AN ORDINANCE AMENDING ORDINANCE NO. 347, IDEN-
TIFIED AS THE ZONING ORDINANCE OF THE CITY OF
EULESS, TEXAS; AMENDING THE CITY OF EULESS ZON-
ING MAP; PROVIDING FOR A CHANGE OF ZONING FROM
"R -1" SINGLE FAMILY DWELLING DISTRICT WITH SPECIAL
PERMIT FOR "CUD" VARIABLE HOUSING (R -3 DENSITY)
TO "SPUD" SPECIAL PLANNED UNIT DEVELOPMENT (TO-
WNHOME) ON CERTAIN PROPERTY OUT OF THE R. D.
PRICE SURVEY, A -1206; PROVIDING FOR THE DEVELOP-
MENT OF SUCH TRACT OF LAND ACCORDING TO AP-
PROVED SITE PLANS; PROVIDING FOR A SEVERABILITY
CLAUSE; PROVIDING A PENALTY AND AN EFFECTIVE
DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
I.
IT IS HEREBY ORDERED THAT the Official District Zoning Map of the
City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as
hereinafter set forth.
The zoning classification of the following described property, now zoned
"R -1" Single Family Dwelling District with Special Permit for "CUD" Variable
Housing (R -3 Denisty), be changed to "SPUD" Special Planned Unit Development
(Townhome).
Being a tract or parcel of land situated in the City of Euless, Tarrant County,
Texas; and being a part of the R. D. Price Survey, Abstract 1206; and being part
of that tract of land conveyed to McCormick Development Corporation by deed
recorded in Volume 6869, Page 2205, of the Deed Records of Tarrant County,
Texas; and being more particularly described as follows:
'BEGINNING at a 1/2 inch diameter iron rod for corner, said point being South
89 degrees 34 minutes 30 seconds West, along the south line of said Price Survey,
a distance of 30.00 feet from the southeast corner of said Price Survey;
"THENCE South 89 degrees 34 minutes 30 seconds West, along the south line of
said Price Survey, a distance of 2563.74 feet to a 1/2 inch diameter iron rod for
corner in the east line of North Main Street;
"THENCE North 12 degrees 41 minutes 50 seconds West, along the east line of
North Main Street, a distance of 319.39 feet to a 1/2 inch diameter iron rod for
corner;
"THENCE South 78 degrees 32 minutes 25 seconds West, a distance of 85.81 feet
to a nail for corner in the centerline of said North Main Street;
"THENCE North 22 degrees 02 minutes 35 seconds West, along the centerline of
said North Main Street, a distance of 193.44 feet to a nail for corner;
"THENCE North 14 degrees 04 minutes 25 seconds West, along the centerline of
said North Main Street, a distance of 50.49 feet to a nail for corner;
"THENCE North 09 degrees 00 minutes 35 seconds West, along the centerline of
said North Main Street, a distance of 160.85 feet to a nail for corner;
"THENCE North 00 degrees 24 minutes 50 seconds East, along the centerline of
said North Main Street, a distance of 50.54 feet to a nail for corner;
"THENCE North 83 degrees 51 minutes 35 seconds East, a distance of 733.38 feet
to a 1/2 inch diameter iron rod for corner;
"THENCE North 00 degrees 24 minutes 50 seconds East, a distance of 562.88 feet
to a 1/2 inch diameter iron rod for corner in the proposed centerline of Cheek
Sparger Road (132 feet proposed width);
"THENCE North 89 degrees 41 minutes 18 seconds East, along the centerline of
said Cheek Sparger Road, a distance of 218.27 feet to a 1/2 inch diameter iron
rod for corner;
"THENCE South 00 degrees 18 minutes 42 seconds East, a distance of 141.00 feet
to a 1/2 inch diameter iron rod for corner;
"THENCE South 08 degrees 10 minutes 00 seconds East, a distance of 215.54 feet
to a 1/2 inch diameter iron rod for corner;
"THENCE South 00 degrees 56 minutes 33 seconds East a distance of 135.06 feet
to a 1/2 inch diameter iron rod for corner;
"THENCE South 04 degrees 34 minutes 14 seconds East, a distance of 204.06 feet
to a 1/2 inch diameter iron rod for corner;
"THENCE South 01 degrees 19 minutes 02 seconds West, a distance of 139.06 feet
to a 1/2 inch diameter iron rod for corner;
"THENCE South 16 degrees 30 minutes 08 seconds East, a distance of 140.08 feet
to a 1/2 inch diameter iron rod for corner;

to the POINT OF BEGINNING, and containing 1,183,102 square feet or 27.1603
acres of land, more or less ";
as specifically set forth in the site plan as submitted by Applicant, which plan is
on file in the City of Euless Zoning Records and file attached to Zoning Case No.
372.
II.
The plan submitted by Applicant shall be incorporated in this ordinance
by reference and made a part hereof for all purposes as now set forth in full.
Such plan shall be applicable only to the property hereby rezoned.
III.
The applicable uses of land pursuant to Section 7 -300, City of Euless
Zoning Ordinance No. 347, to be subject to the conditions as hereinafter set forth.

1) All private drives will contain a 20' wide access, firelane, and utility
easement (maintenance to be by homeowner's association).
2) A wood screening fence will be provided along Main Street and Cheek
Sparger Road frontage.
3) 10 Indicates 10x10 screened dumpster location.
4) If abandonment of Main Street does not take place, there will be a shift
of buildings in the southwest corner of the' site, with a subsequent
loss of lots.
5) All firelanes shall be striped and shall have a minimum outside turning
radius of 35'.

SPECIFIC CONDITIONS
1) A perpetual maintenance agreement shall be provided which affects
the driveways and creek area adjacent to the property on the east side. The
proposed permanent community open space is to be included until it has been
accepted as a City park.
2) The City makes no committment at this time as to the exact
location of the horizontal curve or property line location along North Main Street;
that these items be addressed at the time of final platting. The Planning &
Zoning Commission reserves the right at that time to disprove the horizontal
control information. The developer is to stake the horizontal curve locations
prior to going to City Council.
3) The developer shall provide enough room on the 20' driveway
sections to allow the dumpsters to be picked up and still be screened.
4) Parking adjacent to fire hydrants shall be situated so that there will
be no loss of required parking spaces and overall guest parking spaces.
5) Water meters shall be located in such manner that they will
accommodate the meters and be protected from vehicular traffic.
6) Streets and drives in the addition shall be concrete.
7) The developer shall provide a homeowner's agreement to be
reviewed at the time of final platting. Investigation shall be conducted by legal
staff to insure that adequate provisions are included to enforce the perpetual
maintenance agreement for both the private streets and the drainage adjacent to
the property.
IV.
Severability Clause. It is hereby declared to be the intention of the
City Council of the City of Euless that the sections, paragraphs, sentences,
clauses, and phrases of this ordinance are severable and if any phrase, clause,
sentence, paragraph, or section of this ordinance shall be declared uncon-
stitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs, or sections of this ordinance, since the same would have
been enacted by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase, clause, sentence, paragraph, or section.

Penalty for Violation. Any person violating the provisions of this
ordinance, or the amendments to the City of Euless Charter of 1961 hereby made,
shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more
than Two Hundred ($200.00) Dollars, and each day such violation shall be
permitted to exist shall constitute a separate offense, as provided by Ordinance
No. 347, and subsequent amendments to the Euless City Charter and the Statutes
of the State of Texas.

Effective Date. This ordinance shall be in full force and effect from
and after its passage as provided by the Euless City Charter and the laws of the
State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of the
Euless City Council on the 12th day of October, 1982, by a vote of 3 ayes, 1 nay,
and 1 abstention.
GIVEN SECOND READING, PASSED, AND APPROVED at a regular
meeting of the Euless City Council on the 9th day of November, 1982, by a vote
of 4 ayes, 1 nays, and 0 abstentions.
