AN ORDINANCE AMENDING ORDINANCE NO. 347,
IDENTIFIED AS THE ZONING ORDINANCE OF
THE CITY OF EULESS, TEXAS; AMENDING THE
CITY OF EULESS ZONING DISTRICT MAP ON
CERTAIN PROPERTY OUT OF THE JOHN GROVES
SURVEY; PROVIDING FOR A CHANGE OF ZONING
FROM C -2 (COMMUNITY BUSINESS DISTRICT)
AND CUD R -3 AND R -4 (MULTI FAMILY
DISTRICT, AT 12 AND 16 UNITS PER ACRE),
TO PLANNED DEVELOPMENT FOR SINGLE
FAMILY DETACHED (WITH REDUCED SETBACKS
AND LOT SIZES); PROVIDING FOR A
SEVERABILITY CLAUSE, PENALTY FOR
VIOLATION AND AN EFFECTIVE DATE.
WHEREAS, the Planning & Zoning Commission has conducted a public
hearing on September 16, 1986, and October 7, 1986, in
conjunction with Zoning Case No. 86 -15, and has rendered a
recommendation to the City Council with respect to same;
WHEREAS, City Council has conducted a public hearing on October
28, 1986, considered the recommendation of the Planning & Zoning
Commission, and has determined that the proposed change is in the
best interest of the general welfare of the City of Euless;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS:
SECTION 1
THAT the official zoning district map of the City of Euless,
Texas, being a part of Ordinance No. 347, be amended to read so
that the zoning district classification of that 32.67 acres of
land generally located between W. Pipeline and S.H. 10 and east
of Paula Lane, more specifically described in Exhibit A,
(attached hereto and made a part hereof), be changed from C -2
(Community Business District) and CUD R -3 and R -4, (Community
Unit Development conforming to the R -3 and R -4 (Multi - Family 12
and 16 Units Per Acre) Zoning District Standards), to Planned
Development for Single Family Detached (with reduced setbacks and
lot sizes), in accordance with the site plan labled as Exhibit A,
(attached herewith and made a part hereof).
Said property described in Exhibit A, pursuant to Section 7 -1000
of the Euless Zoning Ordinance, shall be subject to all the
safeguards and conditions set forth on said site plan described
herein as Exhibit A. Said site plan shall be applicable only to
the property herein described.
SEVERABILITY CLAUSE. It is hereby declared to be the intention
of the City Council of the City of Euless that the sections,
paragraphs, sentences, clauses, and phrases of this ordinance are
severable and if any phrase, clause, sentence, paragraph, or
section of this ordinance shall be declared unconstitutional by
the valid judgment or decree of any court of competent juris-
diction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs, or sections of
this ordinance, since the same would have been enacted by the
City Council without the incorporation in this ordinance of any
such unconstitutional phrase.

PENALTY FOR VIOLATION. Any person, firm, or corporation vio-
lating the terms and provisions of this ordinance, or the amend-
ments to the City of Euless Charter hereby made, shall be deemed
guilty of a misdemeanor and, upon conviction thereof, shall be
liable to a fine in an amount not to exceed One- thousand Dollars
($1,000), and each day such violation shall be permitted to exist
shall constitute a separate offense, as provided by Ordinance No.
347, and subsequent amendments to the Euless City Charter and the
Statutes of the State of Texas.
SECTION 4
EFFECTIVE DATE. This ordinance shall be in full force and effect
from and after its passage, as provided by the Euless City
Charter and the laws of the State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of the
Euless City Council on the 28th day of October, 1986, by a vote
of 3 ayes, 2 nays, and 0 abstentions.
