AN ORDINANCE AMENDING ORDINANCE NO. 347, IDEN-
TIFIED AS THE ZONING ORDINANCE OF THE CITY OF
EULESS, TEXAS; AMENDING THE CITY OF EULESS ZON-
ING MAP; PROVIDING FOR A CHANGE OF ZONING FROM
"R -1" SINGLE FAMILY DWELLING DISTRICT, TO "R -3"
MULTI- FAMILY DWELLING DISTRICT WITH "CUD" FOR
TOWNHOMES, ON CERTAIN PROPERTY OUT OF THE J. P.
HALFORD SURVEY, A -711; PROVIDING FOR THE DEV-
ELOPMENT OF SUCH TRACTS OF LAND ACCORDING TO
APPROVED SITE PLANS; PROVIDING FOR A SEVER -
ABILITY CLAUSE; PROVIDING A PENALTY AND AN EF-
FECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
I.
IT IS HEREBY ORDERED THAT the Official District Zoning Map of the
City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as
hereinafter set forth.
The zoning classification of the property described herein, now zoned
"R -1" Single Family Dwelling District, be changed to "R -3" Multi- Family Dwelling
District with "CUD" for Townhomes, as specifically set forth in the site plan as
submitted by Applicant and dated January 11, 1983, revised January 17, 1983,
such plan is on file in the City of Euless Zoning Records and file attached to
Zoning Case No. 388.
The following described tract or parcel of land situated in the J. P. Halford
Survey, A -711, Tarrant County, Texas, and being more particularly described as
follows:
BEGINNING at the Southeast corner of Lot 21, Block 20, Midway Park Addition,
No. 2, to the City of Euless, Tarrant County, Texas, according to plat recorded
on Page 79 of Volume 388 -13 in the Tarrant County Deed Records;
THENCE N 88 degrees 43' W along the South line of said Lot 21 a distance of
124.91 feet to the Southwest corner of said Lot 21 and being in the East line of
Himes Drive;
THENCE S 2 degrees 30' 20" W along the East line of said Himes Drive a distance
of 319.13 feet;
THENCE S 88 degrees 38' 10" E, at a distance of 9.6 feet the Northwest corner
of Tract C -R, MUNICIPAL SERVICE COMPANY OF TEXAS, to the City of
Euless, Tarrant County, Texas, according to plat recorded on Page 42 of Volume
388 -63 in the Tarrant County Deed Records, a total distance of 1058.62 feet to
the West line of North Main Street;

II.
The plan submitted by Applicant shall be incorporated in this ordinance
by reference and made a part hereof for all purposes as now set forth in full.
Such plan shall be applicable only to the property hereby rezoned.
III.
The applicable uses of land pursuant to Section 7 -300 and 7- 1109(1),
City of Euless Zoning Ordinance No. 347, to be subject to the conditions as
hereinafter set forth.
"R -3" Multiple - Family Low Density Dwelling District: Limit of Twelve (12) Units
Per Acre
Townhomes (Three or More Single Family Attached Dwellings)
1) Lot Area -- The minimum lot area per dwelling structure shall be
2,200 square feet.
2) Lot Width -- The minimum lot width between center to center four
inch fire walls shall be 22 feet.
3) Lot Depth -- The minimum lot depth shall be 100 feet.
4) Front Yards -- The minimum depth of front yards on public streets
shall be 25 feet. The minimum depth of the front yard on interior private drives
shall be 20 feet.
5) Rear Yards -- (A) The minimum depth of interior rear yards shall
be 20 feet. (B) The minimum depth of the exterior rear yards shall be 25 feet
from the property line and public roads.

6) Side Yards -- (A) On lots having single family attached dwelling
units, no side yard is required except that no contiguous attached structure shall
exceed one hundred and eighty (180) feet in length, and the minimum separation
between structures shall be twenty (20) feet. (B) Side yards next to property line
or public streets shall be twenty -five (25) feet.
7) Parking -- There shall be two parking spaces per dwelling unit in
Single Family Attached Dwellings; these parking spaces may be on the lot proper
or on common or community property located within 200 feet from the lot or lots
to be served. However, no parking shall be allowed in the required front yard.
Parking spaces shall meet the requirements of SECTION 8.
8) Special Construction Requirements for Townhomes -- The common
walls in any Townhome shall be constructed as a double wall unit that meets a
two -hour fire rating and has an approved soundboard integrated between wall
studs that are staggered and offset along either side of such soundboard. Such
double wall unit shall be constructed in its entirety to the roof deck and shall
meet the requirements of the Euless Building Code. Townhome units shall each
have a minimum floor area of not less than eleven hundred (1100) square feet and
shall not exceed a maximum building height of forty -five feet. (Ord. No. 664, §

Construction Requirements for All Multiple- Family Zoning Districts
1) All buildings hereafter erected in the Multiple - Family Dwelling
Districts shall have eighty percent (80 %) masonry veneer on all exterior wall
elevations. The required eighty percent (80 %) masonry veneer requirement shall
be calculated by finding eighty percent (80 %) of the area that describes the
exterior wall elevation, exclusive of windows and doors and inclusive of any
appendages to the wall. (Ord. No. 664, § IV, 6/23/81)
2) In all Multiple - Family Dwelling Districts, all buildings must be
located within one hundred (100) feet of a fire easement.
3) Height of the buildings usable living space = 45 feet.
4) Minimum amount of masonry provided per building elevation = 80 %.
5) Parking per Section 8 of the City of Euless Zoning Ordinance.
6) Signs per Section 9 of the City of Euless Zoning Ordinance.
7) Screening per Section 10 of the City of Euless Zoning Ordinance,
and will be a solid wooden fence.

ADDITIONAL REQUIREMENTS
1) No vehicular or pedestrian access to Himes Drive except (1)
pedestrian entry point in an easement as shown on site plan.
2) A perpetual maintenance agreement covering the maintenance of all
common open space, easements, and fire lanes which has been reviewed by the
City Attorney and has been accepted by the City Council shall be required at the
time of platting.
3) The Developer commit in writing to the paving of Byers Drive.
4) Developer will pave fire lanes to meet City street standards.
5) There will be a review of the site plan by the Planning and
Development Department.
IV.
Severability Clause. It is hereby declared to be the intention of the
City Council of the City of Euless that the sections, paragraphs, sentences,
clauses, and phrases of this ordinance are severable and if any phrase, clause,
sentence, paragraph, or section of this ordinance shall be declared uncon-
stitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs, or sections of this ordinance, since the same would have
been enacted by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase, clause, sentence, paragraph, or section.

Penalty for Violation. Any person violating the provisions of this
ordinance, or the amendments to the City of Euless Charter of 1961 hereby made,
shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more
than Two Hundred ($200.00) Dollars, and each day such violation shall be
permitted to exist shall constitute a separate offense, as provided by Ordinance
No. 347, and subsequent amendments to the Euless City Charter and the Statutes
of the State of Texas.
VI.
Effective Date. This ordinance shall be in full force and effect from
and after its passage as provided by the Euless City Charter and the laws of the
State of Texas.
