HomeMy WebLinkAbout689 11-24-1981ORDINANCE NO. 689 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A CHANGE OF ZONING FROM "R -1" SINGLE FAMILY DWELLING DISTRICT TO "C -2" COMMUNITY BUSINESS DISTRICT AND "R -3" MULTI - FAMILY DWELLING DISTRICT FOR CERTAIN PROPERTY OUT OF THE GEORGE LINNEY SURVEY; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING A PENALTY AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. IT IS HEREBY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as hereinafter set forth, as submitted by Applicant on September 16, 1981, which is on file in the City of Euless Zoning Records and file attached to Zoning Case No. 355. The zoning classification of the following described property, now zoned "R -1" Single Family Dwelling District, be changed to "C -2" Commercial Business District. The following described tract or parcel of land situated in the George Linney Survey, A -939, Tarrant County, Texas, and being a portion of a tract as conveyed to W. J. Eden by deed recorded on Page 331 of Volume 2532 in the Tarrant County Deed Records and being more particularly described as follows: BEGINNING at the southeast corner of a 1.53 acre tract as conveyed to Texas Power and Light Company by deed recorded on Page 212 of Volume 3197 in the Tarrant County Deed Records; THENCE S 720 19' 20" W along the south line of said Texas Power and Light Company tract a distance of 205.2 feet to the east right -of -way line of F.M. Highway No. 157; THENCE S 30 40'53" W along the east right -of -way line of said F.M. Highway No. 157 a distance of 654.41 feet; THENCE S 00 08' 15" W albng the East right -of -way line of said F.M. Highway No. 157 a distance of 316.89 feet. THENCE S 890 48' 40" E a distance of 494.64 feet; THENCE N 350 00' W a distance of 192.9 feet to the beginning of a curve to the right having a radius of 814.32 feet; THENCE Northwesterly along said curve and through a central angle of 35° 00' 00" a distance of 497.44 feet; THENCE North a distance of 408.8 feet to place of beginning, containing 6.35 acres of land more or less. The zoning classification of the following described property, now zoned "R -1" Single Family Dwelling District, be changed to "R -3" Multi- Family Dwelling District. The following described tract or parcel of land situated in the George Linney Survey, A -939, Tarrant County, Texas and being a portion of a tract as conveyed to W.J. Eden by deed recorded on Page 331 of Volume 2532 in the Tarrant County Deed Records and being more particularly described as follows: BEGINNING at the Southeast corner of a 1.53 acre tract as con- veyed to Texas Power and Light Company as recorded on Page 212 of Volume 3197 in the Tarrant County Deed Records; THENCE South a distance of 408.8 feet to the beginning of a curve to the left having a radius of 814.32 feet; THENCE Southeasterly along said curve and through a central angle of 35° 00' 00" a distance of 497.44 feet; THENCE S 350 00' E a distance of 192.9 feet; THENCE S 890 48' 40" E a distance of 570.44 feet to the Northwest corner of Tract A, Block E, LAKEWOOD TOWNHOUSES ADDITION, to the City of Euless, Tarrant County, Texas according to plat recorded on Page 5 of Volume 388 -79 in the Tarrant County Deed Records; THENCE N 19° 42' W a distance of 305.0 feet; THENCE N 0° 54' E a distance of731.99 feet to the South line of a City of Euless Park tract; THENCE N 890 04' W along the South line of said City of Euless Park tract a distance of 48.98 feet; THENCE N 890 15'30'W along the South line of said City of Euless Park tract a distance of 688.07 feet to place of beginning, con- taining 16.31 acres of land more or less. ORDINANCE NO. 689, PAGE TWO OF FOUR II. Severability Clause. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. III. Penalty for Violation. Any person violating the provisions of this ordinance, or the amendments to the City of Euless Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more than Two Hundred ($200.00) Dollars, and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Charter and the Statutes of the State of Texas. IV. Effective Date. This ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 10th day of November, 1981, by a vote of 4 ayes, 0 nays, and 0 abstentions. GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting of the Euless City Council on the 24th day of November, 1981, by a vote of 3 ayes, 0 nays, and 1 abstentions. APPROVED: �P Harold D.
