AN ORDINANCE AMENDING ORDINANCE NO. 347, IDEN-
TIFIED AS THE ZONING ORDINANCE OF THE CITY OF
EULESS, TEXAS; AMENDING THE CITY OF EULESS ZON-
ING MAP; PROVIDING FOR A CHANGE OF ZONING FROM
"PD" PLANNED DEVELOPMENT TO "C -2" COMMUNITY
BUSINESS DISTRICT AND "CUD" CONFORMING HOUSING
FOR "R -1" TYPE SINGLE FAMILY DWELLINGS, "R -3," "R -4,"
AND "R -5" MULTI - FAMILY DWELLING DISTRICT DEN-
SITIES ON CERTAIN PROPERTY OUT OF THE LEVI FRAN-
KLIN SURVEY; PROVIDING FOR THE DEVELOPMENT OF
SUCH TRACT OF LAND ACCORDING TO APPROVED SITE
PLANS; PROVIDING FOR A SEVERABILITY CLAUSE; PRO-
VIDING A PENALTY AND AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
IT IS HEREBY ORDERED THAT the Official District Zoning Map of the
City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as
hereinafter set forth.
The zoning classification of the property described in Exhibit A,
attached hereto and made a part hereof as fully as if set forth herein, now zoned
"PD" Planned Development be changed to "C -2" Community Business District, and
"CUD" Conforming Housing for "R -1" type single family dwellings, "R -3," "R -4,"
and "R -5" Multi- Family Dwelling District densities, as specifically set forth in the
site plan as submitted by Applicant and dated July 12, 1982, and revised September
12, 1982, which plan is on file in the City of Euless Zoning Records and file
attached to Zoning Case No. 370.
The plan submitted by Applicant and dated July 12, 1982, revised
September 12, 1982, shall be incorporated in this ordinance by reference and made
a part hereof for all purposes as now set forth in full. Such plan dated July 12,
1982, revised September 12, 1982, shall be applicable only to the property hereby
rezoned.
III.
The applicable uses of land pursuant to applicable sections of the City
of Euless Zoning Ordinance No. 347, to be subject to the conditions as set forth
herein.
TRACT 2: 15.657 Acres -- zoning change from PD R -1 to CUD R -1. Residential
development standards will conform to R -1 District. No building or residence
shall be located nearer to the front lot line than 25 feet, nor nearer than 5 feet
on one side and 12 feet on the other side of each inner lot, nor nearer than 25
feet to any corner lot line. The ground floor space area of each residence
structure, exclusive of porches, garages and carports, shall be not less than 1,600
square feet living area„ and on split -level and two story residence structures, the
ground floor area shall not be less than 800 square feet living area, and must be
designed and built so that the ground floor shall consist of not less than 75%
masonry construction. The density will not be greater than forty -six (46) single
family lots.
TRACT 2A: 0.514 Acres -- zoning change from PD Commercial to C -2
Commercial. Development standards of C -2 District will apply.
TRACT 2B: 0.877 Acres -- zoning change from PD Service Station to C -2
Commercial. Development standards of C -2 District will apply.
TRACT 4: 3.841 Acres -- zoning change from PD Duplex (similar to R -3) to CUD
with development standards according to the R -3 District. Total density of the
site will not exceed twenty (20) units. A site plan conforming to the preliminary
plat requirements of the subdivision ordinance will be required at the time of
platting.
TRACT 5: 22.638 Acres -- zoning change from PD MF (similar to R -5) to CUD
with development standards according to the R -5 District. Total density of the
site will not exceed 21.62 dwelling units per gross acre. A development plan
conforming to the requirements of the Planned Development District shall be
submitted at the time of platting of all or a portion of the district. Approval
of the development plan shall require a public hearing before the Planning and
Zoning Commission of the City. Suitable screening will be provided along Bear
Creek Drive.
TRACT 6: 8.811 Acres -- zoning change from PD MF (similar to R -4) to CUD
with development standards according to the R -4 District. Total density of the
site will not exceed fifteen (15) dwelling units per gross acre. A development plan
conforming to the requirements of the Planned Development District shall be
submitted at the time of platting of all or a portion of the district. Approval
of the development plan shall require a public hearing before the Planning and
Zoning Commission of the City.
TRACT 7: 17.33 Acres -- zoning change from PD Shopping Center (similar to C-
2) to C -2 Commercial. A development plan conforming to the requirements of
the Planned Development District shall be submitted at the time of platting of
all or a portion of the tract.
TRACT 8: 10.008 Acres -- zoning change from PD Office Tower (similar to C-
2) to CUD with development standards according to the R -3 District. Total
density of the site will not exceed twelve (12) dwelling units per gross acre. A
site plan conforming to the preliminary plat requirements of the subdivision
ordinance will be required at the time of platting. Site plan will address the
building placement on the lots to minimize the visual access to the single family
residents on the north and west.

IV.
Severability Clause. It is hereby declared to the intention of the City
Council of the City of Euless that the sections, paragraphs, sentences, clauses,
and phrases of this ordinance are severable and if any phrase, clause, sentence,
paragraph, or section of this ordinance shall be declared unconstitutional by the
valid judgment or decree of any court of competent jurisdiction, such unconsti-
tutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs, or sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph, or section.
V.
Penalty for Violation. Any person violating the provisions of this
ordinance, or the amendments to the City of Euless Charter of 1961 hereby made,
shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more
than Two Hundred ($200.00) Dollars, and each day such violation shall be
permitted to exist shall constitute a separate offense, as provided by Ordinance
No. 347, and subsequent amendments to the Euless City Charter and the Statutes
of the State of Texas.
VI.
Effective Date. This ordinance shall be in full force and effect from
and after its passage as provided by the Euless City Charter and the laws of the
State of Texas.

Euless City Council on the 14th day of September, 1982, by a vote of 5 ayes, 0
nays, and 0 abstentions.
GIVEN SECOND READING, PASSED, AND APPROVED at a regular

of 5 ayes, 0 nays, and 0 abstentions.
