HomeMy WebLinkAbout675 08-25-1981ORDINANCE NO. 675 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A CHANGE OF ZONING FROM "R -1" SINGLE FAMILY DWELLING DISTRICT TO TOWNHOME DWELLING DISTRICT AND "R -4" MULTI- FAMILY DWELLING DISTRICT WITH "CUD" FOR CONFORMING HOUSING FOR CERTAIN PROPERTY OUT OF THE RAY SHELTON SUBDIVISION; PROVIDING FOR DEVELOPMENT OF SUCH TRACT OF LAND ACCORDING TO APPROVED'SI'TE PLAN; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING A PENALTY AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: In IT IS HEREBY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as hereinafter set forth. The zoning classification of the following described property, now zoned "R -1" Single Family Dwelling District be changed to Townhome Dwelling District and "R -4" Multi - Family Dwelling District with "CUD" for Conforming Housing. AREAS A, B, AND C, BEING DESIGNATED AS "R -4" ZONING: All that certain tract or parcel of land being part of Tracts 2, 3, and 4, RAY SHELTON SUBDIVISION, Euless, Tarrant County, Texas, as recorded in Volume 1792, Page 93, Deed Records, Tarrant County, Texas, and being further described by metes and bounds as follows: BEGINNING at the Northwest corner of said Tract 2; THENCE East 330.0 feet along the North line of said Tract 2 to the Northeast corner of said Tract 2 and the Northwest corner of said Tract 3; i THENCE East 330.0 feet along the North line of said Tract 3 to the Northeast corner of said Tract 3 and the Northwest corner of said Tract 4; THENCE North 89° 55' 45" East 330.0 feet along the North line of said Tract 4 to the Northeast corner of said Tract 4; THENCE South 692.3 feet along the East line of said Tract 4 to the Northeast corner of Harwood Park Townhomes Addition as recorded in Volume 388 -129, Page 67, Deed Records, Tarrant County, Texas; THENCE North 89° 55' 10" West 330.0 feet along the North line of said Harwood Park Townhomes Addition to the Northwest corner of said Addition, said point also being in the East line of Tract 3, said Ray Shelton Subdivision; THENCE West 330.0 feet to a point in the West line of said Tract 3; THENCE West 330.0 feet to a point in the West line of said Tract 2; THENCE North 692.3 feet along the West line of said Tract 2 to the place of beginning and containing 15.735 acres of land. AREAS D AND E. BEING DESIGNATED AS TOWNHOME ZONING: All that certain tract or parcel of land being part of Tract 3, RAY SHELTON SUBDIVISION, Euless, Tarrant County, Texas, as recorded in Volume 1792, Page 93, Deed Records, Tarrant County, Texas, and being further described by metes and bounds as follows: BEGINNING at the Southeast corner of said Tract 3, said point being in the North right -of -way line of Harwood Road; THENCE West 330.0 feet along said North right -of -way line to the Southwest corner of said Tract 3; THENCE. North 89° 51' 25" East along the North line of Harwood Road a distance of 329.59 feet; THENCE North 0° 01' 20" East along the West line of said Tract 2 a distance of 620.4 feet; THENCE East 330.0 feet to a point in the east line of said Tract 2; ORDINANCF "' C 7', , PAC T1.10 nr FTVF THENCE East 330.0 feet to a point in the East line of said Tract 3, said point also being the Northwest corner of Harwood Park Townhomes Addition as recorded in Volume 388 -129, Page 67, Deed Records, Tarrant County, Texas; THENCE South 620.4 feet along the East line of said Tract 3 to a point in the North right -of -way line of Harwood Road for the Southwest corner of said Tract 3 to the place of beginning and containing 9.4 acres of land; as specifically set forth in the site plan as submitted by Applicant and dated July 9, 1981, which plan is on file in the City of Euless Zoning Records and file attached to Zoning Case No. 343. II. The plan submitted by Applicant and dated July 9, 1981, shall be incorporated in this ordinance by reference and made a part hereof for all purposes as now set forth in full. Such plan dated July 9, 1981, shall be applicable only to the property hereby rezoned. III. The applicable uses of land pursuant to Section 7 -1100, City of Euless Zoning Ordinance No. 347, to be subject to the conditions as herein- after set forth. USES PERMITTED ON AREAS A. B. AND C. BEING "R -4" ZONING (1) Use permitted on these three 5.245 acre tracts shall be limited to residential housing, as permitted in the "R -4" Zoning District of the City of Euless Zoning Ordinance. (2) Uses permitted as listed above in Condition (1) and as permitted in the "R -4" Zoning District of the City of Euless Zoning Ordinance shall include the following: * "R -1" uses to conform to "R -1" standards * "R -2" uses to conform to "R -2" standards * " Townhomes" to conform to the standards for same established in Section 7 -309 of the City of Euless Zoning Ordinance * "R -3" uses to conform to "R -3" standards * "R -4" uses to conform to "R -4" standards ORDINANCE NO. 675, PAGE THREE OF FIVE i USES PERMITTED ON AREAS D AND E, BEING "TOWNHOME" ZONING (3) Uses permitted on these two 4.7 acre tracts shall be limited to townhomes, being defined as three or more single family attached dwellings, anJ conforming to the standards for same as established in Section 7 -309 of the City of Euless Zoning Ordinance up to a maximum density of twelve units per acre. (4) Uses permitted as listed above in Condition (3) and as permitted in Section 7 -309 of the Euless Zoning Ordinance shall include only the following: * "R -1" uses to conform to standards for same as established in the "R -1" Zoning District * "Single family attached dwellings (couplets)" to conform to standards for same as established in the "R -2" Zoning District * " Townhomes" to conform to the standards for same as established in Section 7 -309 of the Euless Zoning Ordinance OTHER CONDITIONS (5) Should the standards and /or uses allowed in any of the zoning districts referenced above in Conditions (1) through (4) be amended by the Euless City Council through appropriate revision procedures, then same amendments shall automatically become binding conditions integral to this CUD Site Plan should they occur prior to issuance of Building Permits for construction upon Areas A through E listed above. (6) The provisions of Section 7- 1111(2) shall not apply to any of the tracts herein zoned unless this property is rezoned to allow for same. IV. Severability Clause. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph or section of this ordinance shall be decLar.ed unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, sincee the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. ORDINANCE NO. 675, PAGE FOUR OF FIVE V. Penalty for Violation. Any person violating the provisions of this ordinance, or the amendments to the City of Euless Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more than Two Hundred Dollars ($200.00), and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Charter and the Statutes of the State of Texas. VI. Effective Date. This ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 11th day of August, 1981, by a vote of 4 ayes, 0 nays, and 0 abstentions. GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting of the Euless City Council on the 25th day of August, 1981, by a vote of 4 ayes, 0 nays, and 1 abstentions.
