HomeMy WebLinkAbout877 03-11-1986ORDINANCE NO. 877 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; ESTABLISHING CERTAIN MINIMUM EXTERIOR FACADE REQUIREMENTS IN ALL SINGLE FAMILY, COMMERCIAL AND INDUSTRIAL ZONING DISTRICTS; PROVIDING FOR A SERVIBILITY CLAUSE, PENALTY FOR VIOLATION; PROVIDING AN EFFECTIVE DATE; AND DECLARING AN EMERGENCY. WHEREAS, the current zoning ordinance specifies no minimum exterior facade requirements in single family, commercial or industrial zoning districts of the City of Euless; and (900) measured parallel to adjacent public streets. The required sixty WHEREAS, in order to preserve and enhance the permanency and quality of these neighborhoods and to encourage high quality future development, a minimum exterior facade requirement is deemed necesary; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TARRANT COUNTY TEXAS: SECTION I THAT Section 7 -400, entitled "'C -1' Neighborhood Business District ", be amended by adding an additional subsection to the end thereof, to read as follows: 7 -408 Exterior Facade Requirements (1) All buildings hereafter erected in the "C -1" Neighborhood Business District shall have a minimum of sixty percent (60 %) masonry veneer on any exterior wall elevation having an angle of less than ninety degrees (900) measured parallel to adjacent public streets. The required sixty percent (60 %) masonry veneer shall be calculated by finding sixty percent (60 %) of the area that describes the exterior wall elevation, exclusive of windows and doors and inclusive of any appendages to the wall. (2) Special exception to this requirement may be granted on a case by case basis by the Euless City Council provided that the Council finds that the proposed building, materials and arrangement of these materials will enhance and preserve the characteristics of the neighborhood in which the structure is located. Special exceptions approved by City Council shall be in effect for only the structure(s) specifically authorized by Council and shall become null and void should no building permit be issued within ninety (90) days or should the building permit for the specific structure expire. Special exception applications shall be made in accordance with the last approved policy for such by the Euless City Council. 0 SECTION II THAT Section 7 -500, entitled "'C -2' Community Business District ", be amended by adding an additional subsection to the end thereof, to read as follows: 7 -507 Exterior Facade Requirements (1) All buildings hereafter erected in the "C -2" Community Business District shall have a minimum of sixty percent (60 %) masonry veneer on any exterior wall elevation having an angle of less than ninety degrees (900) measured parallel to adjacent public streets. The required sixty percent (60 %) masonry veneer shall be calculated by finding sixty percent (60 %) of the area that describes the exterior wall elevation, exclusive of windows and doors and inclusive of any appendages to the wall. SECTION III THAT Section 7 -600, entitled "'L -1' Limited Industrial District ", be amended by adding an additional subsection to the end thereof, to read as follows: 7 -609 Exterior Facade Requirements (1) All buildings hereafter erected in the "L -1" Limited Industrial District shall have a minimum of sixty percent (60 %) masonry veneer on any exterior wall elevation having an angle of less than ninety degrees (900) measured parallel to adjacent public streets. The required sixty percent (60 %) masonry veneer shall be calculated by finding sixty percent (60 %) of the area that describes the exterior wall elevation, exclusive of windows and doors and inclusive of any appendages to the wall. (2) Special exception to this requirement may be granted on a case by case basis by the Euless City Council provided that the Council finds that the proposed building materials and arrangement of these materials will enhance and preserve the characteristics of the neighborhood in which the structure is located. Special exception applications shall be made with the application of the site plan requirements of Section 7 -603 herein and in accordance with the last approved policy for such by the Euless City Council. nRDINANCE NO. 877 PAGE 2 of 5 SECTION IV THAT Section 7 -700, entitled "I -1' Light Industrial District ", be amended by adding an additional subsection to the end thereof, to read as follows: 7 -707 Exterior Facade Requirements (1) All buildings hereafter erected in the "I -1" Light Industrial District shall have a minimum of sixty percent (60 %) masonry veneer on any exterior wall elevation having an angle of less than ninety degrees (900) measured parallel to adjacent public streets. The required sixty percent (60 %) masonry veneer shall be calculated by finding sixty percent (60%) of the area that describes the exterior wall elevation, exclusive of windows and doors and inclusive of any appendages to the wall. (2) Special exception to this requirement may be granted on a case by case basis by the Euless City Council provided that the Council finds that the proposed building materials and arrangement of these materials will enhance and preserve the characteristics of the neighborhood in which the structure is located. SECTION V THAT Section 7 -800, entitled "'I -2' Heavy Industrial District ", be amended by adding an additional subsection to the end thereof, to read as follows: 7 -806 Exterior Facade Requirements (1) All buildings hereafter erected in the "I -2" Heavy Industrial District shall have a minimum of sixty percent (60 %) masonry veneer on any exterior wall elevation having an angle of less than ninety degrees (900) measured parallel to adjacent public streets. The required sixty percent (60 %) masonry veneer shall be calculated by finding sixty percent (60 %) of the area that describes the exterior wall elevation, exclusive of windows and doors and inclusive of any appendages to the wall. (2) Special exception to this requirement may be granted on a case by case basis by the Euless City Council provided that the Council finds that the proposed building materials and arrangement of these materials will enhance and preserve the characteristics of the neighborhood in which the structure is located. ORDINANCE NO. 877 , PAGE 3 of 5 0 SECTION VI THAT Section 7 -100, entitled "'R -1' Single Family Dwelling District ", be amended by adding an additional subsection to the end thereof, to read as follows: 7 -106 Exterior Facade Requirements (1) Any main structures containing 1,300 square feet of livable floor area or less shall maintain an exterior masonry veneer of not less than eighty percent (80 %) on the first floor of all but the rear wall elevation. (2) Any main structures containing more than 1,300 square feet but less than 1,650 square feet of livable floor area shall maintain a minimum exterior masonry veneer of not less than sixty percent (60 %) on the first floor on all but the rear wall elevation. (3) In both cases, the wall area subject to these requirements shall be applicable to the area that describes the exterior wall elevation below the first floor plateline, excluding any doors and windows and inclusive of any appendages to the wall. (4) Special exception to this requirement may be granted on a case by case basis by the Euless City Council provided that the Council finds that the proposed building materials and arrangement of these materials will enhance and preserve the characteristics of the neighborhood in which the structure is located. Special exceptions approved by City Council shall be in effect for only the structure(s) specifically authorized by Council and shall become null and void should no building permit be issued within ninety (90) days or should the building permit for the specific structure expire. Special exception applications shall be made in accordance with the last approved policy for such by the Euless City Council. SECTION VII PENALTY FOR VIOLATION: Any person, firm, or corporation violating the terms and provisions of this ordinance, or the amendments to the City of Euless Charter hereby made, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed One Thousand ($1,000.00) Dollars, and each day such violations shall be permitted to exist shall constitute a separate offense. SECTION VIII SEVERABILITY CLAUSE: It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgement of decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. ORDINANCE NO. 877 PAGE 4 of 5 0 SECTION IX EFFECTIVE DATE: This Ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. SECTION X EMERGENCY CLAUSE: By the affirmative vote of four or more of its members, the City Council declares that this is an ordinance for the immediate preservation of the public peace, property, health, and safety, and is an emergency measure within the meaning of Article II, Section II of the City Charter; and the requirement that it be read at two meetings, as specified in Section II, is hereby dispensed with.
