AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AT
THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS;
AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON
CERTAIN PROPERTY OUT OF THE J. P. HALFORD ADDITION;
PROVIDING FOR A CHANGE OF ZONING FROM COMMUNITY BUSI-
NESS DISTRICT (C -2) TO COMMUNITY BUSINESS DISTRICT WITH
SPECIFIC USE PERMIT (C -2 W /SP) ALLOWING REDUCED SIGN
SPACING; PROVIDING FOR A SEVERABILITY CLAUSE; PENALTY
FOR VIOLATION AND AN EFFECTIVE DATE.
WHEREAS, Planning and Zoning Commission conducted a public hearing on the
7th day of April, 1987, in conjunction with Zoning Case No. 87 -04 and ren-
dered a recommendation to the City Council with respect to same;
WHEREAS, City Council conducted a public hearing on the 28th day of April,
1987, considered the recommendation of the Planning and Zoning Commission,
and determined that the proposed change is in the best interest of the
general welfare of the City of Euless;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS,
TEXAS:
SECTION 1
THAT the official zoning district map of the City of Euless, Texas, being a
part of Ordinance No. 347, be amended to read so that the zoning district
classification of that 0.39 acres of land generally located on the north-
west corner of West Euless Boulevard and South Main Street and more
particularly described as Lot 5, Block D, J. P. Halford Addition, now
zoned Community Business District (C -2) is hereby changed to Community
Business District with a Specific Use Permit (C -2 W /SP), allowing reduced
sign spacing, in accordance with the site plan described herein as Exhibit
"A ", (attached hereto and made a part hereof).
Said property described in Exhibit "A ", pursuant to Section 7 -1000 of the
Euless Zoning Ordinance, shall be subject to all the safeguards and con-
ditions set forth on said site plan described herein as Exhibit "A ". Said
site plan shall be applicable only to the property described herein.
SECTION 2
SRVERABILITY CLAUSE. It is hereby declared to be the intention of the City
of Euless that the sections, paragraphs, sentences, clauses, and phrases of
this ordinance are severable; and if any phrase, clause, sentence,
paragraph, or section of this ordinance shall be declared unconstitutional
by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases,
clauses, sentences, paragraphs, or sections of this ordinance, since the
same would have been enacted by the City Council without the incorporation
in this ordinance of any such unconstitutional phrase.
SECTION 3
PENALTY FOR VIOLATION. Any person, firm, or corporation violating the
terms and provisions of this ordinance, or the amendments to the City of
Euless Charter hereby made, shall be deemed guilty of a misdemeanor and,
upon conviction thereof, shall be liable to a fine in an amount not to
exceed One- thousand Dollars ($1,000), and each day such violation shall be
permitted to exist shall constitute a separate offense, as provided by
Ordinance No. 347, and subsequent amendments to the Euless City Charter and
the Statutes of the State of Texas.
SECTION 4
EFFECTIVE DATE. This ordinance shall be in full force and effect from and
after its passage, as provided by the Euless City Charter and the laws of
the State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City
Council on the 28th day of April , 1987, by a vote of 5— ayes,
0 nays, and 0 abstentions.
GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting of the
Euless City Council on the 12th day of May 1987, by a vote of
5 ayes, 0 nays, and 0 abstentions.
