HomeMy WebLinkAbout722 12-21-1982ORDINANCE NO. 722 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDEN- TIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZON- ING MAP; PROVIDING FOR A CHANGE OF ZONING FROM "C -2" COMMUNITY BUSINESS DISTRICT TO "R -3" AND "R- 4" MULTI - FAMILY DWELLING DISTRICTS WITH "CUD" FOR CONFORMING HOUSING ON CERTAIN PROPERTY OUT OF THE J. GROVES SURVEY, A -599; PROVIDING FOR THE DEV- ELOPMENT OF SUCH TRACT OF LAND ACCORDING TO APPROVED SITE PLANS; PROVIDING FOR A SEVER - ABILITY CLAUSE; PROVIDING A PENALTY AND AN EF- FECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. IT IS HEREBY ORDERED THAT the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as hereinafter set forth. The zoning classification of the property described herein, now zoned "C -2" Community Business District be changed to "R -3" and "R -4" Multi- Family Dwelling District with "CUD" for Conforming Housing, as specifically set forth in the site plan as submitted by Applicant and dated September 7, 1982, revised November 4, 1982, and having a final revision date of November 24, 1982, which plan is on file in the City of Euless Zoning Records and file attached to Zoning Case No. 373. BEING 22.68 acres of land located in the John Groves Survey, Abstract No. 599, Tarrant County, Texas, and being a portion of the tract of land conveyed to Colonial Properties, Inc., Trustee, by Deed recorded in Volume 6056, Page 232 of the Deed Records of Tarrant County, Texas; being more particularly described by metes and bounds as follows: BEGINNING at an iron pin in the South right -of -way line of Pipeline Road, said point being 25.00 feet South, and 588.9 feet West of the Northeast corner of said Groves Survey, and in a fence corner; THENCE S 00 degrees 23' West along an old fence line a distance of 885.10 feet; THENCE S 67 degrees 19' West a distance of 535.17 feet; THENCE S 22 degrees 41' East a distance of 200.00 feet, to a point in the North right -of -way line of State Highway 10; THENCE S 67 degrees 19' West along said right -of -way line a distance of 472.08 feet, to an iron pin at a fence corner; THENCE N 00 degrees 22' East along an old fence line a distance of 1458.22 feet, to an iron pin at a fence corner in the South right -of -way line of Pipeline Road; THENCE S 89 degrees 59' East along said South right -of -way line of Pipeline Road a distance of 848.80 feet, to the PLACE OF BEGINNING, and containing 22.68 acres of land, more or less. The plan submitted by Applicant shall be incorporated in this ordinance by reference and made a part hereof for all purposes as now set forth in full. Such plan shall be applicable only to the property hereby rezoned. III. The applicable uses of land pursuant to Section 7 -1108, City of Euless Zoning Ordinance No. 347, to be subject to the conditions as hereinafter set forth. A detailed site plan to meet the specification of Section 7 -1107 of the City of Euless Zoning Ordinance shall be approved by the Euless City Council, after recommendation of the Planning & Zoning Commission before the issuance of any building permits on this site. Severability Clause. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared uncon- stitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. V. Penalty for Violation. Any person violating the provisions of this ordinance, or the amendments to the City of Euless Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more than Two Hundred ($200.00) Dollars, and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Charter and the Statutes of the State of Texas. VI. Effective Date. This ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 23rd day of November, 1982, by a vote of 4 ayes, 0 nays, and 0 abstentions. GIVEN SECOND READING, PASSED, AND APPROVED at a called meeting of the Euless City Council on the 21st day of December, 1982, by a vote of 4 ayes, 0 nays, and 0 abstentions.
