secondary to food sales and be combined with them. G. Game revenue shall remain secondary to food sales. IV. Severability Clause. It is hereby declared to be the intention of the City of Euless City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitu- tionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. V. Penalty for Violation. Any person violating the provisons of this ordinance, or the amendments to the City of Euless Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more than Two Hundred Dollars ($200.00), and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Charter and the Statutes of the State of Texas. ORDINANCE NO. 674, PAGE THREE OF FOUR VI. Effective Date. This ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 11th day of August, 1981, by a vote of 5 ayes, 0 nays, and 0 abstentions.
