AN ORDINANCE ADOPTING THE 1985 EDITION OF THE
UNIFORM PLUMBING CODE & APPENDICES WITH AMEND-
MENTS, REPEALING THE EXISTING PLUMBING CODE AND
ALL AMENDMENTS THERETO, PROVIDING A SEVERABILITY
CLAUSE AND EFFECTIVE DATE.
Whereas, it is deemed necessary to provide minimum standards to regulate
the design, construction, materials, use and occupancy location and maintenance
of buildings and structures, and certain equipment thereof, within the city to
protect and promote the public safety, health and welfare.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS,
TEXAS:
I.
ADOPTION OF STANDARD CODE
The 1985 edition of the Uniform Plumbing Code & appendices, as adopted by
the International Association of Plumbing and Mechanical Official's with pro-
visions is hereby adopted. One copy of said Uniform Plumbing Code and amendments
have been filed in the office of the City Secretary for permanent record and
inspection.
II.
AMENDMENTS TO THE UNIFORM PLUMBING CODE
Part I - Administration - Section 20.7
Cost of Permit - Amend to read:
A. The fee for each permit shall be as set forth in the City of Euless Schedule
of Fees, Ordinance #807. There shall be a re- inspection fee of $15.00 where
it is necessary for the plumbing inspector to re- inspect any phase of a
plumbing installation.
B. Registration of Plumbing Contractors
The master plumber shall be required to maintain a registration with the
City before performing any type of plumbing work. Each contractor shall
furnish the plumbing department with a written notice of contractor's
permanent business and residential address, telephone numbers, proof of
current state license, and if actively engaged in the plumbing contracting
business a list of journeyman plumbers and other plumbing helpers employed
by contractor.
C. Registration Fees
For a business registration a fee shall be paid in addition to the other
provisions provided herein. The fee for initially establishing registration
data shall be $50.00. The annual renewal fee for continuing the validity
of registration data shall be $25.00.
D. Registration Renewal
The registration may be renewed for the calendar year by filing of a new
registration and the payment of a renewal fee as set forth herein. No
refund will be paid in the event of the revocation or surrender of any
such certificate of license.
D. Insurance
Every registrant shall carry contractor's public liability insurance in
not less than the following amounts:
Bodily Injury - $300,000 each occurrence
Property Damage - $100,000 each occurrence
Chapter 2 - Table A - Plumbing Material Standards, delete the following items:
Asbestos cement -non pressure sewer pipe
Absestos cement non - pressure small diameter sewer pipe
Asbestos cement pressure pipe
Asbestos cement pressure pipe for water and other liquids
Asbestos cement pressure pipe for water service and yard piping (installation)
Chlorinated poly )vinal Chloride (cpvc) plastic hot water distribution
systems.
Estra strength and standard strength clay pipe and perforated clay pipe
Fittings for joining polyethylene pipe for water service and yard piping
Non - metallic building and house sewers
Homogenous bitumized fiber drain and sewer pipe to Polybutylene (pb) hot
and cold water distribution systems
Polybutylene (pb) hot and cold water distribution systems using insert
fittings (installation)
Polybutylene (pb) cold water building supply and yard piping (installation)
Chapter 4, Section 401 (c) Add:
(c) Building Sewers shall be of the same materials as the building drain.
Chapter 10, Section 1004, Delete and amend to Read:
All cold and hot water piping fittings shall be of copper. All materials
used in the water supply system, except valves and similar devices shall be
of a like material, except where otherwise approved by the administrative
authority. Copper tubing and piping shall not be less than type "M ".
III.
ORDINANCES REPEALED
Ordinances 141, 199, 502, 616, 716 and all ordinances amendatory there-
to are expressly superseded by the terms of this ordinance.
Plumbing permits heretofore issued under existing ordinances shall be
valid for the time for which they were issued under the existing building
code; however, upon expiration of such date, the same shall become void.
All pending litigation and existing violations, both civil and criminal
whether pending in courts or not, under the building code and amendments
therefore superseded by this ordinance, shall not be affected by this
ordinance.

IV.
SEVERABILITY CLAUSE
That it is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of the
ordinance are severable, and if any phrase, clause, sentence, paragraph
or section of this ordinance shall be declared unconstitutional by the
valid judgment or decree of any court of competent jurisdiction, such
unconstitutionality shall not affect any of the remaining phrases,
clauses, sentences, paragraphs and sections of this ordinance, since
the same would have been enacted by the City Council without the in-
corporation in this ordinance of any such unconstitutional phrase,
clause, sentence, paragraph or section.
V.
PENALTY FOR VIOLATION
Any person, firm or corporation violating any of the terms and pro-
visions of this ordinance shall be deemed guilty of a misdemeanor and
upon conviction thereof, shall be fined in an amount not to exceed
$1,000.00. Each such violation shall be deemed a separate offense and
shall be punishable as such hereunder.
VI.
EFFECTIVE DATE
This ordinance shall be in full force and effect from and after its
passage and publication as provided by the Euless City Charter and the laws
of the State of Texas
