HomeMy WebLinkAbout750 07-26-1983ORDINANCE NO. 750 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A CHANGE OF ZONING FROM "R -3" WITH "CUD" CONFORMING HOUSING TO "PD" PLANNED DEVELOPMENT FOR STACKED AND DETACHED CONDOS (12 U /A) ON CERTAIN PROPERTY OUT OF THE S. HUITT SURVEY A -705; PROVID- ING FOR THE DEVELOPMENT OF SUCH TRACT OF LAND ACCORDING TO APPROVED PLANS; PROVIDING FOR SEVERABILITY CLAUSE; PROVID- ING FOR A PENALTY AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 IT IS HEREBY ORDERED THAT the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as hereinafter set forth. The zoning classification of the property described herein, now zoned "R -3" with "CUD" Conforming Housing, be changed to "PD" Planned Development for Stacked and Detached Condos (12 U /A), as specifically set forth in the Development Plan submitted by the applicant dated April 26, 1983, and revised April 29, 1983. Said Development Plan shall be incorporated in this ordinance by reference and made a part hereof, and shall also be on file attached to Zoning Case No. 404. The applicable uses of land shall be in compliance with those sections of the Euless Zoning Ordinance No. 347 relating to zone classifications for "R -3" Multi- family zoning district, except as stipulated herein. BEING a tract or parcel of land situated in the City of Euless, Tarrant County, Texas; and being part of the Solomon Huitt Survey, Abstract 705; and also being a part of a tract of land conveyed to Tarrant Land Company by E. L. Baker by deed filed August 14, 1951, in Volume 2342, Page 439; and also being part of a tract of land conveyed to Tarrant Lane Company by W. J. Eden, et ux, by deed dated August 6, 1951, and recorded in Volume 2342, Page 131; all in the Deed Records of Tarrant County; and being more particularly described as follows: COMMENCING at a point for corner at the intersection of the northerly line of Midway Drive (80 feet wide) and the easterly line of Main Street; ORDINANCE NO. 750, PAGE ONE OF FIVE THENCE, in an easterly direction along the northerly line of said Midway Drive and along a curve to the left whose tangent bears South 89 degrees -44 minutes -57 seconds east, having a radius of 2,920.00 feet, a central angle of 15 degrees -59 minutes -09 seconds and an arc length of 814.70 feet to the end of said curve to the left; THENCE, north 74 degrees -15 minutes -54 seconds east a distance of 22.33 feet to an iron rod for corner, said rod being the POINT OF BEGINNING; THENCE, north 00 degrees -06 minutes -59 seconds east, a distance of 570.22 feet to an iron rod for corner; THENCE, North 79 degrees -07 minutes -00 seconds east, a distance of 83.58 feet to an iron rod for an angle; THENCE, north 49 degrees -07 minutes -00 seconds east, a distance of 300.00 feet to an iron rod for an angle; THENCE, north 79 degrees -07 minutes -00 degrees east, a distance of 1,387.94 feet to an iron rod for corner in the westerly line of a tract of land conveyed to Joe P. Farina and Jack Pilon by the Amon G. Carter Foundation, Inc., by deed dated June 30, 1967, and recorded in Volume 4431, Page 612, of the Deed Records of Tarrant County; THENCE, south 00 degrees -07 minutes -57 seconds west along the westerly line of said tract, a distance of 275.01 feet to an iron rod for corner in the northerly line of said Midway Drive, said rod also being the most north- westerly corner of Midway Square Addition - Phase Two, as recorded in Volume 388132, Page 43 of the Deed Records of Tarrant County, Texas; THENCE, South 79 degrees -07 minutes -00 seconds west along the northerly line of said Midway Drive, a distance of 632.28 feet to an iron rod being the beginning of a curve to the left; THENCE, in a westerly and southwesterly direction continuing along the northerly line of said Midway Drive and along said curve to the left , having a radius of 904.24 feet, a central angle of 40 degrees -00 minutes -00 seconds, and an arc length of 631.28 feet to an iron rod being the end of said curve to the left and the beginning of a curve to the right; THENCE, in a southwesterly and westerly direction continuing along the northerly line of said Midway Drive and along said curve to the right having a radius of 981.05 feet, a central angle of 35 degrees -08 minutes -54 seconds, and an arc length of 601.83 feet to an iron rod being the end of said curve to the right; THENCE, South 74 degrees -15 minutes -54 seconds west continuing along the northerly line of said Midway drive, a distance of 26.51 feet to the POINT OF BEGINNING, and containing 15.0869 acres, more or less. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. ORDINANCE NO. 750, PAGE FOUR OF FIVE SECTION 4 Penalty for Violation. Any person, firm, or corporation violating the terms and provisions of this ordinance, or the amendments to the City of Euless Charter hereby made, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed Two Hundred ($200.00) Dollars, and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Charter and the Statutes of the State of Texas. SECTION 5 Effective Date. This ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas.
