AN ORDINANCE AMENDING ORDINANCE NO. 347,
IDENTIFIED AS THE ZONING ORDINANCE OF THE
CITY OF EULESS, TEXAS; AMENDING THE CITY OF
EULESS ZONING DISTRICT NAP ON CERTAIN PROP-
ERTY OUT OF THE A.J. HUITT SURVEY A -684;
PROVIDING FOR A CHANGE OF ZONING FROM R -5,
MULTI - FAMILY DWELLING DISTRICT (24 UNITS PER
ACRE), TO C -2, COMMUNITY BUSINESS DISTRICT;
PROVIDING FOR A SEVERABILITY CLAUSE; PENALTY
FOR VIOLATION AND AN EFFECTIVE DATE.
WHEREAS, The Planning and Zoning Commission conducted a public
hearing on the 16th day of September, 1986, in conjunction with
Zoning Case No. 86 -16 and rendered a recommendation to the City
Council with respect to same;
WHEREAS, City Council conducted a public hearing on the 14th day
of October, 1986, considered the recommendation of the Planning
and Zoning Commission, and determined that the proposed change is
in the best interest of the general welfare of the City of
Euless;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS:
SECTION 1
THAT the official zoning district map of the City of Euless,
Texas, being a part of Ordinance No. 347, be amended to read so
that the zoning district classification of that 1.88 acres of
land generally located in the 1000 Block of Villa Drive east of
F.M. 157, more particularly described in Exhibit "A," (attached
hereto and made a part hereof), being a portion of Tract 5B,
Abstract No. 684, now zoned Multi- Family Dwelling District (24
Units Per Acre) (R -5) is hereby changed to Community Business
District (C -2).
SECTION 2
SEVERABILITY CLAUSE. It is hereby declared to be the intention
of the City of Euless that the sections, paragraphs, sentences,
clauses, and phrases of this ordinance are severable; and if any
phrase, clause, sentence, paragraph, or section of this ordinance
shall be declared unconstitutional by the valid judgment of any
court of competent jurisdiction, such unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences,
paragraphs, or section of this ordinance, since the same would
have been enacted by the City Council without the incorporation
in this ordinance of any such unconstitutional phrase.
EXHIBIT "A"
LEGAL DESCRIPTION
Being 1.858 acres of land located in the A.J. Huitt Survey, Abstract
No. 684, Tarrant County, Texas, being a portion of the tract of land described
in the deed to Texas Bank and Trust Company of Dallas, in Volume 5921,
Page 415, of the Deed Records, Tarrant County, Texas. Said 1.858 acres
of land being more particularly described by metes and bounds as follows:
BEGINNING at an iron rod at the Northeast corner of said Texas Bank and
Trust Company tract lying by deed East 461.33 varas and South 382.84
varas from the Northwest corner of said Huitt Survey;
THENCE S00041'00 "E 144.76 feet along the East line of said Texas
Bank and Trust Company tract, to an iron rod in the North right -of-
way line of Villa Drive, according to the plat of Villa West Addition,
an addition to the City of Euless, Texas, as recorded in Volume
388 -45, Page 23, of the Plat Records, Tarrant County, Texas;
THENCE along said right -of -way line as follows:
1. S89 019'00 "W 131.36 feet to an iron rod;
2. N88 029100 "W 414.33 feet to an iron rod at the Southeast corner
of Lot 4, Villa West, Second Installment Addition, an addition
to the City of Euless, Texas, according to the plat recorded
in Volume 388 -52, Page 63, of the Plat Records, Tarrant County,
Texas;
THENCE N01 031'00 "E 149.69 feet along the East line of said Lot 4,
to an iron rod at the Northeast corner of said- Lot 4;
THENCE S88 029100 11E 540.04 feet along the North line of said Texas
Bank and Trust Company tract to the place of beginning, containing
1.858 acres of land.

SECTION 3
PENALTY FOR VIOLATION. Any person, firm, or corporation
violating the terms and provisions of this ordinance, or the
amendments to the City of Euless Charter hereby made, shall be
deemed guilty of a misdemeanor and, upon conviction thereof,
shall be liable to a fine in an amount not to exceed One- thousand
Dollars ($1,000), and each day such violation shall be permitted
to exist shall constitute a separate offense, as provided by
Ordinance No. 347, and subsequent amendments to the Euless City
Charter and the Statutes of the State of Texas.
SECTION 4
EFFECTIVE DATE. This ordinance shall be in full force and effect
from and after its passage, as provided by the Euless City
Charter and the laws of the State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of the
Euless City Council on the 14th day of October, 1986, by a vote
of Al ayes, p nays, and O abstentions.
GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting
