AN ORDINANCE AMENDING ORDINANCE NO. 347,
IDENTIFIED AS THE ZONING ORDINANCE OF THE
CITY OF EULESS, TEXAS; AMENDING THE CITY OF
EULESS ZONING DISTRICT MAP ON CERTAIN
PROPERTY OUT OF THE KITTY HOUSE SURVEY A -678;
PROVIDING FOR A CHANGE OF ZONING FROM R -1,
SINGLE FAMILY DETACHED DWELLING DISTRICT, TO
C -2, COMMUNITY BUSINESS DISTRICT; PROVIDING
FOR A SEVERABILITY CLAUSE; PENALTY FOR
VIOLATION AND AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission conducted a public
hearing on the 15th day of July, 1986, in conjunction with Zoning
Case No. 86 -14 and rendered a recommendation to the City Council
with respect to same;
WHEREAS, City Council conducted a public hearing on the 12th day
of August, 1986, considered the recommendation of the Planning
and Zoning Commission, and determined that the proposed change is
in the best interest of the general welfare of the City of
Euless;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS:
SECTION 1
THAT the official zoning district map of the City of Euless,
Texas, being a part of Ordinance No. 347, be amended to read so
that the zoning district classification of that 0.18 acres of
land generally located north of S.H. 10 and west of Westpark Way,
more particularly described in Exhibit "A," (attached hereto and
made a part hereof), being a portion of Tract 2A3A and 2C,
Abstract No. 678, now zoned Single Family Detached Dwelling
District (R -1) is hereby changed to Community Business District
(C -2).
SECTION 2
SEVERABILITY CLAUSE. It is hereby declared to be the intention
of the City of Euless that the sections, paragraphs, sentences,
clauses, and phrases of this ordinance are severable; and if any
phrase, clause, sentence, paragraph, or section of this ordinance
shall be declared unconstitutional by the valid judgment of any
court of competent jurisdiction, such unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences,
paragraphs, or section of this ordinance, since the same would
have been enacted by the City Council without the incorporation
in this ordinance of any such unconstitutional phrase.

PROPOSED REZONING EXISTING R -1 (RESIDENTIAL) TO C -2 (BUSINESS)
BEING a 0.18 Ac tract of laud and being a part of a 2.21 Ac tract of land Known
as tracts 2A9Af 2C in the Kitty llouse Survey, Abstract G76 in Tarrant County,
Texas and conveyed to the Dav -Kin Corporation as recorded in Vol 66-73 ,page
of the Deed Records, Tarrant County,Texas, and more particularily described
as follows:
CO ?N1GNCING at an iron in the west property line of said 2.21 Ac tract, and said
iron also being in the north right of way line of State Highway 10;
TIiENCE N 00 -11 W 325.4 Peet along said west line to the POINT OF BLGINNING, said
point being parallel to and 300' away from said north right of way;
THENCE N 00 -11 W 80.3 feet along said west line to an iron being the northwest
corner of said 2,21 Ac tract;
THENCE 6W4694 E 1917 to a point, said point being in the north line of said
2.21 Ac tract;
THENCE S 67 -01 W 207.8 feet, said hearing and distance being parallel to and
300' away from said north right of way of State Highway le, to the pOIN'I 01;
BLCI.NNING ofa tract containing 7696 sift. or 0.18 Ac. of land more or less.

SECTION 3
PENALTY FOR VIOLATION. Any person, firm, or corporation
violating the terms and provisions of this ordinance, or the
amendments to the City of Euless Charter hereby made, shall be
deemed guilty of a misdemeanor and, upon conviction thereof,
shall be liable to a fine in an amount not to exceed One- thousand
Dollars ($1,000), and each day such violation shall be permitted
to exist shall constitute a separate offense, as provided by
Ordinance No. 347, and subsequent amendments to the Euless City
Charter and the Statutes of the State of Texas.
SECTION 4
EFFECTIVE DATE. This ordinance shall be in full force and effect
from and after its passage, as provided by the Euless City
Charter and the laws of the State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of the
Euless City Council on the 12th day of August, 1986, by a vote of
4 ayes, 0 nays, and 0 abstentions.
GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting
of the Euless City Council on the 26th day of August ,
1986, by a vote of 5 ayes, 0 nays, and 0 abstentions.
