AN ORDINANCE AMENDING ORDINANCE NO. 347,
IDENTIFIED AS THE ZONING ORDINANCE OF THE
CITY OF EULESS, TEXAS; AMENDING THE CITY OF
EULESS ZONING DISTRICT MAP ON CERTAIN PROP-
ERTY OUT OF THE BELL RANCH TERRACE ADDITION;
PROVIDING FOR A CHANGE OF ZONING FROM PD
(PLANNED DEVELOPMENT FOR SINGLE - FAMILY AT-
TACHED AND ZERO -LOT LINE) AND PD (PLANNED
DEVELOPMENT) AND CUD (COMMUNITY UNIT DEVELOP-
MENT FOR CONDOMINIUMS AND MULTI - FAMILY) TO
R -lA (SINGLE - FAMILY ATTACHED DWELLING DIS-
TRICT); PROVIDING FOR A SEVERABILITY CLAUSE;
PENALTY FOR VIOLATION AND AN EFFECTIVE DATE.
WHEREAS, the Planning & Zoning Commission has conducted a public
hearing on November 5, 1985, in conjunction with Zoning Case No.
85 -37, and has rendered a recommendation to the City Council with
respect to same;
WHEREAS, City Council has conducted a public hearing on January
28, 1986, considered the recommendation of the Planning & Zoning
Commission, and has determined that the proposed change is in the
best interest of the general welfare of the City of Euless;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS:
SECTION 1
THAT the official zoning district map of the City of Euless,
Texas, being a part of Ordinance No. 347, be amended to read so
that the zoning district classification of that 7.93 acres of
land generally located between Kynette Street and Signet Street,
west of proposed Nita Lane and east and adjacant to the housing
fronting on the east side of Yorkshire Drive, more particularly
described in the plat filed of record as Bell Ranch Terrace
Addition, in Vol. 388 -5, p. 52, P.R.T.C.T., of the Tarrant County
Deed of Records, as Lots 1 through 12, Block 9, now zoned PD
(Planned Development for Single - family Attached and Zero -lot
Line) , and Lots 1, 2, and 5 through 24, Block 8, now zoned PD
(Planned Development) and CUD (Community Unit Development for
Condominiums and Multi- family at a maximum density of 13.1 units
per acre) be changed to R -lA (Single - family Attached Dwelling
District).
SECTION 2
SEVERABILITY CLAUSE. It is hereby declared to be the intention
of the City Council of the City of Euless that the sections,
paragraphs, sentences, clauses, and phrases of this ordinance are
severable and if any phrase, clause, sentence, paragraph, or
section of this ordinance shall be declared unconstitutional by
the valid judgment or decree of any court of competent juris-
diction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs, or sections of
this ordinance, since the same would have been enacted by the
City Council without the incorporation in this ordinance of any
such unconstitutional phrase.
SECTION 3
PENALTY FOR VIOLATION. Any person, firm, or corporation vio-
lating the terms and provisions of this ordinance, or the amend-
ments to the City of Euless Charter hereby made, shall be deemed
guilty of a misdemeanor and, upon conviction thereof, shall be
liable to a fine in an amount not to exceed One - thousand Dollars
($1,000), and each day such violation shall be permitted to exist
shall constitute a separate offense, as provided by Ordinance No.
347, and subsequent amendments to the Euless City Charter and the
Statutes of the State of Texas.
SECTION 4
EFFECTIVE DATE. This ordinance shall be in full force and effect
from and after its passage, as provided by the Euless City
Charter and the laws of the State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of the
Euless City Council on the 28th day of January, 1986, by a vote
of 5 ayes, 0 nays, and 0 abstentions.
