HomeMy WebLinkAbout699 03-23-1982ORDINANCE NO. 699 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A CHANGE OF ZONING FROM "C -2" COMMUNITY BUSINESS DISTRICT TO "R -4" MULTI - FAMILY DWELLING DISTRICT FOR CERTAIN PROPERTY OUT OF THE JOHN GROVES SURVEY; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING A PENALTY AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. IT IS HEREBY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as hereinafter set forth. The zoning classification of the following described property, now zoned "C -2" Community Business District be changed to "R -4" Multi- Family Dwelling District. BEING a 4.448 acre tract of land out of the John Groves Survey, Euless, Tarrant County, Texas, and being further described by metes and bounds as follows: BEGINNING at a steel rod in the East ROW line of Raider Drive; said point also being the Northwest corner of a tract described in Volume 4776, Page 350, Deed Records, Tarrant County, Texas, and being the Southwest corner of Lot 12, Block 3, Bell -Hi Addition, Euless, Tarrant County, Texas, as recorded in Volume 388 -8, Page 132, Deed Records, Tarrant County, Texas, and being 442 varas South and 79 varas East of the Northwest corner of said Groves Survey; THENCE East, along the South line of said Block 3, Bell -Hi Addition, 381.0 feet to a steel rod being the Southeast corner of Lot 2, Block 3, said Addition; THENCE South, 0 degrees 04 minutes 45 seconds East, with fence line, 508.73 feet to a fence corner; THENCE North, 89 degrees 57 minutes 30 seconds West, 381.0 feet to a steel rod in said East ROW line of Raider Drive; THENCE North, 0 degrees 04 minutes 45 seconds West, along said East ROW line of Raider Drive, 508.45 feet to the place of beginning, and containing 4.448 acres of land, more or less; as specifically set forth in the application submitted by Applicant on January 20, 1982, which application is on file in the City of Euless Zoning Records and file attached to Zoning Case No. 358. SEVERABILITY CLAUSE: It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. III PENALTY FOR VIOLATION: Any person violating the provisions of this ordinance or the amendments to the City of Euless Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more than Two Hundred ($200.00) Dollars, and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Charter and the Statutes of the State of Texas. IV EFFECTIVE DATE: This ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 9th day of March, 1982, by a vote of 4 ayes, 1 nay, and 0 abstentions. GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting of the Euless City Council on the 23rd day of March, 1982, by a vote of 4 ayes, I nays, and 0 abstentions. APPROVED: Harold D.
