HomeMy WebLinkAbout735 04-12-1983ORDINANCE NO. 735 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A CHANGE OF ZONING FROM "PD" PLANNED DEVELOPMENT "R -2" TWO FAMILY DWELLING DISTRICT TO "PD" PLANNED DEVELOPMENT "R -2" TWO FAMILY DWELLING DISTRICT WITH REVISED DEVELOPMENT PLAN, ON CERTAIN PROPERTY OUT OF THE J.E. FIELD SURVEY, A -540; PROVIDING FOR THE DEVELOPMENT OF SUCH TRACT OF LAND ACCORDING TO APPROVED DEVELOPMENT PLANS; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING A PENALTY AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 IT IS HEREBY ORDERED THAT the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as hereinafter set forth. The zoning classification of the property described herein, now zoned "PD" Planned Development "R -2" Two - Family Dwelling District, be changed to "PD" Planned Development "R -2" Two - Family Dwelling District with Revised Development Plan, as specifically set forth in the development plan as submitted by Applicant and dated January 5, 1983, Revised January 19, 1983, such plan is on file in the City of Euless Zoning Records and file attached to Zoning Case No. 384. The following described tract or parcel of land situated in the J. E. Field Survey, A -540, Tarrant County, Texas, and being more particularly described as follows: BEGINNING in the centerline of County Road No. 3036 (Glade Road) and being West a distance of 572.2 feet from the Northeast corner of said J. E. Field Survey, and the intersection of the centerline of said County Road No. 3036 (Glade Road) with the centerline of County Road No. 3129 (North Main Street); THENCE West along the centerline of said County Road No. 3036 (Glade Road) a distance of 516.9 feet; THENCE S 0 degrees 12' 30" W, at a distance of 25.0 feet the South line of said County Road No. 3036 (Glade Road), a total distance of 1318.56 feet; THENCE S 89 degrees 50' E a distance of 519.81 feet; THENCE S 89 degrees 49' 40" E, at a distance of 442.16 feet the West line of said County Road No. 3129 (North Main Street), a total distance of 467.24 feet to the centerline of said County Road No. 3129 (North Main Street); THENCE N 4 degrees 42' E along the centerline of said County Road No. 3129 (North Main Stret) a distance of 780.5 feet; THENCE West, at a distance of 25.08 feet the West line of said County Road No. 3129 (North Main Street), a total distance of 234.78 feet; THENCE North a distance of 174.0 feet; THENCE N 88 degrees 37' 30" W a distance of 295.1 feet; THENCE N 0 degrees 05' E, at a distance of 337.5 feet the South line of said County Road No. 3036 (Glade Road), a total distance of 362.5 feet to place of beginning, containing 25.799 acre with 0.296 acres being occupied by said County Road No. 3036 (Glade Road) and with 0.448 acre being occupied by said County Road No. 3129 (North Main Street) leaving a net acreage of 25.055 acres of land. SECTION 2 The plan as submitted by Applicant shall be incorporated in this ordinance by reference and made a part hereof for all purposes as now set forth in full. Such plan shall be applicable only to the property hereby rezoned. SECTION 3 The applicable uses of land pursuant to Section 7- 1103(1), City of Euless Zoning Ordinance No. 347, to be subject to the conditions as hereinafter set forth. BUILDINGS: R -2 Maximum Height -- 35 feet or 2 -1/2 stories Minimum Floor Area - 1,000 square feet Maximum Floor Area -- 1,250 square feet Minimum Floor Area for any combination of two units be set at 25% at 2,000 square feet; 25% at 2,100 square feet; and 50% at 2,200 square feet. ORDINANCE NO. 735, PAGE TWO OF FIVE SITE: Density -- 7.16 lots /acre Site Coverage (% of total tract covered with buildings using maximum building size on typical lot size) -- 30.0% Minimum Building Spacing -- 20 feet Yard Setback Requirements: Minimum front yard -- 15 feet Minimum side yard -- 10 feet Minimum rear yard -- 15 feet Lot Size Requirements Minimum Width - 32 feet Minimum Depth - N/A Minimum Area -- 3,750 square feet Open Space -- 68.0% TRAFFIC: nTHF R Public Streets 50' dedicated right -of -way 31' pavement back to back 6" curb - 30" guter (curb inclusive) 5" HMAC pavement 6" stabilized subgrade Pedestrian Ways 3' wide concrete sidewalks along both sides of public streets Minimum off - street parking -- 2 per unit (screened per Section 10 -104) provided at rear of units Landscaping -- no requirements Signs -- Same as for R -1 Masonry Requirements - 80% except for rear elevation Acres -- 24.58 acres net Number of Units -- 176 Screening Fences -- along North Main and commercial tract and Glade Road in accordance with Section 10 -104 NOTES: 1) All building lines shall be 15' front, 10' side, and 15' rear, except as shown. 2) All utility easements shall be 7 -1/2' and 15', except as shown. 3) All street intersections shall have a 25' x 25' public open space easement as shown. 4) All corners shall be set with 5/8" iron rods. ORDINANCE NO. 735, PAGE THREE OF FIVE 5) No driveway shall be permitted access to Glade Road or North Main Street. 6) Sidewalks shall be 3' in width, P off property line on all streets. 7) All drive curb returns shall be 5' radius and shall terminate within the limits of the subject lot dimensions. SECTION 4 Severability Clause. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared uncon- stitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION 5 Penalty for Violation. Any person violating the provisions of this ordinance, or the amendments to the City of Euless Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more than Two Hundred ($200.00) Dollars, and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Charter and the Statutes of the State of Texas. SECTION 6 Effective Date. This ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 22nd day of March, 1983, by a vote of 5 ayes, 0 nays, and 0 abstentions.
