HomeMy WebLinkAbout757 09-27-1983ORDINANCE NO. 757 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A CHANGE OF ZONING FROM "I -2" HEAVY INDUSTRIAL DISTRICT TO "I -1" LIGHT INDUS- TRIAL DISTRICT WITH SPECIFIC USE PERMIT FOR DANCE HALL, ON CERTAIN PROPERTY OUT OF THE INTERNATIONAL /REGIONAL INDUS- TRIAL COMPLEX; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 IT IS HEREBY ORDERED THAT the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read has hereinafter set forth. The zoning classification of the property described herein, now zoned "I -2" Heavy Industrial District be changed to "I -1" Light Industrial District with specific use permit for dance hall, as specifically set forth in the site plan dated July 7, 1983, on file in the City of Euless Zoning Records attached to Zoning Case No. 413. Said tract or parcel of land being a portion of Block D, Interna- tional /Regional Industrial Complex, to the City of Euless, Tarrant County, Texas, according to plat recorded on Page 41 of Volume 388 -75 in the Tarrant County Deed Records, and being more particularly described as follows: BEGINNING at an iron rod at the northwest corner of Lot 1, Block D, International /Regional Industrial Complex, to the City of Euless, Tarrant County, Texas, according to plat recorded on Page 41 of Volume 388 -107 in the Tarrant County Deed Records, and being in the east right -of -way line of Westpark Way; THENCE, north 0 degrees -16 minutes west along the east right -of -way line of said Westpark Way, a distance of 307.51 feet to an iron rod at the beginning of a curve to the right having a radius of 20.0 feet; THENCE, northeasterly along said curve and along the east right -of -way line of said Westpark Way, a distance of 31.5 feet to an iron rod in the south right -of -way line of Regal Park Way; THENCE, north 89 degrees -58 minutes -30 seconds east along the south right - of -way line of said Regal Park Way, a distance of 259.82 feet to an iron rod in the east line of an existing 25 -foot Texas Power and Light Company easement; THENCE, south 0 degrees -16 minutes east along the east line of said 25 -foot Texas Power and Light Company easement, a distance of 326.41 feet to an iron rod; THENCE, south 89 degrees -44 minutes west at a distance of 25.0 feet the northeast corner of said Lot 1, Block D, said International /Regional Industrial Complex, a total distance of 279.9 feet to place of beginning, containing 91,442 square feet with 8,162 square feet being occupied by said 25 -foot Texas Power and Light Company easement leaving a net acreage of 83,280 square feet of land more or less. SECTION 2 The plan dated March 1981 and revised as of July 7, 1983, as submitted by applicant shall be incorporated in this ordinance by reference and made a part hereof for all purposes as now set forth in full. Such plan shall be applicable only to the property hereby rezoned. SECTION 3 The applicable uses of land pursuant to Section 7 -1000, City of Euless Zoning Ordinance No. 347 are to be subject to the conditions as hereinafter set forth. Additional Conditions Applicable to this Tract (1) No alcoholic beverages will be sold for consumption on site. (2) No food will be processed and sold for profit on site. (3) No loitering. (4) Facility will be available to Square and Round Dance Clubs in Metroplex for both teaching of square and round dancing, and their regular scheduled dances. (5) Hours of operations shall be limited to between 8:00 a.m. and 12:00 midnight. (6) Facility will be made available to church groups for recreational activity and church services on Saturday or Sunday. (7) Facility will also be available to other groups for special occasions. ORDINANCE NO. 757, PAGE TWO OF FOUR SECTION 4 Severabi1ity Clause. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable; and, if any phrase, clause, sentence paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remain- ing phrases, clauses, sentences, paragraphs, or sections of this ordi- nance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION 5 Penalty for Violation. Any person, firm, or corporation violating the terms and provisions of this ordinance, or the amendments to the City of Euless Charter hereby made, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed Two Hundred ($200.00) Dollars, and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Charter and the Statutes of the State of Texas. SECTION 6 Effective Date. This ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 13th day of September, 1983, by a vote of 4 ayes, 0 nays, and 0 abstentions.
