HomeMy WebLinkAbout682 09-29-1981ORDINANCE NO. 682 AN ORDINANCE PROVIDING FOR THE LEVY OF AN AD VALOREM TAX ON PROPERTY SITUATED WITHIN THE CORPORATE LIMITS OF THE CITY OF EULESS, TEXAS, ON THE FIRST DAY OF JANUARY, 1981, EXCEPT SUCH PROPERTY AS MAY BE EXEMPT FROM TAXATION BY THE CONSTITUTION AND THE STATUTES OF THE STATE OF TEXAS; ESTABLISHING THE TAX RATE; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. There is hereby levied an ad valorem tax for the year 1981 on all property, real or personal, except for such property as may be exempt from taxation by the Constitution and the Statutes of the State of Texas, situated within the corporate limits of the City of Euless, Texas, on January 1, 1981, and that amount to be applied to the value of such property shall be Seventy Cents ($0.70) per each One Hundred Dollars ($100.00) of assessed valuation. II. The tax so levied and assessed shall be apportioned to the following accounts and funds in the amounts set forth: Maintenance & Operation ............ $0.56 Debt Service .......................$0.14 Total Levy .........................$0.70 III. Severability Clause. It is hereby declared to be the intention of the City Council of the City of Euless, Texas, that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared un- constitutional by the valid judgment of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. IV. Emergency Clause. By the affirmative vote of four or more of its members, the City Council declares that this is an ordinance for the immediate preservation of the public peace, property, health, and safety, and is an emergency measure within the meaning of Article ii, Section 11, of the City Charter; and the requirement that it be read at two meetings, as specified in such Section 11, is hereby dispensed with. M Effective Date. This ordinance shall become effective immediately from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas.
