AN ORDINANCE VACATING AND ABANDONING A
PORTION OF MILI.ICAN STREET IN THE OAKCREST
ESTATE ADDITION IN THE CITY OF EULESS, TEXAS;
AND AN EFFECTIVE: DATE.
The City Council of the City of Euless, Texas, after careful
study and consideration, has determined that the portion of
Millican Street, a public: street hereinafter specifically des-
cribed, is not being used. by, nor useful, nor convenient to the
public in general; therefore, it constitutes a public charge
without a corresponding public benefit, and the public would be
better served and benefited by its vacation and abandonment.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS, THAT:
SECTION 1
The portion of Millican Street situated in the Oakcrest Estates
Addition, in the City of Euless, particularly described in
Exhibit " A," attached hereto and made a part hereof for all
intents and purposes, is hereby vacated and abandoned as a public
street.
SECTION 2
This ordinance shall become effective immediately from and after
its passage as provided by the Euless City Charter and the laws
of the State of Texas.

BEING that portion of that certain public street, known as MILLICAN DRIVE, in the CITY
OF EULESS, TARRANT COUNTY, TEXAS, and being more particularly described as follows:
BEGINNING at the southwest corner of LOT 16, BLOCK 1, OAK CREST ESTATES
ADDITION, an addition to the City of Euless, Tarrant County, Texas
according to the plat recorded on Page 29 of Volume 388 -4, Plat Records of
Tarrant County, Texas, said point also being in the north line of Alexander
Lane (50 -foot right -of -way) and also being in the east line of Millican
Drive (60 -foot right -of -way);

TO THE MAYOR AND CITY COUNCIL OF THE CITY OF EULESS, TEXAS:
The undersigned hereby makes application for the vacation and abandonment
of that portion of the above named street more particularly described in
EXHIBIT No. 1, attached. In support of this application, the undersigned
represent and warrant the following:
1. The undersigned will hold the City of Euless harmless, and
indemnify it against all suits, costs, expenses, and damages
that may arise or grow out of such vacation and abandonment;
2. Attached, marked EXHIBIT No. 2, is a plat or sketch of the street
sought to be vacated and the surrounding area to the nearest
streets in all directions, showing the abutting lots and blocks,
and the addition in which the above described portion of such
street is situated, together with the record owners of such
lots;
3. Attached, marked EXHIBIT No. 3, is the consent of public
utilities to such vacation;
4. Attached, marked EXHIBIT No. 4, is the consent to such vacation
of all the abutting property owners, except the following: (If
none, so state).

5. Such street should be vacated because: The right -of -way for
Millican Drive was dedicated with the platting of the Millican
Subdivision in 1959. The street was never constructed and as
such was never opened for public use. The City of Euless has
recently acquired fee simple title to all the lots in the
Millican Subdivision, and to Lots 17 and 18, Block 1, OAKCREST
ESTATES ADDITION, which have Millican Drive as their only means
of access. The City of Euless proposes to combine, by
subdivision replat, a portion of the abandoned right -of -way,
Lots J, K, M, N, and portions of Lots H and L, all in the Millican
Subdivision; and Lots 17 and 18 of Oakcrest Estates Addition,
into one (1) tract which will ultimately contain public service
type facilities. The title in the abandoned right -of -way will
be proportionately deeded to the adjacent property owners in
accordance with the laws of the State of Texas and the Ordinance
of the City of Euless governing such abandonments.

6. Such street has been and is being used as follows: As noted in
Item 5. above, the street within the area proposed for abandon-
ment was never constructed. The existing right -of -way is
currently occupied by a 6 -inch water line which the City of
Euless proposes to abandon, concurrent with the abandonment of
the street right -of -way. Texas Power and Light Company also has
an overhead electric distribution line in the eastern portion of
the right -of -way which will either be removed or an exclusive
easement granted for same, concurrent with final action on this
abandonment request.
