HomeMy WebLinkAbout738 05-10-1983ORDINANCE NO. 738 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A CHANGE OF ZONING FROM "PD" PLANNED DEVELOPMENT TO "PD" PLANNED DEVELOPMENT WITH NEW DEVELOPMENT PLAN FOR OFFICES, MULTI - FAMILY & OPEN SPACE ON CERTAIN PROPERTY OUT OF THE T. JASPER SURVEY, A -861; PROVIDING FOR DEVELOPMENT OF SUCH TRACTS OF LAND ACCORDING TO APPROVED DEVELOPMENT PLANS; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING A PENALTY AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 IT IS HEREBY ORDERED THAT the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as hereinafter set forth. The zoning classification of the property described herein, now zoned "PD" Planned Development be changed to "PD" Planned Development with New Development Plan for offices, multi- family dwellings and open space, as specifically set forth in the development plan as submitted by Applicant and reflecting a revised date of February 1, 1983, again Revised May 1983, such plan on file in the City of Euless Zoning Records and file attached to Zoning Case No. 391. SITUATED in the City of Euless, Tarrant County, Texas, and being a tract of land in the T. JASPER SURVEY, Abstract No. 861, and being a portion of that certain 25 acre tract as recorded in Volume 1355, Page 218, Deed Records of Tarrant County, Texas, and also being a portion of a 10 acre tract as recorded in Volume 2544, Page 319, of said Deed Records, and being more particularly described as follows: COMMENCING at a Texas Highway Department monument in the South line of State Spur No. 350, said point being the Northwest corner of said 25 acre tract; Thence North 89 degrees 53 minutes 40 seconds East with said South line of Spur No. 350, 833.03 feet to the PLACE OF BEGINNING OF THE TRACT HEREIN DESCRIBED; THENCE North 89 degrees 53 minutes 40 seconds East with said South line of Spur No. 350, 300.0 feet to an iron rod for the Northwest corner of a 6 acre tract recorded as Tract 2 in Volume 6827, Page 2163, of the Deed Records of Tarrant County, Texas; THENCE South 0 degrees 31 minutes 19 seconds East with the West line of said 6 acre tract and the East line of said 10 acre tract, 1251.35 feet to an iron rod for the Southwest corner of a 3 acre tract conveyed to the City of Euless as recorded in Volume 5202, Page 127, of the Deed Records of Tarrant County, Texas; THENCE South 89 degrees 22 minutes 32 seconds West, 340.0 feet with the South line of said 10 acre tract in the Southwest corner of said 10 acre tract; THENCE South 1 degree 16 minutes 23 seconds East, 170.48 feet to an iron rod for corner; THENCE South 88 degrees 35 minutes 27 seconds West, 105.23 feet to an iron rod for corner; THENCE North 1 degree 16 minutes 23 seconds West, 1027.57 feet to an iron rod; THENCE North 89 degrees 56 minutes 07 seconds East, 156.03 feet to an iron rod; THENCE North 0 degrees 27 minutes 33 seconds West, 400.0 feet to the PLACE OF BEGINNING, and containing 12.003 acres of land, more or less. SECTION 2 The plan as submitted by Applicant shall be incorporated in this ordinance by reference and made a part hereof for all purposes as now set forth in full. Such plan shall be applicable only to the property hereby rezoned. SECTION 3 The applicable uses of land pursuant to Section 7- 1103(21), City of Euless Zoning Ordinance No. 347, to be subject to the conditions as hereinafter set forth. CONDITIONS OF TRACT A (NORTHERNMOST 2.5 + ACRES) USES PERMITTED -- As permitted by Section 7- 1103(21) of the Euless Zoning Ordinance No. 347 SITE REQUIREMENTS (1) Site Development (A) Site Coverage -- 20% (B) Parking -- 230 cars; location in accordance with site plan (2) Minimum Yards (A) Front -- 140 feet (B) Rear -- 70 feet (C) Side - 100 feet (D) Side -- 70 feet ORDINANCE NO. 738, PAGE TWO OF FIVE BUILDING REQUIREMENTS -- (1) Height of the building -- 3 stories or 60 feet, whichever is less (2) Gross building area -- 64,000 sq ft (3) Minimum amount of masonry for exterior walls -- 90% (4) Parking per Section 8 of the City of Euless Zoning Ordinance No. 347 (5) Sign as per Section 9 of the City of Euless Zoning Ordinance No. 347 (6) Screening as indicated on Development Plan and in accordance with Section 10, City of Euless Zoning Ordinance No. 347 CONDITIONS OF TRACT B (SOUTHERNMOST 9.5 + ACRES) SITE REQUIREMENTS -- (1) Development Mix (A) Site Denisty -- 17.22 DU /A (B) Site Coverage -- 20% (C) Parking -- 340 cars; location (2) Minimum Land Size (A) Land Area per according to development plan (1) one - bedroom -- 2450 square feet (2) two - bedrooms -- 2665 square feet (3) Minimum Yards (A) Front -- 50 feet (B) Rear -- 200 feet (C) Side 1 -- 50 feet (D) Side 2 -- 50 feet (E) Minimum Distances Between (1) two blank walls -- 20 feet (2) blank wall & window /door wall -- 25 feet (3) two walls both having windows /doors -- 30 feet BUILDING REQUIREMENTS (1) Floor Areas (A) Minimum one - bedroom unit -- 614 square feet (B) Minimum two - bedroom unit -- 979 square feet (2) Unit Mixture (A) Number of one - bedroom units -- 108 / 65.85% of total (B) Number of two- bedroom units -- 56 / 34.15% of total (3) Height of the buildings usable living space -- 25 feet (4) Minimum amount of masonry provided per building elevation -- 80% (5) Parking per Section 8 of the City of Euless Zoning Ordinance No. 347 (6) Signs per Section 9 of the City of Euless Zoning Ordinance No. 347 (7) Screening per Section 10 of the City of Euless Zoning Ordinance No. 347 SPECIAL CONDITIONS OF TRACT B -- Treatment of all drainage ways on Tract B shall be in conformance with subdivision ordinance requirements for same. Should drainage ways be left in their natural state, a variance as prescribed in the subdivision ordinance must be approved by the City Council and the following shall be supplied at the time of preparation of the preliminary plat for the tract: (1) a perpetual maintenance agreement to conform to the requirements of the City Attorney shall be submitted with the preliminary plat of this tract; and (2) limits of the 100 -year flood plain shall be indicated on the preliminary plat as a proposed drainage easement. ORDINANCE NO. 738, PAGE THREE OF FIVE SECTION 4 Severability Clause. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconsti- tutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION 5 Penalty for Violation. Any person violating the provisions of this ordinance, or the amendments to the City of Euless Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more than Two Hundred ($200.00) Dollars, and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Charter and the Statutes of the State of Texas. SECTION 6 Effective Date. This ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 26th day of April, 1983, by a vote of 5 ayes, 0 nays, and 0 abstentions. GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting of the Euless City Council on the 10th day of May, 1983, by a vote of 4 ayes, 0 nays, and 0 abstentions. APPROVED: Harold D.
