APPROVAL OF MINUTES Mr. Williamson made a motion to approve the minutes of the regular meeting dated May 5, 1981, as written. Mr. Tyson seconded the motion, and the vote was as follows: Ayes: Messrs. Williamson, Tyson, Gibson, McMillon and Deithloff Nays: None Chairman Deithloff declared the motion carried. 4I:) ACKNOWLEDGMENT Chairman Deithloff acknowledged the two new members to the Planning & Zoning Commission; Norma Morelock and Sam Huston. CONSIDER PLATTING - FINAL PLATTING OF LOT 2, BLOCK C, INTERNATIONAL/ REGIONAL INDUSTRIAL COMPLEX, LOCATED AT THE NORTHEAST CORNER OF REGAL PARKWAY AND WESTPARK WAY Mr. Walter Elliott, 1004 W. Euless Blvd. , representing Michie Thaten, presented the request for final platting. He stated he is in receipt of the City Engineer's letter dated May 29, 1981. Chairman Deithloff requested that the letter be made a part of the minutes. Mr. Tyson made a motion to recommend approval of the final platting of Lot 2, Block C, International/Regional Industrial Complex subject to the City Engineer's letter dated May 29, 1981. Mr. Williamson seconded the motion, and the vote was as follows: Ayes: Messrs. Tyson, Williamson, Gibson, McMillon, Huston and Deithloff, and Mrs. Morelock Nays: None Chairman Deithloff declared the motion carried. II. PUBLIC HEARING - ZONING CASE #337 - REQUEST OF NEAL ADAMS FOR CHANGE OF ZONING FROM R2 TO PD (SINGLE FAMILY ATTACHED) ON LOTS 1R THROUGH 6 AND LOTS 8R THROUGH 18, BLOCK 1, WILSHIRE VILLAGE SQUARE ADDITION Chairman Deithloff opened the public hearing and explained that the proponents would be heard first and then opponents. Mr. Ron Addison with the law firm, Neal W. Adams & Associates, presented the request for change of zoning from R2 duplexes to PD (single family attached) . He stated that the homes have been constructed on the 17 lots and are occupied at this time. The purpose of the zoning change is to allow each unit to be individually owned. He stated that his law firm represents every property owner of the affected lots. He also had letters from the three remaining property owners in the subdivision who are not included in this plat. In response to item #3 of the staff letter dated May 29th, he stated that those matters concerning lots 10A, 10B, 11A and 11B have been addressed in the deed restrictions to provide for the access to those driveways and common walkways between those lots. He stated that he understood from Neal Adams that the City Attorney is in agreement that Page Three, Regular Meeting, Planning & Zoning Commission, June 2, 1981 ' C the private rights for ingress and egress would be sufficient to provide ingress and egress through appropriate litigation, and that the City would not have any obligation to maintain them because they are not public streets. He stated he understood that the Commission is waiting on a letter from the City Attorney concerning the legal technicalities of this case, as pointed out in the staff letter. He stated that if the Commission would feel more comfortable with an opinion from the City Attorney, he would agree to the case being tabled. He further stated that he, being an attorney, saw no legal problems with the proposal, but could understand if the Commission wanted an unbiased legal opinion from the City Attorney. There being no additional proponents or opponents, Chairman Deithloff declared the public hearing closed. Mr. Tyson questioned why the Commission is not aware of the agreements between Neal Adams and the City Attorney. Mr. Flynn stated that the City Attorney has not responded to the DRC's request for written legal opinion to the Commission, but that he may have talked with Neal. For clarification, Mr. Addison stated that there was conversation between Neal Adams and the City Attorney regarding the letter from Mr. Flynn on May 26th; however, he did not know if there was any conversation between them after that date. In light of the fact that the Commission has not received a response from the City Attorney concerning the legal technicalities of this case, Mr. Tyson made a motion to continue the public hearing of Zoning Case #337 at the meeting on June 16th subject to the receipt of the letter from the City Attorney. Mr. Gibson seconded the motion, and the vote was as follows: Ayes: Messrs. Tyson, Gibson, Williamson, McMillon, Huston and Deithloff, and Mrs. Morelock Nays: None Chairman Deithloff declared the motion carried. III. CONSIDER PLATTING - REPLATTING OF LOTS 1R THROUGH 6 AND LOTS 8R THROUGH 18, BLOCK 1, WILSHIRE VILLAGE SQUARE ADDITION Chairman Deithloff stated that since this replat is contingent upon the previous zoning case, the replat needs to be tabled also. Page Four, Regular Meeting, Planning & Zoning Commission, June 2, 1981 Mr. McMillon made a motion to table the replatting of Lots 1R through 6 and Lots 8R through 18, Block 1, Wilshire Village Square Addition until Zoning Case #337 has been acted upon. Mr. Williamson seconded the motion, and the vote was as follows: Ayes: Messrs. McMillon, Williamson, Huston, Gibson, Tyson and Deithloff, and Mrs. Morelock Nays: None Chairman Deithloff declared the motion carried. IV. PUBLIC HEARING - ZONING CASE #338 - REQUEST OF DAVID WHEELER FOR CHANGE OF ZONING FROM C2 TO C2/SP FOR COM- MERCIAL AMUSEMENTS ON PART OF TRACT 5, PUENTE DEL OESTE (703 S. INDUSTRIAL BLVD.), LOCATED AT THE SOUTHEAST CORNER OF W. EULESS BLVD. & S. INDUSTRIAL BLVD. Chairman Deithloff opened the public hearing and stated that the proponents would be heard first and then opponents. Mr. Tom Bouldin, District Manager of Pizza Time, stated that in a discussion with Mr. Flynn the day before, it was discovered that there was a lack of information on the site plan and the petition for change of zoning. He asked that the public hearing be continued at the July 7th meeting. Mr. Tyson asked if there are any Pizza Time Theatre restaurants in operation in the area at this time. Mr. Bouldin stated that there is one in operation in Arlington. There being no additional proponents or opponents, Chairman Deithloff stated the Commission could continue or close the public hearing at this time. Mr. Williamson made a motion to continue the public hearing on Zoning Case #338 at the July 7th meeting. Mr. McMillon seconded the motion, and the vote was as follows: Ayes: Messrs. Page Five, Regular Meeting, Planning & Zoning Commission, June 2, 1981 V. PUBLIC HEARING - ZONING CASE #339 - REQUEST OF DAN MCLELAND FOR CHANGE OF ZONING FROM PD TO C2 ON PORTION OF TRACT 4D3, A. J. HUITT SURVEY, A-684, LOCATED SOUTH OF AIRPORT FREEWAY, EAST OF LAQUINTA MOTEL & WEST OF PARK CRESTMOOR ADDITION Chairman Deithloff opened the public hearing and explained that the proponents would be heard first and then opponents. Mr. Tom Hodge, partner of Dan McLeland, stated they are representing Furrs Cafeteria. He stated they currently have the subject tract under contract. The northern portion of the property is currently zoned C2 while the southern portion is zoned PD for mini warehouses. C2 zoning is needed on the southern portion to allow the construction of the Furrs Cafeteria. Mr. Williamson asked if this cafeteria is going to be a full size one or one of the mini cafeterias. Mr. Hodge stated that it will be a full size Furrs cafeteria, approximately 10-12,000 square feet, like the one in North Richland Hills. Mr. Tyson asked when construction is expected to begin. Mr. Hodge stated that construction will begin as soon as the zoning change and platting are approved. There being no additional proponents or opponents, Chairman Deithloff declared the public hearing closed. Mrs. Morelock made a motion to recommend approval of Zoning Case #339. Mr. Williamson seconded the motion, and the vote was as follows: Ayes: Mrs. Morelock and Messrs. ZONING CASE #340 - REQUEST OF JIMMY WOLFF FOR CHANGE OF ZONING FROM C2 TO R4/CUD FOR CONFORMING HOUSING ON PORTION OF TRACT A, LAKEWOOD ADDITION, LOCATED NORTH OF ASH LANE AND EAST OF F.M. 157 Chairman Deithloff opened the public hearing and explained that the proponents would be heard first and then opponents. Mr. Bill Pasteur, 1004 W. Euless Blvd. , presented the request for rezoning. He stated that Mr. Jimmy Wolff and Mr. Gary Sibley plan to develop the adjacent multi-family zoned property to the east, and they want to extend the project west to F.M. 157. He stated that these men are currently involved in the multi-family development south of Ash Lane. Chairman Deithloff asked that the staff letter dated May 30th be made a part of the minutes. He asked Mr. Pasteur about the property on the corner of Ash Lane and F.M. 157. Mr. Pasteur stated that the one acre corner tract will remain C2 and will be used for some type of commercial development. There being no additional proponents or opponents, Chairman Deithloff declared the public hearing closed. Chairman Deithloff asked what is intended for the open space drawn on the site plan. Mr. Jimmy Wolff, 1512 Riverview, Arlington, stated that the designated open space has over 15% grade to it with a creek running through the thickly wooded property. They intend to leave it as natural as possible with walking trails, etc. Chairman Deithloff inquired if there will be screening along F.M. 157 to protect children from getting onto the highway. Mr. Wolff stated they intend to provide only the screening as required in the zoning ordinance until further study is done. He stated that if they find a need for more they will provide additional screening as needed. Mr. McMillon made a motion to recommend approval of Zoning Case #340 subject to the staff letter dated May 30th. Mrs. Morelock seconded the motion, and the vote was as follows: Ayes: Mrs. Morelock and Messrs. PUBLIC HEARING - ZONING CASE #341 - REQUEST OF JIMMY WOLFF FOR CHANGE OF ZONING FROM C2 TO R4 ON PORTION OF TRACT B-R, LAKEWOOD ADDITION, AND R4 TO C2 ON PORTION OF BLOCK 1, LAKEWOOD ADDITION, SECOND INSTALL- MENT, LOCATED SOUTH OF ASH LANE & EAST OF F.M. 157 Chairman Deithloff opened the public hearing and explained that the proponents would be heard first and then opponents. Mr. Bill Pasteur, 1004 W. Euless Blvd. , presented the request for rezoning. He stated that the west zoning line for this multi-family property runs north and south. However, the zoning line is bisected in two places with the construction of Lakeshore Drive in conjunction with the multi-family development presently taking place. This leaves a very small tract zoned R4 on the west side of the street which they are requesting be rezoned to C2 to correspond with the rest of the adjacent property. Also left is a small tract zoned C2 east of the street next to the multi-family property which they are requesting be rezoned to R4. He stated that this is basically a "clean-up". There being no additional proponents or opponents, Chairman Deithloff declared the public hearing closed. Mr. Williamson made a motion to recommend approval of Zoning Case #341 as presented. Mr. Gibson seconded the motion, and the vote is as follows: Ayes: Messrs. Williamson, Gibson, Tyson, McMillon, Huston and Deithloff, and Mrs. Morelock Nays: None Chairman Deithloff declared the motion carried. (Chairman Deithloff called for a 10 minute recess at 8:25 p.m.) VIII. PUBLIC HEARING - ZONING CASE #342 - REQUEST OF JIM CULBERTSON FOR CHANGE OF ZONING FROM RI TO R3, R4 & R5 ON TRACTS 1, 1C, 1D & 6, S. HUITT SURVEY, A-705, LOCATED SOUTH OF HARWOOD ROAD AND EAST OF NORTH MAIN STREET Page Eight, Regular Meeting, Planning & Zoning Commission, June 2, 1981 C Chairman Deithloff opened the public hearing and explained that the proponents would be heard first and then opponents. Mr. Bob Eden, 414 W. Euless Blvd. , stated that his sister and himself are owners of the subject property which is under contract to Mr. Jim Culbertson. He stated they are requesting R3 along East Harwood and increasing the density to R5 adjacent to the property zoned CUD to the south. Mr. Williamson asked what their time frame is for construction. Mr. Eden stated it would be six to eight months. Chairman Deithloff asked Mr. Eden if he had considered a lesser density. Mr. Eden stated he had considered it and is not closed to suggestions from the Commission. There being no additional proponents, Chairman Deithloff asked if there were any opponents. Mr. Ed Cole, 1209 Hillcrest, stated he is opposed to any more apartment type units going up in the area. He felt that there was already a high density in the area. He stated that the schools were busting at the seams and asked if there were any plans for a new school. Mr. Flynn stated he has not received any input from the school district, but knows of no immediate plans to build a new school. Mr. Cole stressed that the Commission should consider the effects that these densities will have on the schools, roads and other resources before they approve the zoning changes. He felt that City officials should look at controlled growth. Jumping at approving changes in the zoning is certainly not controlling growth. There being no additional opponents, Chairman Deithloff declared the public hearing closed. Mr. Tyson asked what the total density will be for this tract. Mr. Williamson figured the density to be a little over 17z units an acre based on 27 acres. Mr. Tyson stated that the density in the northern part of town concerns him very much. However, when looking at the surrounding zoning, it does seem compatible. Mr. Williamson stated he is concerned about the feelings of the homeowners in Meadowview Addition, but again, the subject tract seems compatible with the surrounding property. Mr. McMillon stated that the northern area of town seems to be getting Ccrowded. Page Nine, Regular Meeting, Planning & Zoning Commission, June 2, 1981 Mr. Williamson asked about the time frame for the completion of Highway 360. Mr. Flynn stated that it is not on their 20 year plan at the State Highway Department. It was pointed out that North Main Street and Fuller-Wiser Road are the only north/south streets, and that the traffic from Fuller-Wiser onto Airport Freeway is funneled through the North Main Street intersection. Mr. Gibson stated the Commission needs to be careful not to approve too high of a density for the area. He stated that just because it is compatible to everything around it, if the Commission keeps going that route, the density will be too high for that area. He stated the Commission is going to have to stop someplace. He suggested reducing the request to R3 on all the subject tract or reducing the R5 to R4 and some of the R4 to R3. Mr. Eden stated that because of the concern, he could live with R4 on the portion where he is requesting R5. Mr. McMillon stated that reducing the R5 to R4 would decrease the number of proposed units from 314 to approximately 234 units. After discussion with Mr. Culbertson, Mr. Eden stated he would agree to reduce the R5 portion to R4. He also stated that the property is planned for townhomes, not apartments. Mr. Tyson asked what the density is for the Harwood Park Townhomes.- Mr. Culbertson stated it is 112 units per acre. Mr. McMillon made a motion to recommend approval of the amended request for R3 on the northern 9 acres and R4 on the southern 18 acres for Zoning Case #342. Mrs. Morelock seconded the motion, and the vote was as follows: Ayes: Mrs. Morelock and Messrs. McMillon, Houston and Tyson Nays: Messrs. Gibson, Williamson and Deithloff Chairman Deithloff declared the motion carried. IX. PUBLIC HEARING - ZONING CASE #343 - REQUEST OF JIM CULBERTSON FOR CHANGE OF ZONING FROM R1 TO R3 & R4 ON TRACTS 2 & 3, AND NORTHERN PART OF TRACT 4, RAY SHELTON SUBDIVISION, LOCATED NORTH OF HARWOOD ROAD AND EAST OF NORTH MAIN STREET C Chairman Deithloff opened the public hearing and explained that the proponents would be heard first and then opponents. • Page Ten, Regular Meeting, Planning & Zoning Commission, June 2, 1981 C Mr. Harry Hoover, architect for Mr. Culbertson, stated they are requesting R4 on the property behind Harwood Park Townhomes and Mr. Blease Tibbets' home and on the ten acres to the west. They are requesting R3 on the property where Mr. Tibbets' home is. He stated the home will be remodeled into a large recreational club room. He stated they are proposing cluster type townhomes for the subject property. He stated they intend to put 88 townhomes on the five acres behind Harwood Park Townhomes. The density on the rest of the property will be approximately ten units per acre. Mr. McMillon asked if the proposed housing will be similar to what is in Harwood Park Townhomes. Mr. Hoover stated yes. Mr. Williamson asked if the property involved in the previous zoning request will be developed with the same type housing. Mr. Hoover stated yes. Mr. McMillon asked what the approximate cost will be for each unit. Mr. Hoover stated the average cost is $80,000-$100,000. There being no additional proponents, Chairman Deithloff asked for any opponents. Mr. Ed Cole, 1209 Hillcrest, stated he is opposed for the same reasons he was opposed to the previous zoning case. He stated that if the Commission keeps approving multi-family zoning because it is compatible, the whole area will end up multi-family. Mrs. Jan Johnston, 1211 Hillcrest, stated she is opposed and asked the Commission to consider that the streets and schools cannot stand the additional density. There being no additional opponents, Chairman Deithloff declared the public hearing closed. Mr. McMillon asked Mr. Hoover why they are requesting R4 (16 units/acre) if they intend to build the same type complex as in Harwood Park Townhomes (zoned R3, 12 units/acre), which he stated is a density of 112 units per acre. Mr. Hoover did not answer the question, instead, he referred to the tract east of the existing townhomes which is zoned R5. He stated that the front part of the tract would have approximately 52 units similar to Harwood Park Townhomes while the northern half would contain approximately 88 units. Even though this property is zoned R5, they do not have plans to build at the R5 density. Mr. Tyson asked if the units planned are going to be smaller than what is in Harwood Park Townhomes. Page Eleven, Regular Meeting, Planning & Zoning Commission, June 2, 1981 Mr. Hoover stated that the Harwood Townhomes average 1,700 square feet. In the proposed development, the units will range in size from 1,152 to 1,363 square feet. Mr. Tyson stated it is hard to maneuver a car around the existing townhomes and asked if there is going to be more room in the proposed project. Mr. Hoover stated they plan to make the proposed project more open with additional green space. He showed the Commission members a proposed plan for the R5 area east of the tracts under consideration which, he stated, is similar to the proposal for the R4 tracts. After discussion generated by the presented plan, Mr. Flynn stated that if these units are for individual sale, they will have to be built according to the standards for single family attached. He stated that this plan does not conform to those standards which require certain lot widths and depths. If the developer wants to build this project without having lots that conform to the single family attached standards, he will have to go PD or CUD. He further stated that this plan would have to be reviewed to see that it conforms to the subdivision ordinance, and since it has not been reviewed, it could change. Mr. McMillon asked Mr. Hoover if they would agree to reduce the R4 to R3. Mr. Hoover stated that Mr. Culbertson would agree to reduce the southern half only on the R4 to R3. Mr. Tyson asked if the presented plan would be approved and restricted to a townhome development. Mr. Flynn stated that it could only be restricted to townhomes if the developer came back for a CUD or PD. He pointed out that anything under R4 could be built and that no conditions can be placed on straight zoning. He stated that is what a CUD or PD is for. Chairman Deithloff stated the developer could withdraw his present request and return at a later date for a CUD. Mr. Tyson stated that he likes the townhomes better than apartments. He stated that he is, however, concerned about the marketability of townhomes. Mr. Hoover stated he is prepared to file a site plan for approval as soon as it is completed. Mr. Flynn then asked Mr. Hoover if they would be willing to request the Commission to table their consideration until such time a site plan is submitted for CUD amendment of this request. Mr. Hoover then requested that the Commission table their consideration of this zoning request until June 16th, when they will return with a site plan for the amended request of CUD. Page Twelve, Regular Meeting, Planning & Zoning Commission, June 2, 1981 Mr. Tyson made a motion to table Zoning Case #343 until June 16th to allow the petitioner to return with a site plan for the amended request of CUD. Mr. Williamson seconded the motion, and the vote was as follows: Ayes: Messrs. Tyson, Williamson, Huston, McMillon and Gibson, and Mrs. Morelock Nays: Chairman Deithloff Chairman Deithloff declared the motion carried. tj X. CONSIDERATION —FURTHER CONSIDERATION OF RECOMMENDED CHANGES TO THE RESIDENTIAL PROVISIONS OF THE EULESS ZONING ORDINANCE Given the length of the agenda, Mr. Flynn stated that Staff did not have time to prepare the information for this phase of the ordinance revision. He stated he intends to hold a work session with the Commission to discuss the revisions before recommendations are made and hopes to make the recom- mendations soon. Briefly, he stated that the next step of the revisions will be to address the issue of affordable housing and establish a new residential zoning district R-1A for single family alternatives to accommo- date these more affordable housing styles. Also, the PD & CUD ordinances will be addressed to make them more flexible. XI. CONSIDER DATE TO ELECT OFFICERS Mr. Gibson made a motion to elect officers on July 7th. Mr. Huston seconded the motion, and the vote was as follows: Ayes: Messrs. Gibson, Huston, Tyson, Williamson, McMillon and Deithloff, and Mrs. Morelock Nays: None Chairman Deithloff declared the motion carried. XII.
