B16-UC-48-0001-22-50-A TO EXCEL 4 CONSTRUCTION, LLC, FORT WORTH, TEXAS, IN THE AMOUNT OF $191,602.00 FOR THE REPLACEMENT OF SANITARY SEWER MAIN IN THE OAKWOOD TERRACE EAST AND CEDAR HILL ESTATES ADDITIONS, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Euless, Texas does hereby recommend the award of contract for CDBG Project No. B16-UC-48-0001-22-50-A to Excel 4 Construction, LLC, Fort Worth, Texas, in the amount of $191,602.00 for the replacement of the sanitary sewer main in the Oakwood Terrace East and Cedar Hill Estates Additions; and WHEREAS, CDBG Project No. B16-UC-48-0001-22-50-A consists of the replacement of approximately 1,500 linear feet of sanitary sewer main along Reaves Court using trenchless technology and open trench methods; and WHEREAS, the City Council recommends including the authorization for the City of Euless staff and Tarrant County to issue change order(s) totaling an amount not to exceed five percent of the base contract amount ($9,580.00) without requiring formal action by the City Council and Commissioner's Court; and WHEREAS, the construction funds available through Tarrant County for this project are $208,840.19; and WHEREAS, staff has reviewed the bid tabulation and based on supporting documentation from Elliott and Hughes, Inc. (Exhibit A), recommends that Tarrant County award the contract to the low bidder, Excel 4 Construction, LLC, Fort Worth, Texas. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, THAT: SECTION 1. The City of Euless, Texas City Council recommends award of a contract to Excel 4 Construction, LLC, Fort Worth, Texas for the replacement of the sanitary sewer main in the Oakwood Terrace East and Cedar Hill Estates Additions in the amount of $191,602.00 of which Tarrant County Community Development will pay the full amount. SECTION 2. EFFECTIVE DATE. This resolution shall be in full force and effect from and after its passage. Senior Civil Engineer Re: Sanitary Sewer Line Replacement Oakwood Terrace East and Cedar Hill Estates Additions CDBG Project No. B16-UC-48-0001-22-50-A Dear Mr. Harts: Our firm completed the civil engineering design, construction plans, and prepared contract documents for the above captioned improvements. An official "Advertisement for Bid Notice" was published and the plans and documents were available from Tarrant County and were on file in area plan rooms. Sealed bids for the construction were received in the offices of Tarrant County Community Development, at 10:00 o'clock A.M. on Tuesday, December 28, 2016. Two (2) sealed bids were submitted. The low bid of $191,602.00 was submitted by Excel 4 Construction, LLC. (aka "XCEL 4") of Fort Worth, Texas. The second or high bid of $244,380.00 was submitted by BSK USA, LLC of Benbrook, Texas. A third bid was presented that was absent required information in the bid documents and, in accord with the requirements of HUD and Tarrant County, the bid was ruled non-responsive and was not read into the record. A copy of the Bid Summary and the line item Bid Tabulation for the two (2) bids are enclosed for your information and file. The engineer's estimate for the construction was $201,690.00. Completion time was established in the documents at ninety (90) calendar days. We submit that a recommendation be made to Tarrant County Commissioner's Court to award the construction contract to Excel 4 in the amount of their low bid of $191,602.00. Funds are available for the construction through Tarrant County in the total amount of$208,840.19. In any resolution on construction contract award, we recommend that the City Council include authorization for the City of Euless Staff and Tarrant County to issue change order(s) totaling an amount not to exceed five (5%) percent of the base contract amount ($9,580.00) without requiring formal action by the City Council and Commissioner's Court. 1001 West Euless Blvd., Suite 212 • Euless, Texas 76040 • 817-267-1303 • Fax 817-283-5310 Resolution No. 17-1497, Page 3 of 6 Allen J. Harts, P.E. Page 2 As a matter of information, Excel 4 was incorporated in June, 2011, and established their offices in Fort Worth. Prior to the new venture, all four (4) principals were employed by Hall-Albert Construction, Inc. (H-A) a highly respected utility contractor and pioneer in the trenchless technology methods of sanitary sewer rehabilitation. When Hall-Albert dissolved their corporation in early 2001, the four (4) Excel principals made arrangements to purchase equipment from H-A, arrange to subcontract work from ARK Construction (a multi million dollar utility contractor in Kennedale), and start to establish a project history necessary to obtain bonding as an independent contractor. At the present time, all the principals have at least twenty (20) years of experience in trenchless technology and open trench construction. They have completed approximately 80 sanitary sewer projects since they started, with construction costs ranging from $1,800.00 to $980,000.00. They have completed sanitary sewer line rehabilitation projects in the City of Euless as a subcontractor under ARK, and have performed construction in most all of the cities the Metroplex. All of their projects that we are familiar with were successfully completed in a timely and acceptable manner. We spoke with representatives of Excel 4 regarding their unit prices and total bid, and they are comfortable with their bid as submitted. They indicated they have enjoyed their past relationship with the City and Tarrant County and look forward to successfully completing this project. Surety bonds (performance, payment and maintenance bonds) are underwritten by Washington International Insurance Company of New Hampshire. We spoke to the surety's local representative and they told of no problems with the contractor, and they assured us they would be issuing the necessary bonds. We trust the foregoing will be beneficial to you as you prepare your final recommendations on this project.
