HomeMy WebLinkAbout839 05-14-1985ORDIJTA17CE NO. 839 AN ORDINANCE ArVIENDING ORDINANCE NUi:4BERS 147 & 148, SAME BEING THE EULESS SUBDIVISION RULES AND REGULATIONS; ESTABLISHING NEW AND DIFFERENT SIDEWALK REQUIREMENTS WITHIN THE CITY; PROVIDING A SEVEFABILITY CLAUSE; P11.0- VIDING A PENALTY; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council and the City of Euless Planning and Zoning Commission have studied in detail the needs and requirements for sidewalks within the City; WHEREAS, it has been determined that in order to provide for the adequate separation of pedestrian and vehicular traffic, adjustments to the current sidewalk requirements are needed; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS: I. Article I, Section 11, entitled "Same — Sidewalks" of the Euless Subdivision Rules and Regulations, heretofore, adopted as Ordinance Numbers 147 & 148, is hereby amended to read as follows; Section 11 "Same — Sidewalks" Sidewalks are required along all public streets and shall conform to the following minimum width specifications: (1) Single family residential - minimum of three feet (3' -0) in width; (2) Multi- family, Commercial and Industrial - minimum of four feet (4' -0) in width. Sidewalks shall be located wholly within the dedicated street right -of -way in a 'manner commensurate with the sidewalks on adjacent properties. Where no set pattern currently exists on adjacent properties or where no sidewalks have previously been installed, sidewalks shall be located parallel to and not more than one foot outside the property line. Landing walks of a width not less than eighteen (18 ") inches may be installed abutting the rear of the curb. Construction plans for such walks shall be submitted along with the building permit application and are subject to the approval of the City Building Inspection Department. Construction of all public sidewalks shall comply with Article II, Section 3 (10) of this ordinance and shall be accepted by the City prior to the Occupancy of the structure. II. Article II, Section 3 (10) entitled "Sidewalks" of the Euless Rules and Regulations heretofore, adopted as Ordinance Numbers 147 & 148, is hereby amended to read as follows; (10) Sidewalks: Sidewalks shall be installed along each street front in accordance with Article I, Section 11 of this Ordinance. All public sidewalks shall be contained within the parkway which shall be excavated or filled to a grade parallel with and not more than one quarter inch (1/4 ") slope per foot from the back -of -curb to the property line. Sidewalks shall be constructed to a minimum concrete thickness of four inches (411) and shall be reinforced with not less than V" X 0" No. 10 wire mesh. Construction joints of approved materials shall be required every twenty -five feet (259 and dummy saw joints every five feet (5'). Handicap sidewalk ramps are required at each street intersection and shall be constructed at time of street construction. III. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not effect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. ORDINANCE NO. 839, PAGE TWO OF FOUR lv Penalty for Violation. Any person, firm, or corporation violating the terms and provisions of this ordinance, or the amendments to the City of Euless Charter hereby made, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed One Thousand ($1,000.00) Dollars and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance Nos. 147 & 148, and subsequent amendments to the Euless City Charter and the statutes of the :hate, of Texas. iv Effective Date. This ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas.
