AN ORDINANCE AMENDING ORDINANCE NO. 347, IDEN-
TIFIED AS THE ZONING ORDINANCE OF THE CITY OF
EULESS, TEXAS; AMENDING THE CITY OF EULESS ZON-
ING MAP; PROVIDING FOR A CHANGE OF ZONING FROM
"C -2" COMMUNITY BUSINESS DISTRICT TO "C -2" COM-
MUNITY BUSINESS DISTRICT WITH "SP" SPECIFIC USE
PERMIT FOR COMMERCIAL AMUSEMENTS WITH BAR ON
CERTAIN PROPERTY OUT OF THE WILSHIRE VILLAGE
SHOPPING CENTER; PROVIDING FOR THE DEVELOPMENT
OF SUCH TRACT OF LAND ACCORDING TO APPROVED
SITE PLANS; PROVIDING FOR A SEVERABILITY CLAUSE;
PROVIDING A PENALTY AND AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
I.
IT IS HEREBY ORDERED THAT the Official District Zoning Map of the
City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as
hereinafter set forth.
The zoning classification of the following described property, now zoned
"C -2" Community Business District, be changed to "C -2" Community Business
District with "SP" Specific Use Permit for Commercial Amusements with Bar.
The following described tract or parcel of land being Tract B,
Tract C, and a portion of Tract A, WILSHIRE VILLAGE
SHOPPING CENTER, to the City of Euless, Tarrant County,
Texas, according to plat recorded on Page 7 of Volume 388-
95, in the Tarrant County Deed Records, and being more
particularly described as follows:
BEGINNING at the Northwest corner of said Tract B and
being the intersection of the South line of Sagebrush Trail
with the East line of Wilshire Drive;
THENCE N 89 degrees 26' E along the South line of said
Sagebrush Trail a distance of 1015.38 feet to the most
northerly Northeast corner of said Tract A;

S 0 degrees 46' E a distance of 70.0 feet;
THENCE
S 89 degrees 26' W a distance of 152.69 feet;
THENCE
S 0 degrees 34' E a distance of 90.7 feet to the
Southeast
corner of said Tract C;

S 89 degrees 26' W a distance of 612.13 feet to the
Southwest
corner of said Tract C;
THENCE
S 0 degrees 34' E a distance of 157.8 feet to the
Southeast
corner of said Tract B;
THENCE
S 89 degrees 26' W a distance of 180.0 feet;
THENCE
S 0 degrees 34' E a distance of 240.0 feet;
THENCE
S 89 degrees 26' W a distance of 70.0 feet to the
East line
of said Wilshire Drive;
THENCE
N 0 degrees 34' W along the East line of said
Wilshire Drive a distance of 558.5 feet to place of beginning,
containing 4.723 acres of land more or less,
as specifically set
forth in the site plan as submitted by Applicant and dated
March 23, 1982, revised May 18, 1982, which plan is on file in the City of Euless
Zoning Records and
file attached to Zoning Case No. 363.
II.
The plan submitted by Applicant and dated March 23, 1982, revised May
18, 1982, shall be incorporated in this ordinance by reference and made a part
hereof for all purposes as now set forth in full. Such plan dated March 23, 1982,
revised May 18, 1982, shall be applicable only to the property hereby rezoned.
III.
The applicable uses of land pursuant to Section 7- 1002(30) and (52), City
of Euless Zoning Ordinance No. 347, to be subject to the conditions as hereinafter
set forth.

OTHER CONDITIONS
(1) Building facade adjacent to Wilshire Drive will have no exits or service
areas.
(2) Off -duty Police Officers will be used for security on Friday and Saturday
nights during peak league season.
(3) Gross annual receipts from sale of alcoholic beverages will be less than
50% of total annual gross receipts.
(4) Exterior lighting plan as shown on site plan.
(5) Exterior lighting to be high pressure sodium with sharp cutoff.
(6) "No Loitering" signs will be placed throughout parking lot.
IV.
Severability Clause. It is hereby declared to the intention of the City
Council of the City of Euless that the sections, paragraphs, sentences, clauses,
and phrases of this ordinance are severable and if any phrase, clause, sentence,
paragraph, or section of this ordinance shall be declared unconstitutional by the
valid judgment or decree of any court of competent jurisdiction, such unconsti-
tutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs, or sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph, or section.
V.
Penalty for Violation. Any person violating the provisions of this
ordinance, or the amendments to the City of Euless Charter of 1961 hereby made,
shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more
than Two Hundred ($200.00) Dollars, and each day such violation shall be
permitted to exist shall constitute a separate offense, as provided by Ordinance
No. 347, and subsequent amendments to the Euless City Charter and the Statutes
of the State of Texas.

VI.
Effective Date. This ordinance shall be in full force and effect from
and after its passage as provided by the Euless City Charter and the laws of the
State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of the
Euless City Council on the 11th day of May, 1982, by a vote of 5 ayes, 0 nays,
and 0 abstentions.
GIVEN SECOND READING, PASSED, AND APPROVED at a regular
meeting of the Euless City Council on the 25th day of May, 1982, by a vote of
4 ayes, 0 nays, and 0 abstentions.
