HomeMy WebLinkAbout886 06-24-1986ORDINANCE NO. 886 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS ZONING DISTRICT MAP ON CERTAIN PROPERTY OUT OF THE INTERNATIONAL REGIONAL INDUSTRIAL COMPLEX; PROVIDING FOR A CHANGE OF ZONING FROM HEAVY INDUSTRIAL DISTRICT (I -2) TO HEAVY INDUSTRIAL DISTRICT WITH SPECIFIC USE PERMIT (I -2 W /SP) ALLOWING A 500 -FOOT COMMUNICATIONS TOWER; PROVIDING FOR A SEVERABILITY CLAUSE; PENALTY FOR VIOLATION, AND AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission has conducted a public hearing on May 6, 1986, in conjunction with Zoning Case No. 86 -06, and has rendered a recommendation to the City Council with respect to same; and WHEREAS, the City Council has conducted a public hearing on June 10, 1986, considered the recommendation of the Planning and Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TARRANT COUNTY, TEXAS: SECTION 1 THAT the official zoning district map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read so that the zoning district classification of that 0.3873 acres of land generally located west and adjacent to Westpark Way, across from the City of Euless Animal Shelter and Service Center, more particularly described in Exhibit "A" included herein, now zoned Heavy Industrial District (I -2) is hereby changed to Heavy Industrial District with a Specific Use Permit (I -2 W /SP) al- lowing a 500 -foot communications tower, in accordance with the site plan described herein as Exhibit "A" (attached hereto and made a part hereof). Said property described in Exhibit "A ", pursuant to Section 7 -1000 of the Euless Zoning Ordinance, shall be subject to all the safeguards and conditions set forth on said site plan des- cribed herein as Exhibit "A ". Said site plan shall be applicable only to the property herein described. SECTION 2 SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable; and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by ORDINANCE NO. 886 , PAGE TWO OF FIVE the valid judgment or decree of any court of competent juris- diction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION 3 PENALTY FOR VIOLATION. Any person, firm, or corporation vio- lating the terms and provisions of this ordinance, or the amend- ments to the City of Euless Charter hereby made, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed One - thousand Dollars ($1,000), and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Charter and Statutes of the State of Texas. SECTION 4 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas.
