AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED
AS THE ZONING ORDINANCE OF THE CITY OF EULESS,
TEXAS; AMENDING THE CITY OF EULESS ZONING MAP;
PROVIDING FOR A CHANGE OF ZONING FROM "R -1" SINGLE
FAMILY DWELLING DISTRICT TO "C -2" COMMUNITY BUSINESS
DISTRICT AND COMMUNITY UNIT DEVELOPMENT WITH CON-
FORMING HOUSING TO THE "R -4" AND "R -5" MULTI - FAMILY
DWELLING DISTRICTS ON CERTAIN PROPERTY OUT OF THE
B. HARRINGTON SURVEY, A -808, AND THE LEVI FRANKLIN
SURVEY, A -513; PROVIDING FOR THE DEVELOPMENT OF SUCH
TRACTS OF LAND ACCORDING TO APPROVED PLANS: PRO-
VIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR A
PENALTY AND AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS:
SECTION 1
IT IS HEREBY ORDERED THAT the Official Zoning Map of the City of Euless,
Texas, being a part of Ordinance No. 347, be amended to read as hereinafter set
forth.
The zoning classification of the property described in Exhibit "A" attached hereto
and made a part hereof as fully as if stated herein, now zoned "R -1" Single - family
Dwelling District, be changed to "C -2" Community Business District and Com-
munity Unit Development with Conforming Housing to the "R -4" and "R -5" Multi-
family Dwelling Districts, as specifically set forth in the plan as submitted by
applicant and dated November 1982. Such plan being on file in the City of Euless
Zoning Records and file attached to Zoning Case No. 389.
SECTION 2
The plan as submitted by applicant shall be incorporated in this ordinance by
reference and made a part hereof for all purposes as now set forth in full. Such
plan shall be applicable only to the property hereby rezoned.
SECTION 3
The applicable uses of land pursuant to Section 7 -500 for Tracts 1, 4, and 7;
Section 7 -311 for Tracts 3 and 6; and Section 7 -312 for Tracts 2, 5, and 8, City
of Euless Zoning Ordinance No. 347, to be subject to the conditions as hereinafter
set forth.
Tracts 1, 4, 7, as described herein, subject to the "C -2" Community Business
District Regulations, as prescribed uses thereon by the City of Euless Zoning
Ordinance No. 347.
Tracts 2, 3, 5, 6, and 8, as described herein, subject to the "R -4" and "R-
5" Multi - family Dwelling District Regulations, as prescribed by the City of
Euless Ordinance No. 347, with a permanent restriction of not more than 620
dwelling units totaled, and further restricting Tracts 3 and 6 only to not
more than a maximum density of 16 dwelling units per acre; and Tracts 2, 5,
and 8 to not more than a maximum density of 22 dwelling units per acre.
SECTION 4
Severability Clause. It is hereby declared to be the intention of the City
Council of the City of Euless that the sections, paragraphs, sentences,
clauses, and phrases of this ordinance are severable; and if any phrase,
clause, sentence, paragraph, or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of.any court of competent
jurisdiction, such unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs, or sections of this ordinance,
since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional phrase, clause,
sentence, paragraph, or section.
SECTION 5
Penalty for Violation. Any person, firm, or corporation violating the terms
and provisions of this ordinance, or the amendments to the City of Euless
Charter hereby made, shall be deemed guilty of a misdemeanor and, upon
conviction thereof, shall be liable to a fine in an amount not to exceed Two
Hundred ($200.00) Dollars, and each day such violation shall be permitted to
exist shall constitute a separate offense, as provided by Ordinance No. 347,
and subsequent amendments to the Euless City Charter and the Statutes of the
State of Texas.
SECTION 6
Effective Date. This ordinance shall be in full force and effect from and
after its passage as }provided by the Euless City Charter and the laws of the
State of Texas.

Council on the 26th day of April, 1983, by a vote of 5 ayes, 0 nays, and 0
abstentions.
