HomeMy WebLinkAbout920 02-10-1987ORDINANCE NO. 920 AN ORDINANCE AMENDING THE EULESS FIRE AND BUILDING CODES TO PROVIDE FOR THE GRANT OF A VARIANCE BY THE EULESS CITY COUNCIL FOR THE INSTALLATION AND MAINTENANCE OF AUTOMATIC SPRINKLER SYSTEMS UPON ALTERNATION, REPAIR OR ENLARGEMENT OF CERTAIN OCCUPANCIES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND DECLARING AN EMERGENCY. WHEREAS, the City Council of the City of Euless, Texas, heretofore adopted Fire and Building Codes for the City of Euless, Texas; and WHEREAS, such Fire and Building Codes, as amended, require the installation and maintenance of automatic sprinkler systems within certain existing occupied structures of the city having more than 10,000 square feet of floor area upon alteration, repair or enlargement thereof; and WHEREAS, it is the desire of the City Council of the City of Euless, Texas, to authorize the grant of a variance to such requirement of installation and maintenance of automatic sprinkler systems upon alteration, repair or enlargement of certain occupancies existent and in use at time of establishment of such requirement, which variances would be upon such conditions as might be established by the Euless City Council. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: Section I. Paragraph 3 of subsection (c) of Section 10.308 of the Euless Fire Code and Paragraph 3 of subsection (c) of Section 3802, are, each, as amended, herewith amended to hereafter be and read as follows: 3. "Assembly Areas, Exhibition and Display Rooms. An automatic sprinkler system shall be installed in Group A occupancies which have more than 10,000 square feet of floor area which can be used for exhibition, assembly or display purposes. Provided, however, as to assembly areas, exhibition and display rooms being used for such purposes on such requirement shall not apply to a renovation or enlargement of such pre - existing use, provided the user thereof applies for and obtains a variance for the installation of such required sprinkler system from the Euless City Council, which variance, if granted, may be conditioned as the City Council may determine. Section II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. Section III. Emergency Clause. By the affirmative vote of four or more of its members, the City Council declares that this is an ordinance for the immediate preservation of the public peace, property, health, and safety, and is an emergency measure within the meaning of Article II, Section 11 of the City Charter; and the requirement that it be read at two meetings, as specified in Section 11, is hereby dispensed with. Section IV. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND PASSED on first and final reading on the loth day of February , 1987, at a regular meeting of the City Council of the City of Euless, Texas, by a vote of 5 ayes, 0 nayes and 0 abstentions.
