HomeMy WebLinkAbout870 01-14-1986ORDINANCE NO. 870 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON CERTAIN PROPERTY OUT OF THE JOHN GROVES SURVEY, A -599; PROVIDING FOR A CHANGE OF ZONING FROM COMMUNITY BUSINESS DISTRICT (C -2) TO PLANNED DEVELOPMENT (PD) FOR MULTI- FAMILY DWELLINGS; PROVIDING FOR A SEVERABILITY CLAUSE, PENALTY FOR VIOLATION AND AN EFFECTIVE DATE. WHEREAS, the Planning & Zoning Commission has conducted a public hearing on October 15, 1985, in conjunction with Zoning Case No. 85 -34, and rendered a recommendation to the City Council with respect to same; WHEREAS, the City Council has conducted a public hearing on December 10, 1985, considered the recommendation of the Planning & Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 THAT the official zoning district map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read so that the zoning district classification of that 2.0 acres of land generally located south of West Pipeline Road, north of Raider Court, and between Raider Drive and David Drive, more particularly described in Exhibit "A" (attached hereto and made a part hereof), now zoned Community Business District (C -2), is hereby changed to Planned Development (PD) for multi- family dwellings, as specifically set forth in the development plan described herein as Exhibit "B" (attached hereto and made a part hereof). Said property described in Exhibit "A ", pursuant to Section 7 -1100 of the Euless Zoning Ordinance, shall be subject to all height, area, setback, bulk, permitted uses and other requirements and stipulations specified on said development plan, and shall be applicable only to the property described herein. SECTION 2 Severability Clause. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 3 Penalty for Violation. Any person, firm, or corporation violating the terms and provisions of this ordinance, or the amendments to the City of Euless Charter hereby made, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed One- Thousand Dollars ($1,000), and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Charter and the Statutes of the State of Texas. SECTION 4 Effective Date. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. Tarrant County, Texas and being the same tract as conveyed to Aubrey Leon Sheppard, et ux Mary Ann Sheppard by deed recorded on Page 274 of Volume 3247 and being a portion of a tract as recorded on Page 51 of Volume 2762 in the Tarrant County Deed Records and being more Particularly described as follows: BEGINNING at an old iron rod at the Southeast corner of Tract 2, FAIRMONT ADDITION, to the City of Euless. Tarrant County, Texas according to plat recorded on Page 74 of Volume 388 -50 in the Tarrant County Plat Records and being in the Nest line of David Drive and also being by deed Nest a distance of 810 varas and South a distance of 367.97 feet from the Northeast corner of said John Groves Survey; THENCE N 89' 57' 15' N along the South line of said Tract 2 a distance of 381.0 feet to an iron rod at the Southwest corner of said Tract 2 and being in the East line of Raider Drive; THENCE S 0' 01' 50' E along the East line of said Raider Drive a distance of 229.55 feet; THENCE East, at a distance of 5.0 feet an old Iron rod at the Northwest corner of Lot A, DAY CARE CENTER, to the City of Euless, Tarrant County, Texas according to plat recorded on Page 85 of Volume 388 -52 in the Tarrant County Plat Records, a total distance of 381.0 feet to an old iron rod at the Northeast corner of Lot A -2, DAY CARE CENTER, to the City of Euless, Tarrant County, Texas according to plat recorded on Page 997 of Volume 388 -58 in the Tarrant County Plat Records and being in the West line of said David Drive; THENCE N 0' 01' 50' W along the West line of said David Drive a distance of 229.24 feet to place of beginning, containing 2.006 acres or 87,400 square feet of land.
