AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED
AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS;
AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR
A CHANGE OF ZONING FROM "R -1" SINGLE FAMILY DWELLING
DISTRICT TO "PD" PLANNED DEVELOPMENT FOR SINGLE
FAMILY ATTACHED DWELLING DISTRICT FOR CERTAIN PROPERTY
OUT OF THE B. HARRINGTON SURVEY; PROVIDING FOR DEVELOP-
MENT OF SUCH TRACT OF LAND ACCORDING TO APPROVED
DEVELOPMENT PLAN; PROVIDING FOR A SEVERABILITY CLAUSE;
PROVIDING A PENALTY AND AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS,
TEXAS:
I.
IT IS HEREBY ORDERED that the Official District Zoning Map of
the City of Euless, Texas, being a part of Ordinance No. 347, be amended
to read as hereinafter set forth.
The zoning classification of the following described property,
now zoned "R -1" Single Family Dwelling District be changed to "PD" Planned
Development for Single Family Attached Dwelling District.
BEING 33.21 acres of land situated in the Bryant Harrington
Survey, A -808, Tarrant County, Texas; said 33.21 acres being
owned by: Jim F. Bewley as described by deed recorded in
Volume 2047, Page 115; John Love, Trustee, et al,(for Jimmy
Work, ownes an undivided 26.0325% interest, as recorded in Volume
6160, Page 145, TCDR, A. L. Harguess & Rose Harguess ownes an
undivided 47.9350% interest, as recorded in Volume 6160,
Page 149, TCDR, and Hellen Mabry ownes an undivided 26.0325%
interest as recorded in Volume 6160, Page 153, TCDR); Melvin
L. Best et ux, Gladys Hayes, as described by deed recorded in
Volume 6698, Page 913, TCDR and Howard U. Freeman as described
by deed recorded in Volume 4793, Page 147, TCDR, said 33.21
acres being more particularly described by metes and bounds
as follows:
BEGINNING at a 5/8" iron set at the northwest corner
of the aforementioned Jim F. Bewley tract, from whence
a 1/4" iron bears N 59° 16' 05" W, 0.79 feet; said point
also being in the south right -of -way line of Glade Road,
County Road No. 3036 (A. 50 foot wide public right -of -way);
THENCE N 890 26' 00" E, along said south right -of -way line,
375.51 feet to a 5/8 inch iron set at the most northerly
east corner of the aforementioned John Love, Trustee et al,
tract whence an iron bears S 81° 34' 48" E, 0.25 feet;
THENCE south along an east line of said John Love tract,
403.00 feet to a 5/8 inch iron found for a corner, from
whence an iron bears S 11° 36' 45" E, 0.31 feet;
THENCE N 890 47' 00" E, along a north line of said John
Love tract, 176.35 feet to a 5/8 inch iron found for corner
from whence an iron bears S 20° 13' 33" E, 0.60 feet;
THENCE N 010 22' 00" W, along a west line of said John Love
tract, 106.29 feet to an iron pipe found for the southwest
corner of a tract of land owned by R. L. Sansom as described
by deed recorded in Volume 2348, Page 386, TCDR;
THENCE N 880 38' 00" E, along the south line of said Sansom
tract 135.00 feet to an iron found at the southeast corner
of said Sansom tract;
THENCE S 010 22' 00" E, along an east line of the aforementioned
John Love tract, 98.90 feet to a 5/8 inch iron set from whence an
iron bears N 89° 40' 53" E, 0.71 feet;
THENCE S 890 39' 20" E leaving said east line 201.61 feet to a
5/8 inch iron set;
THENCE S 000 06' 20" E, 183.50 feet to a 5/8 inch iron set;
THENCE N 890 23' 40" E, 178.00 feet to a 5/8 inch iron set;
THENCE S 000 06' 20" E, 59.50 feet to a 5/8 inch iron set;
THENCE N 890 23' 40" E, 183.75 feet to a 5/8 inch iron set from
whence a fence post bears S 29° 08' 46" E, 0.35 feet, said iron
being in the west right -of -way line of Baze Drive, County Road
No. 3069 (a public right -of -way of variable width);

THENCE S 000 05' 56" E, along said west right -of -way line,
159.65 feet to a 5/8 inch iron set for the northwest corner
of a tract of land owned by Earl L. Heitman, as described by
deed recorded in Volume 3844, Page 147, TCDR;
THENCE S 890 23' 40" W leaving said west right -of -way line,
554.41 feet along the north line of said Heitman tract to a
5/8 inch iron set for the northwest corner of said Heitman
tract from whence an iron bears S 89° 27' 22" W, 0.27 feet;
THENCE S 010 22' 00" E, along the west line of said Heitman
tract at 400.04 feet pass the southwest corner of said Heitman
tract whence'an iron bears S 88° 47' 12" E, 1.08 feet, and
continuing in all 545.05 feet to a 5/8 inch iron set at the
northwest corner of a tract of land owned by Howard U. Freeman
as described by deed record in Volume 4793, Page 147, TCDR,
from whence an iron bears N 41° 19' 30" E, 0.12 feet;
THENCE N 890 23' 40" E, along the north line of said Freeman
tract 542.35 feet to a fence post at the northeast corner of
said Freeman tract, said northeast corner being in the afore-
mentioned west right -of -way line of Baze Drive;
THENCE S 000 05' 56" E, along said west right -of -way line
374.40 feet to an iron found for corner;
THENCE S 890 38' 18" W leaving said west right -of -way line and
along the most northerly south line of said Freeman tract, 392.91
feet to a 5/8 inch iron set for corner from whence an iron bears
S 21° 59' 24" W, 0.54 feet;
THENCE S 000 14' 00" E, along the most westerly east line of said
Freeman tract, 111.00 feet to a 5/8 inch iron set for corner from
whence an iron bears N 79° 41' 24" E, 0.23 feet;
THENCE S 890 46' 00" W along the south line of said Freeman tract
at 139.00 feet pass a 5/8 inch iron found at the common corner of
said Freeman tract and the aforementioned John Love, Trustee tract
from whence an iron bears S 03° 53' 13" W, 0.18 feet and continuing
in all, along the south line of said Love tract 653.44 feet to a
5/8 inch iron found at the most southerly southwest corner of said
Love tract from whence an iron bears N 62° 10' 45" E, 0.43 feet;
THENCE N 000 32' 00" W, along the most easterly west line of said Love
tract 416.90 feet to a 5/8 inch iron found for corner, from whence
an iron bears N 78° 59' 16" E, 0.25 feet;

THENCE S 890 43' 00" W, 202.50 feet to a 5/8 inch iron found
at the southeast corner of a tract of land owned by Zalon A.
Wilkins as described by deed recorded in Volume 6145, Page 597,
TCDR from whence an iron bears N 43° 10' 32" E, 0.60 feet;
THENCE north along the east line of said Wilkins tract, 1407.72
feet to the point of beginning and embracing 33.21 acres of land
or 1,446,672 square feet, more or less;
as specifically set forth in the development plan as submitted by Applicant,
which plan is on file in the City of Euless Zoning Records and file attached
to Zoning Case No. 351.
II.
The development plan submitted by Applicant shall be incorporated
in this ordinance by reference and made a part hereof for all purposes as
now set forth in full. Such development plan shall be applicable only to
the property hereby rezoned. Said development plan is dated October 13, 1981,
per last revision.
III.
The applicable uses of land pursuant to Section 7 -1100, City of
Euless Zoning Ordinance No. 347, to be subject to the conditions as herein-
after set forth.
SITE Maximum Density - 9 Dwelling Units Per Acre
Maximum Coverage - 50%
Minimum Parking Requirements
Number - Minimum of two (2) off - street parking spaces
required for each dwelling unit.
Location - Each dwelling unit shall have two (2) parking
spaces behind the front building line. However, in no case
shall the required parking be allowed less than twenty (20)
feet from the front property line when it is accessed from
the front, nor shall it be allowed less than twenty (20) feet
from the rear property line when it is accessed from the rear.
Covered or Screened - All required parking which is not located
behind the dwelling unit shall be required to be covered with
either a carport or garage or a combination thereof.
All required parking which is located on the lot and behind
the dwelling unit shall be either covered as described in the
above paragraph or it shall be screened by a screening fence
that conforms to the standards of Section 10 -104 of the Euless
Zoning Ordinance.

BUILDING STANDARDS

Minimum Floor Area - 1000 square feet
Minimum Combined Floor Area of Two Attached Dwelling Units
- 2000 square feet
- -with 25% of dwelling units being 1000 square feet per side,
and 2000 square feet per building
- -with 25% of dwelling units being 1050 square feet per side,
and 2100 square feet per building
- -with 50% of dwelling units being 1100 square feet per side,
and 2200 square feet per building
Maximum Height - 35 feet
Minimum Masonry Requirement - 80%
Dwellings and accessory buildings shall have 80% masonry
veneer on all exterior wall elevations except the rear
exterior wall elevation.
The required 80% masonry veneer shall be calculated by
finding 80% of the area that describes the exterior
wall elevation exclusive of windows and doors and
inclusive of any appendages to the wall.
Common Wall Construction Requirements
All common walls in single family attached dwellings shall
be constructed as a double wall unit that meets a two -hour
fire rating and has an approved sound board integrated
between wall studs that are staggered and offset along
either side of said sound board.
The double wall unit herein described shall be constructed
in its entirety to the roof deck and shall meet the require-
ments of the most recently adopted building code of the
City of Euless.
Fence screening requirements as specified in the Euless Zoning
Ordinance and additionally, where this property is immediately
adjacent to an existing residence, as indicated on the
development plan.
Sign requirements shall be in conformance to the standards
of Section 9 of the Euless Zoning Ordinance.

IV.
Severability Clause. It is hereby declared to be the intention of the
City Council of the City of Euless that the sections, paragraphs, sentences,
clauses, and phrases of this ordinance are severable and if any phrase, clause,
sentence, paragraph, or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs, and sections of this ordinance, since the same would have
been enacted by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase, clause, sentence, paragraph, or section.
V.
Penalty for Violation. Any person violating the provisions of this
ordinance, or the amendments to the City of Euless Charter of 1961 hereby made,
shall be deemed guilty of a misdemeanor and shall be liable to a fine of not
more than Two Hundred Dollars ($200.00), and each day such violation shall be
permitted to exist shall constitute a separate offense, as provided by
Ordinance No. 347, and subsequent amendments to the Euless City Charter and
the Statutes of the State of Texas.

Effective Date. This ordinance shall be in full force and effect
from and after its passage as provided by the Euless City Charter and the laws
of the State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless
City Council on the 25th day of August, 1981, by a vote of 5 ayes, 0
nays, and 0 abstentions.
GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting of the
Euless City Council on the 13th day of October , 1981, by a vote of
4 ayes, 0 nays, and 0 abstentions.
