AN ORDINANCE AMENDING ORDINANCE NO. 347, IDEN-
TIFIED AS THE ZONING ORDINANCE OF THE CITY OF
EULESS, TEXAS; AMENDING THE CITY OF EULESS ZON-
ING MAP; PROVIDING FOR A CHANGE OF ZONING FROM
"CUD" CONFORMING (R -2) DWELLING DISTRICT TO
"PD" PLANNED DEVELOPMENT FOR 0-1-OT LINE HOMES
AND SINGLE FAMILY ATTACHED HOMES, ON CERTAIN
PROPERTY OUT OF THE TALL TIMBERS ADDITION; PRO -
VIDING FOR THE DEVELOPMENT OF SAID LAND AC-
CORDING TO APPROVED PLANS; PROVIDING FOR A
SEVERABILITY CLAUSE; PROVIDING A PENALTY AND AN
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS,
TEXAS:
SECTION 1
IT IS HEREBY ORDERED THAT the Official District Zoning Map of the City of
Euless, Texas, being a part of Ordinance No. 347, be amended to read as
hereinafter set forth.
The zoning classification of the property described herein, now zoned "CUD"
Conforming (R -2) Dwelling District be changed to "PD" Planned Development
for O -Lot Line Homes and Single Family Attached Homes, as specifically set
forth in the development plan dated August 23, 1983. Such plan as submitted
by Applicant shall be on file in the City of Euless Zoning Records and file
attached to Zoning Case No. 418.
Lots 1 -32, Block 1, and Lots 1 -31, Block 3, Tall Timbers Addition to the City
of Euless, Tarrant County, Texas.
SECTION 2
The plan dated August 23, 1983, as submitted by Applicant shall be in-
corporated in this ordinance by reference and made a part hereof for all
purposes as now set forth in full. Such plan shall be applicable only to the
property hereby rezoned.
SECTION 3
The applicable uses of land pursuant to Section 7 -1100 , City of Euless
Zoning Ordinance No. 347 are to be subject to the conditions as hereinafter
set forth.
SINGLE FAMILY ATTACHED UNITS (SFA) - Lots 1R, 2R, 26R, 27R, 28R, 29R, 30R,
31R, of Block Three - 8 SEA Units.
ZERO LOT LINE UNITS (0 -LL) - Lots 1R -32R of Block One and Lots 3R -35R of Block

NOTE: No individual lot access permitted to Ash Lane or Fullcr -Wiser Road.
ADDITIONAL CONDITIONS TO DEVELOPMENT
1) The fourteen housing units on Sycamore Lane adjacent to the Meadowview
Addition will be limited from visual access from the second story in their
backyard (south elevation).
2) The units along Tall Timbers Drive will have two covered parking places
commencing twenty -five feet (25') from Tall Timbers Drive.
3) Permits for the fourteen residences adjacent to the Meadowview Addition
will be obtained prior to building any units on Tract B (multi - family tract),
and that permits for the lots adjacent to Ash Lane will be taken simul-
taneously with permits for townhouses for sale on Tract B, with six townhouse
permits allowed per one zero -lot line permit. If Tract B is to be developed
into apartments, then all permits for lots adjacent to Ash Lane must be taken
out prior to commencement of construction on Tract B.
4) Maintenance of the front yards along Ash Lane will be maintained by the
Condominium Association in a proper manner if the owners of the homes fail
to maintain same in an attractive and well - groomed manner. This is written
into the condominium documents.
SECTION 4
Severability Clause. It is hereby declared to be the intention of the City
Council of the City of Euless that the sections, paragraphs, sentences,
clauses, and phrases of this ordinance are severable and if any phrase,
clause, sentence, paragraph, or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs, or sections of this ordinance,
since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional phrase, clause,
sentence, paragraph, or section.

SECTION 5
Penalty for Violation. Any person, firm, or corporation violating the terms
and provisions of this ordinance, or the amendments to the City of Euless
Charter hereby made, shall be deemed guilty of a misdemeanor and, upon
conviction thereof, shall be liable to a fine in an amount not to exceed Two
Hundred ($200.00) Dollars, and each day such violation shall be permitted to
exist shall constitute a separate offense, as provided by Ordinance No. 347,
and subsequent amendments to the Euless City Charter and the Statutes of the
State of Texas.
SECTION 6
Effective Date. This ordinance shall be in full force and effect from and
after its passage as provided by the Euless City Charter and the laws of the
State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City
Council on the 11th day of October, 1983, by a vote of 5 ayes, 0 nays, and
0 abstentions.
