HomeMy WebLinkAbout742 06-28-1983ORDINANCE NO. 742 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A CHANGE OF ZONING FROM "R -1" SINGLE FAMILY DWELLING DISTRICT TO COMMUNITY UNIT DEVELOPMENT "CUD" CONFORMING HOUSING TO THE SINGLE FAMILY ATTACHED REGULATIONS DESCRIBED HEREIN, ON CERTAIN PROPERTY OUT OF THE J. E. FIELD SURVEY, A -540; PROVIDING FOR THE DEVELOPMENT OF SUCH TRACT OF LAND ACCORDING TO APPROVED SITE PLANS; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING A PENALTY AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 IT IS HEREBY ORDERED THAT the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as hereinafter set forth . The zoning classification of the property described herein, now zoned "R -1" Single- Family Dwelling District be changed to Community Unit Development "CUD" Conforming Housing to the Single Family Attached regulations and standards described herein, as specifically set forth in the site plan dated June 1983. Such plan, as submitted by applicant, shall be on file in the City of Euless Zoning Records and file attached to Zoning Case No. 395. The following described tract or parcel of land situated in the J. E. Field Survey, A -540, Tarrant County, Texas, and being a 3.58 acre tract as recorded on Page 938 of Volume 6489, and a portion of a 3.611 acre tract as recorded on Page 755 of Volume 5075 in the I- arrant County Deed Records, and being more particularly described as follows: BEGINNING in the center line of Field -Doss Road, and being about south, a distance of 541.2 feet from the northwest corner of said J. E. Field Survey; THENCE, East, a distance of 276.6 feet to the southeast corner of a 0.896 acre tract, as recorded on Page 27 of Volume 6862 in the Tarrant County Deed Records; THENCE, north, a distance of 150.0 feet to the northeast corner of said 0.896 acre tract; THENCE, east, a distance of 243.8 feet to the northeast corner of said 3.611 acre tract; THENCE, south, a distance of 600.0 feet to the southeast corner of said 3.5 8 acre tract; THENCE, west, a distance of 520.4 feet to the center line of said Field -Doss Road; THENCE, north along the center line of said Field -Doss Road, a distance of 450.0 feet to place of BEGINNING containing about 6.22 acres of land more or less. SECTION 2 The plan dated June 1983, as submitted by applicant, shall be incorporated in this ordinance by reference and made a part hereof for all purposes as now set forth in full. Such plans shall be applicable only to the property hereby rezoned. SECTION 3 The following regulations shall apply to this tract or parcel of land. PERMITTED USES 1) Any use permitted in the "R -1" Dwelling District 2) Two single- family attached dwellings 3) Accessory buildings 4) Home occupations Lsubject to Section 7- 1300(21) of the Euless Zoning Ordinance AREA REQUIREMENTS 1) Front Yard: There shall be a front yard for every structure having a depth of not less than twenty -five feet from the property line to the face of the building. No covered porch, covered terrace, or attached accessory building shall project into any required front yard space. 2) Rear Yard: There shall be a rear yard for every structure not less than fifteen feet measured from the back of the structure to the rear property line; provided, however, that where such rear yard abuts an alley, the required rear yard may be measured from the centerline of such alley. 3) Side Yards: There shall be one side yard for each dwelling unit having a depth of not less than ten feet from the property line to the wall of the building. 4) Lot Area: The minimum area of any lot shall be 3,750 square feet. 5) Lot Width: The minimum lot width shall be thirty -two feet at the required building line. 6) Lot Coverage: The combined area of the main building and accessory buildings shall not cover more than fifty percent of the total area of any lot. ORDINANCE NO. 742, PAGE TWO OF FOUR 7) Floor Area: Every dwelling unit erected, constructed, or altered shall have a floor area, excluding basements, open or screened porches or garages, of not less than 1,100 square fet for each family. 8) Minimum Masonry: All dwellings and accessory buildings shall have eighty percent masonry veneers on all exterior wall elevations, except the rear exterior wall elevation. The required eighty percent masonry veneer requirement shall be calculated by finding eighty percent of the area that describes the exterior wall elevation, exclusive of windows and doors and inclusive of any appendages to the wall. 9) Common Wall: A11 common walls shall be constructed as a double wall unit that meets a two hour fire rating and has an approved soundboard integrated between wall studs that are staggered and offset along either side of such soundboard. Such double wall unit shall be constructed in its entirety to the roof deck and shall meet the requirements of the Euless Building Code. HEIGHT LIMIT No building shall exceed the height of thirty -five feet or two and one -half stories; however, one family dwellings may be increased in height not more than ten feet when two side yards of not less than fifteen feet each are provided. OFF- STREET PARKING There shall be provided in connection with every use permitted, an off - street parking area in accordance with the provisions of Section 8 of the Euless Zoning Ordinance. SIGNS Signs shall be permitted that are in accordance with the "R -2" Dwelling District of the City of Euless. SECTION 4 Severability Clause. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable; and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. ORDINANCE NO. 742, PAGE THREE OF FOUR SECTION 5 Penalty for Violation. Any person, firm, or corporation violating the terms and provisions of this ordinance, or the amendments to the City of Euless Charter hereby made, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed Two Hundred ($200.00) Dollars, and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Charter and the Statutes of the State of Texas. SECTION 6 Effective Date. This ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 24th day of May, 1983, by a vote of 5 ayes, 0 nays, and 0 abstentions. GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting of the Euless City Council on the 28th day of June, 1983, by a vote of ayes, C. nays, and C, abstentions.
