AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS
THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS;
AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A
CHANGE OF ZONING FROM "PD" PLANNED DEVELOPMENT (OPEN
SPACE) TO "C -2" COMMUNITY BUSINESS DISTRICT ON CERTAIN
PROPERTY OUT OF THE LEVI FRANKLIN SURVEY, A -513;
PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING A PEN-
ALTY AND AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS,
TEXAS:
SECTION 1
IT IS HEREBY ORDERED THAT the Official District Zoning Map of the City of
Euless, Texas, being a part of Ordinance No. 347, be amended to read as
hereinafter set forth.
Such zoning request as submitted by Applicant shall be on file in the City
of Euless Zoning Records and file attached to Zoning Case No. 84 -08.
The zoning classification of the property described in Exhibit "A"
(attached hereto and made a part hereof as fully as if set forth herein), now
zoned "PD" Planned Development (Open Space) is hereby changed to "C -2"
Community Business District.
SECTION 2
Severability Clause. It is hereby declared to be the intention of the City
Council of the City of Euless that the sections, paragraphs, sentences,
clauses, and phrases of this ordinance are severable and if any phrase,
clause, sentence, paragraph, or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the remain-
ing phrases, clauses, sentences, paragraphs, or sections of this ordinance,
since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional phrase,
clause, sentence, paragraph, or section.
SECTION 3
Penalty for Violation. Any person, firm, or corporation violating the terms
and provisions of this ordinance, or the amendments to the City of Euless
Charter hereby made, shall be deemed guilty of a misdemeanor and, upon
conviction thereof, shall be liable to a fine in an amount not to exceed Two
Hundred ($200.00) Dollars, and each day such violation shall be permitted to
exist shall constitute a separate offense, as provided by Ordinance No. 347,
and subsequent amendments to the Euless City Charter and the Statutes of the
State of Texas.
SECTION 4
Effective Date. This ordinance shall be in full force and effect from and
after its passage as provided by the Euless City Charter and the laws of the
State of Texas.

BEING a tract of land situated in the Levi Franklin Survey, Abstract No. 513, City of
Euless, Tarrant County, Texas, and being more particularly described as follows:
CO'S',ENCING at the Northwest intersection of North Main Street and Bear Creek. Drive, a
point for corner;
-THENCE, S.0046'30 "W, along the West line of North Main Street, a distance of 978.48
feet to the PLACE OF BEGINNING of the herein described tract of land siad point being
the South�,est intersection of North t�,ain Street, and Proposed Cheek Sparger Road, an
iron stake for corner;
THENCE, S.0 046'30 "W, along the West line of North Main Street a distance of 1015.19 feet
to an iron stake for corner;
THENCE, Leaving said West line of North Main Street and proceeding around a curve to
the Right having a central angle of 27 °01'31" and a radius of 650.0 feet with a back
tangent bearing of N.61 °03'50"W, a distance around said curve of 306.59 feet to the
beginning of a curve to the Left having a central angle of 37 °01'11" and a radius of
1000.0 feet, an iron stake for corner;
THENCE, Around said curve to the Left, a distance of 646.12 feet to an iron stake for
corner;
THENCE, N.12 054'19 "W, a distance of 191.56 feet to a point on the South line of said
Proposed Cheek Sparger Road, same point being the beginning of a curve to the Right
having a central angle of 3 °28'33" and a radius of 657.38 feet with a back tangent
bearing of N.77 °07'09 "E, an iron stake for corner;
THENCE, Along said South line of Proposed Cheek Sparger Road and around said curve a
distance of 41.70 feet to the beginning of a reverse curve having a central angle of
8 °14'42" and a radius of 687.38 feet, an iron stake for corner;
THENCE, Along said South line of the Proposed Cheek Sparger Road and around said curve
a distance of 98.92 feet to an iron stake for corner;
THENCE, N.72 °21'E, along said South line of Proposed Cheek Sparger Road a distance of
679.71 feet to the PLACE OF BEGINNING and containing 9.665 acres of land.

PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City
Council on the 22nd day of May, 1984, by a vote of 4 ayes, 0 nays, and 0
abstentions.
GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting of the
Euless City Council on the 12th day of June, 1984, by a vote of // ayes,
O nays, and C) abstentions.
