HomeMy WebLinkAbout807 09-11-1984ORDINANCE NO. 807 AN ORDINANCE AMENDING ORDINANCE NO. 771, WHICH AMEN- DED THE SCHEDULE OF FEES FOR ORDINANCE NO. 715, SAME BEING THE UNIFORM BUILDING CODES, DWELLING CONSTRUC- TION UNDER THE UNIFORM BUILDING CODE, UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDING, UNIFORM HOUSING CODE AND UNIFORM MECHANICAL CODE, OF THE CITY OF EULESS, TEXAS: AMENDING ORDINANCE NO. 716 SAME BEING THE UNIFORM PLUMBING CODE OF THE CITY OF EULESS, TEXAS: AMENDING ORDINANCE NO. 696, SAME BEING THE UNIFORM ELECTRICAL CODE OF EULESS, TEXAS: TO REVISE THE SCHEDULE OF FEES UNDER AN PURSUANT TO SUCH CODES: PROVIDING A SEVERABILITY CLAUSE, PRO- VIDING A PENALTY FOR VIOLATION THEREOF, PROVIDING AN EFFECTIVE DATE; AND DECLARING AN EMERGENCY. WHEREAS, the City Council of the City of Euless, Texas is desirous of amending the schedule of fees applicable to the city's Uniform Building and related Codes to more accurately reflect the cost to the city with respect to performance of the permitting and application process as well as inspection and enforcement thereunder. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS; I. Table A. City of Euless, Schedule of Fees to the Uniform Building Code of the City of Euless, Texas, and the Uniform Mechanical Code of the City of Euless, Texas, as previously established by Ordinance No. 771 is herewith amended to hereafter be and read as stated in Exhibit "A" hereto, which Exhibit is incorporated herein by reference as though now set forth in full. II. Table A, City of Euless, Schedule of Fees to the Uniform Electrical Code of the City of Euless, Texas, as previously estab- lished by Ordinance No. 696 and 771 is herewith amended to hereafter be and read as stated in Exhibit "A" hereto, which Exhibit is incorporated herein by reference as though now set forth in full. III. Table A, City of Euless, schedule of fees to the Uniform Plumbing Code of the City of Euless, Texas as previously esta- blished by Ordinance No. 771 is herewith amended to hereafter be and read as stated in Exhibit "A" hereto, which Exhibit is incorporated herein by reference as though now set forth in full. IV. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sen- tences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judge- ment or decree of any court of competent jurisdiction, such unconstitutionality shall riot affect any of the remaining phra- ses, clauses, sentences, paragraphs and sections of this ordin- ance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconsti- tutional phrase, clause, sentence, paragraph or section. V. Penalty for Violation. Any person, firm or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in an amount not to exceed $200.00. Each such violation shall be deemed a separate offense and shall be punish- able as such hereunder. IN* Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. VII. Emergency Clause. By the affirmative vote of four or more of its members, the City Council declares that this is an ordinance for the immediate preservation of the public peace, property, health, and safety, and is an emergency measure within the meaning of Article II, Section 11 of the City Charter; and the requirement that it be read at two meetings, as specified in Section 11, is hereby dispensed with. PRESENTED AND PASSED on first and final reading on the 11th day of September , 1984, at a regular meeting of the City Counci of The City of Euless, Texas, by a vote of 5 ayes, 0 nayes, and 0 abstentions. Minimum valuation calculations shall be: 1. Group R Division Occupancies (residential) Single Family, Single Family Attached, Townhomes - 2,000 S.F. - $350.00 2,001 & over - $400.00 2. Group R Division 1 Occupancy (multi - family) - $30.00 per square foot. 3. All other groups and occupancy including sewer lines, air conditioning repair, hot water heaters, swimming pools, fence, lawn sprinklers, signs and fire protection sprinkler shall be based on the estimated cost of construction. If in the opinion of the Building Official, the valuation of building, alteration or structure appears to be under estimated, permit shall be denied unless the applicant can show detailed estimated cost to meet the approval of the Building Official. B. Building Permit Fee Schedule - -- TOTAL VALUATION FEE $1.00 to $500.00 $501.00 to $2,000.00 $2,001 to $25,000.00 $25,001.00 to $50,000.00 $50,001.00 to $100,000.00 $100,000.00 and up $10.00 $10.00 for the first $500.00 plus $1.50 for each additional $100.00 or fraction thereof, to and including $2,000.00 $32.50 for the first $2,000.00 plus $6.00 for each additional $1,000.00 or fraction thereof, to and including $25,000.00 $170.50 for the first $25,000.00 plus $4.50 for each additional $1,000 or fraction thereof, to and including $50,000.00 $283.00 for the first $50,000.00 plus $3.00 for each additional $1,000.00 or fraction thereof, to and including $100,000.00 $433.00 for the first $100,000.00 plus $2.50 for each additional $1,000.00 or fraction thereof.
