AN ORDINANCE AMENDING SECTION 11 -14 OF
ARTICLE I, "IN GENERAL ", OF CHAPTER 11,
"OFFENSES AND MISCELLANEOUS PROVISIONS"
OF THE CODE OF ORDINANCES, CITY OF EU-
LESS, TEXAS, TO PROVIDE FOR THE DIS-
CHARGE OF FIREARMS WITHIN THE CITY BY
MEMBERS OF THE PUBLIC IN THE TIME, PLACE
AND MANNER AUTHORIZED UNDER ANY SPECIFIC
USE PERMIT; AND AMENDING ORDINANCE NO.
347, SAME BEING THE COMPREHENSIVE ZONING
CODE OF THE CITY OF EULESS, TEXAS, TO ADD
TO USES PERMITTED IN SPECIFIC USE PER-
MITS "COMMERCIAL FIRING RANGES" IN CER-
TAIN SPECIFIED DISTRICTS; PROVIDING AN
EFFECTIVE DATE; AND PROVIDING A SEVER -
ABILITY CLAUSE.
WHEREAS, the City Council of the City of Euless, Texas,
desires to permit the operation of commercial firing ranges in
certain districts of the city; and
WHEREAS, the City Council of the City of Euless also
desires to restrict the location of said commercial firing
ranges to certain specifi.c districts within the city, and to
regulate the oper.ati.on thereof.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF EULESS, TEXAS:
I.
Section 11 -14, entitled "Same - Discharging" of Article I,
"IN GENERAL" of Chapter 11, "OFFENSES AND MISCELLANEOUS PRO-
VISIONS" of the Code of Ordinances, City of Euless, Texas, is
hereby amended to be and read as follows:
Sec. 11 -14. Same - Discharging.
The firing, shooting, setting off or
discharging of any firearm, air gun,
pellet gun, spring gun, zip gun and
other such weapon is prohibited within
the city except:
(1) by action of official and /or
duly authorized police and
peace officers engaged in the
performance of duty and /or
training; or
(2) by other persons in the time,
place and manner expressly
authorized by the City Coun-
cil under, the terms of any
Specific Use Permit issued
pursuant to the terms of the
Comprehensive Zoning Code of
the City.
II.
Section 7 -1002, entitled "Specific Use Schedule" of Ordi-
nance No. 347, same being the Comprehensive Zoning Code of the
City of Euless, Texas, is hereby amended by the addition of a
new subsection (56) thereto, which subsection is herewith added
to be and read as follows:
(56) Commercial Firing Ranges I -1, I -2
III.
Effective Date. This ordinance shall be in full force and
effect from and after its passage and publication as provided
by the Euless City Charter and the laws of the State of Texas.
IV.
Severability Clause. That it is hereby declared to be the
intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable,
and if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such
unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs and sections of this
ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or sec-
tion.
PRESENTED AND GIVEN FIRST READING at a regular meeting of
the Euless City Council on the 26th day of March , 1985;
by a vote of 5 ayes, 0 nays and 0 abstentions;
GIVEN SECOND READING AND APPROVED at a regular meeting of the
Euless City Council on the 9th day of A riles, 1985; by
a vote of 4 ayes, 0 nays and a0 bstentions.
