AN ORDINANCE DETERMINING THE NECESSITY
OF EXTENDING AND IMPROVING LITTLE BEAR
CREEK BRIDGE AND IMPROVING THAT PORTION
OF NORTH MAIN STREET IN THE CITY EULESS,
TEXAS, WHICH EXTENDS NORTHWARD FROM
LITTLE BEAR CREEK BRIDGE TO GLADE ROAD
BY WIDENING THE ROADWAY, CONSTRUCTING,
PAVING, CURB AND GUTTER, SIDEWALKS AND
STORM DRAINAGE IMPROVEMENTS; APPROVING
THE CITY ENGINEER'S PLANS AND SPECIFICA-
TIONS FOR IMPROVEMENT OF LITTLE BEAR
CREEK BRIDGE EXTENSION AND NORTH MAIN
STREET; APPROVING THE ENGINEER'S ESTI-
MATE OF COST AND THE ASSESSMENT ROLL;
DIRECTING THE CITY MANAGER TO SOLICIT
BIDS FOR THE IMPROVEMENTS TO NORTH MAIN
STREET AND LITTLE BEAR CREEK BRIDGE;
DECLARING THE INTENT OF THE CITY COUNCIL
TO LEVY AN ASSESSMENT FOR A PORTION OF
THE COSTS OF IMPROVING NORTH MAIN STREET
AND EXTENDING AND IMPROVING LITTLE
BEAR CREEK BRIDGE; PROVIDING A SEVER -
ABILITY CLAUSE; AND PROVIDING AN EF-
FECTIVE DATE.
WHEREAS, the City Council of the City of Euless, Texas, has
determined the necessity for improving North Main Street by
constructing an improved and widened roadway with paving, curb
and gutter, sidewalks and storm drainage improvements; and
WHEREAS, the City Council of the City of Euless, Texas, has
determined the necessity of constructing an extension to Little
Bear Creek Bridge; and
WHEREAS, the City Council of the City of Euless, Texas,
being presented with the engineer's plans and specifications
for the improvements of North Main Street and the extension of
Little Bear Breek Bridge; and
WHEREAS, the City Council of the City of Euless, Texas,
being presented with an estimate of costs of improvements to
Little Bear Creek Bridge and North Main Street in the amount of
$1,589,014.00 and assessment roll of abutting property owners
to North Main Street and Little Bear Creek Bridge prepared by
the City Engineer; and
WHEREAS, the City Council of the City of Euless, Texas,
recognizes the necessity of the City Manager advertising the
improvements to North Main Street and Little Bear Creek Bridge
extension to facilitate attracting bids for those improve-
ments; and
WHEREAS, the City Council of the City of Euless, Texas,
intends to levy an assessment for a portion of the costs of the
improvements to North Main Street and Little Bear Creek Bridge
extension:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF EULESS, TEXAS, THAT:
I.
The City Council of the City of Euless, Texas, adopt the
plans and specifications prepared by the City Engineer de-
tailing the improvements for that portion of North Main Street
extending northward from Little Bear Creek Bridge to Glade
Road.
II.
The City Council of the City of Euless, Texas, adopt the
plans and specifications prepared by the City Engineer de-
tailing the extension and improvements of Little Bear Creek
Bridge.
III.
The City Council of the City of Euless, Texas, approve the
City Engineer's estimate of the costs for the improvements of
North Main Street extending northward from Little Bear Creek
Bridge to Glade Road, and the extension and improvement of
Little Bear Creek Bridge, in the amount of $1,589,014.00.
IV.
The City Council of the City of Euless, Texas, directs the
City Manager to solicit bids for the improvements to North Main
Street and the Little Bear creek Bridge extension.
V.
The City Council of the City of Euless, Texas, declares
that it is the intention of the City Council to levy a portion
of the costs of the improvements to North Main Street and Little
Bear Creek Bridge extension upon the abutting property owners
of North Main Street and Little Bear Creek Bridge.
VI.
Severability Clause. That it is hereby declared to be the
intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable,
and if any phrase, clause, sentence, paragraph or section of

this ordinance shall be declared unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such
unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs and sections of this
ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or sec-
tion.
VII.
Effective Date. This ordinance shall be in full force and
effect from and after its passage and publication as provided
by the Euless City Charter and the laws of the State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of
the Euless City Council on the 8th day of January , 1985;
by a vote of 3 ayes, ___L nays and _I abstentions;
GIVEN SECOND READING AND APPROVED at a regular meeting of the
Euless City Council on the 22nd day of January , 1985; by
