HomeMy WebLinkAbout771 01-24-1984ORDINANCE NO. 771 AN ORDINANCE AMENDING ORDINANCE NO. 715, SAME BEING THE UNIFORM BUILDING CODE, DWELLING CON- STRUCTION UNDER THE UNIFORM BUILDING CODE, UNI- FORM CODE FOR THE ABATEMENT OF DANGEROUS BUILD- ING, UNIFORM HOUSING CODE AND UNIFORM MECHANI- CAL CODE, OF THE CITY OF EULESS, TEXAS; AMENDING ORDINANCE NO. 716, SAME BEING THE UNIFORM PLUMBING CODE OF THE CITY OF EULESS, TEXAS; AMENDING ORDINANCE 696, SAME BEING THE UNIFORM ELECTRICAL CODE OF THE CITY OF EULESS, TEXAS, TO REVISE THE SCHEDULE OF FEES UNDER AND PURSUANT TO SUCH CODES; PROVIDING A SEVERABILITY CLAUSE, PROVIDING A PENALTY FOR VIOLATION THEREOF; PRO- VIDING AN EFFECTIVE DATE; AND DECLARING AN EMERGENCY. WHEREAS, the City Council of the City of Euless, Texas, is desirous of amending the schedule of fees applicable to the city's Uniform Building and related codes to more accurately reflect the cost to the city with respect to performance of the permitting and application process as well as inspection and enforcement thereunder. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS; I. Table A, City of Euless, Schedule of Fees to the Uniform Building Code of the City of Euless, Texas, and the Uniform Mechanical Code of the City of Euless, Texas, as previously established by Ordinance No. 715 is herewith amended to here- after be and read as stated in Exhibit "A" hereto, which Exhibit is incorporated herein by reference as though now set forth in full. II. Table A, City of Euless, Schedule of Fees to the Uniform Electrical Code of the City of Euless, Texas, as previously established by Ordinance No. 696 is herewith amended to here- after be and read as stated in Exhibit "A" hereto, which Exhibit is incorporated herein by reference as though now set forth in full. III. Table A, City of Euless, Schedule of Fees to the Uniform Plumbing Code of the City of Euless, Texas, as previously established by Ordinance No. 716 is herewith amended to here- after be and read as stated in Exhibit "A" hereto, which Exhibit is incorporated herein by reference as though now set forth in full. IV. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or sec- tion. V. Penalty for Violation. Any person, firm or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in an amount not to exceed $200.00. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. VI. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. VII. Emergency Clause. By the affirmative vote of four or more of its members, the City Council declares that this is an ordinance for the immediate preservation of the public peace, property, health, and safety, and is an emergency measure within the meaning of Article II, Section 11 of the City Charter; and the requirement that it be read at two meetings, as specified in Section 11, is hereby dispensed with. When the proposed work will involve building, electrical, mechanical and plumbing work, a single project permit fee shall be computed. The fee will be based on the number of square feet to be built, as in catagories I, II, III, and IV of Table A. Alterations and repairs that involve all four types of work will carry a fee based on the valuation of the work to be done in each trade, accord- ing to category V. of Table A. Separate permits may be issued. Where a Certificate of Occupancy is required for any reason except in direct connection with work done under a building permit, a fee of $25.00 is charged. For fee calculation purposes, the building area includes: (a) Total area under the roof and enclosed walls, The sum of the above area constitutes the building area for permit fee determination and is to be stated on the permit application. VALUATION ESTIMATE The valuation estimate is used to determine the permit fee for remodel- ing and alterations, including swimming pools, fences, etc. It is not used for new construction (building area is used) The dollar value of the proposed work is important to accurately report the total building activity in the City of Euless. It should be your present best estimate of the total market value (all of owner's costs including contractor's overhead and profit) of the proposed construction work (excluding land).
