HomeMy WebLinkAbout705 06-08-1982ORDINANCE NO. 705 AN ORDINANCE ESTABLISHING AN ADDITIONAL PENALTY NOT TO EXCEED FIFTEEN (15%) OF THE AMOUNT OF TAXES, PENALTY, AND INTEREST DUE THE CITY OF EULESS, TEXAS, FOR THE COSTS OF COLLECTION OF SAME; PROVIDING A SEVERABILITY CLAUSE; AND AN EFFECTIVE DATE. WHEREAS, Section 33.07 of the Property Tax Code provides that an additional penalty of not more than fifteen per cent (15 %) of the amount of taxes, penalty, and interest due be added to the amount of taxes and penalty and interest on taxes that remain delinquent on July 1 of the year in which they become delinquent if the taxing unit has contracted with an attorney to collect delinquent taxes; and WHEREAS, in order to defray the costs of collection of such delinquent taxes, the Euless City Council has determined that it is advantageous to the taxpayers of the City of Euless, Texas, to adopt the provisions of Section 33.07 of the Property Tax Code; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Euless, Texas, that: I. The provisions of Section 33.07, Property Tax Code, State of Texas, be and they are hereby adopted whereby an additional penalty of fifteen per cent (15 %) of the amount of delinquent taxes, and penalty and interest on delinquent taxes, be imposed and collected on taxes becoming delinquent after January 1, 1982. II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or sec- tion. '�j III. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 2 5th day of May, 1982; by a vote of 4 ayes, 0 nays and 0 abstentions; GIVEN SECOND READING AND APPROVED at a regular meeting of the Euless City Council on the 8th day of June, 1982; by a vote of 5 ayes, 0 nays ands— abstentions.
