HomeMy WebLinkAbout882 05-13-1986ORDINANCE NO. 882 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON CERTAIN PROP- ERTY OUT OF THE J. GROVES SURVEY, A -599; PROVIDING FOR A CHANGE OF ZONING. FROM COM- MUNITY BUSINESS DISTRICT (C -2) TO COMMUNITY UNIT DEVELOPMENT (CUD /R -4) CONFORMING TO THE R -4 MULTI- FAMILY ZONING DISTRICT STANDARDS; PROVIDING FOR A SEVERABILITY CLAUSE, PENALTY FOR VIOLATION, AND AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission has conducted a public hearing on March 4, 1986, in conjunction with Zoning Case No. 86 -02, and has rendered a recommendation to the City Council with respect to same; and WHEREAS, the City Council has conducted a public hearing on April 8, 1986, considered the recommendation of the Planning and Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS; SECTION 1 THAT the official zoning district map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read so that the zoning district classification of that 9.3323 acres of land generally located east and adjacent to Bell Hi Addition, south and adjacent to West Pipeline Road, and north of S.H. 10, more particularly described in Exhibit "A" (attached hereto and made a part hereof), now zoned Community Business District (C -2), is hereby changed to Community Unit Development conforming to the R -4 multi - family zoning district standards, with further limita- tions as specified on the site plan described herein as Exhibit "A". SECTION 2 Said property described in Exhibit "A", pursuant to Section 7 -1100 of the Euless Zoning Ordinance, shall be subject to all the permitted uses of the R -4 multi - family zoning district and other requirements and stipulations specified on the site plan which shall be applicable only to the property described herein. SECTION 3 SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections paragraphs, sentences, clauses, and phrases of this ordinance are severable; and, if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by ORDINANCE NO. 882, PAGE TWO OF FIVE the valid judgment or decree of any court of competent jurisdic- tion, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION 4 PENALTY CLAUSE. Any person, firm, or corporation violating the terms and provisions of this ordinance, or the amendments to the City of Euless Charter hereby made, shall be deemed guilty of a misdemeanor; and, upon conviction thereof, shall be liable to a fine in an amount not to exceed One - thousand Dollars ($1,000), and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Charter and Statutes of the State of Texas. SECTION 5 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 8th day of April, 1986, by a vote of 3 ayes, 0 nays, and 0 abstentions.
