AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTI-
FIED AS THE ZONING ORDINANCE OF THE CITY OF
EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING
DISTRICT MAP ON CERTAIN PROPERTY OUT OF THE J. P.
HALFORD SURVEY, A -711; PROVIDING FOR A CHANGE OF
ZONING FROM COMMUNITY BUSINESS DISTRICT (C -2) TO
COMMUNITY UNIT DEVELOPMENT (CUD /R -3) CONFORMING TO
THE R -3 MULTI- FAMILY ZONING DISTRICT STANDARDS;
PROVIDING FOR A SEVERABILITY CLAUSE, PENALTY FOR
VIOLATION, AND AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission has conducted a public hearing on
December 2, 1987, in conjunction with Zoning Case No. 86 -22, and has rendered
a recommendation to the City Council with respect to same; and
WHEREAS, the City Council has conducted a public hearing on January 13, 1987,
considered the recommendation of the Planning and Zoning Commission, and has
determined that the proposed change is in the best interest of the general
welfare of the City of Euless.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS,
TEXAS;
SECTION 1
THAT the official zoning district map of the City of Euless, Texas, being a
part of Ordinance No. 347, be amended to read so that the zoning district
classification of that .33 acres of land generally located on the west side of
the 300 block of North Main Street, more particularly described as area 1 in
Exhibit "A" (attached hereto and made a part hereof), now zoned Community
Business District (C -2), is hereby changed to Community Unit Development
conforming to the R -3 townhome zoning district for ingress /egress only.
SECTION 2
Said property described in Exhibit "A ", pursuant to Section 7 -1100 of the
Euless Zoning Ordinance, shall be subject to all the permitted uses of the R -3
multi - family zoning district and with specific limitations for ingress /egress.
SECTION 3
THAT the official zoning district map of the City of Euless, Texas, being a
part of Ordinance No. 347, be amended to read so that the zoning district
classification of that 0.31 acres of land generally located on the west side
of the 300 block of North Main Street, more particularly described as area 2
in Exhibit "B," (attached hereto and made a part hereof), now zoned Community
Unit Development conforming to the townhome requirements of the R -3 zoning
district, with further limitations for ingress /egress only, is hereby changed
to Community Business District (C -2).

Area 1 from C -2 to CUD -R3 Zoning
Being a 0.326 acre tract of land situated in the J. B. Halford
Survey, Abstract No. 711, Tarrant County, Texas and being a por-
tion of that certain tract of land as described by deed to Ronald
A. Scott and recorded in deed Volume 8572, Page 483, County
Records, Tarrant County, Texas, said 0.326 acre tract of land
being more particularly described by metes and bounds as follows:
BEGINNING at a point in the easterly line of said Scott
tract, said point being S 000 29' 47" W, 160.00 feet from the
northeast corner of said Scott tract, said point also being in the
westerly right -of -way line of North Main Street (a 50 foot wide
public right -of -way), said point also being North 1660.5 feet ( +)
and West 25.0 feet ( +) from the southeast corner of said J. B.
Halford Survey;
THENCE S 000 29' 47" W, along the easterly line of said Scott
tract and the westerly right -of -way line of North Main Street,
42.00 feet;
THENCE N 880 32' 58" W, leaving said easterly line and said
westerly right -of -way line, 100.00 feet to the beginning of a
curve to the right;
THENCE along said curve to the right in a westerly direction
through a central angle of 140 03' 59 ", a radius of 200.00 feet,
an arc length of 49.10 feet and a long chord of N 810 30' 59" W,
48.98 feet to the end of said curve and the beginning of a reverse
curve to the left;
THENCE along said reverse curve to the left in a westerly
direction through a central angle of 140 03' 59, a radius of
200.00 feet, an arc length of 49.10 feet and a long chord of N 810
30' 59" W, 48.98 feet to the end of said curve;
THENCE N 880 32' 58" W, 217.55 feet;
THENCE N 010 25' 11" E, 30.00 feet;
THENCE S 880 32' 58" E, 414.09 feet to the POINT OF BEGINNING
and containing 0.326 acres of land, more or less.

Area 2 from CUD -R 3 to C -2 Zoning
Being a 0.305 acre tract of land situated in the James P. Hallford
Survey, Abstract No. 711, Tarrant County, Texas, said tract of
land being a portion of that certain tract of land as described by
deed to Marion F. Dooley and M. R. Cannon, as recorded in Volume
4531, Page 61, Tarrant County Deed Records, and being more par-
ticularly described by metes and bounds as follows:
COMMENCING at a 5/8" iron pin, with cap stamped "Carter &
Burgess," found, the northeast corner of a tract of land as
described by deed to Carl Stone, and recorded in Volume 5206, Page
673, said deed records, said point also being the southeast corner
of 6.84 acre tract of land as described by deed to R. W. Tamplin,
Trustee, and recorded in Volume 7093, Page 208, said Deed Records,
said point also being in the westerly right -of -way line of North
Main Street (a 50 foot wide public right -of -way), said point lying
1336.1 feet (plus or minus) north and 25.0 feet, (plus or minus)
west of the southeast corner of said James P. Hallford Survey;

SECTION 4
SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City
Council of the City of Euless that the sections paragraphs, sentences, clau-
ses, and phrases of this ordinance are severable; and, if any phrase, clause,
sentence, paragraph, or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs, or sections of this ordinance, since
the same would have been enacted by the City Council without the incorporation
in this ordinance of any such unconstitutional phrase, clause, sentence,
paragraph, or section.
SECTION 5
PENALTY CLAUSE. Any person, firm, or corporation violating the terms and
provisions of this ordinance, or the amendments to the City of Euless Charter
hereby made, shall be deemed guilty of a misdemeanor; and, upon convictipn
thereof, shall be liable to a fine in an amount not to exceed One- thousand
Dollars ($1,000), and each day such violation shall be permitted to exist
shall constitute a separate offense, as provided by Ordinance No. 347, and
subsequent amendments to the Euless City Charter and Statutes of the State of
Texas.
SECTION 6
EFFECTIVE DATE. This ordinance shall be in full force and effect from and
after its passage, as provided by the Euless City Charter and the laws of the
State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless .City
Council on the 13th day of January, 1987, by a vote of 5 ayes, 0 nays, and 0
abstentions.
PRESENTED AND PASSED ON SECOND AND FINAL READING at a regular meeting of the
Euless City Council on the 77th day of January 1987, by a vote of
