AN ORDINANCE AMENDING ORDINANCE NO. 927 WHICH
ORDINANCE AMENDED CHAPTER FOUR (4), "BUILDINGS
AND STRUCTURES ", OF THE CODE OF ORDINANCES,
CITY OF EULESS, TEXAS, BY THE ADDITION OF AN
"ARTICLE 7" THERETO TO PROVIDE FOR PROCEDURES
TO MINIMIZE FLOOD DAMAGE; PROVIDING A PENALTY
FOR VIOLATION THEREOF; PROVIDING AN EFFECTIVE
DATE; AND PROVIDING A SEVERABILITY CLAUSE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS,
TEXAS, AS FOLLOWS:
I.
Subsection (4), entitled "Manufactured Homes" of Section
B of Division V is amended to change the word "floodways"
appearing in subparagraph (a.) of such subsection (4) to the
word "floodplains" so that such subparagraph (a) of
subsection (4) will hereafter be and read as follows:
(4) Manufactured Homes -
a. The placement of manufactured housing within
the areas which have been identified as
regulatory floodplains is prohibited.
II.
Effective Date. This ordinance shall be in full force
and effect from and after its passage and publication as
provided by the Euless City Charter and the laws of the State
of Texas.
III.
Penalty for Violation. Any person, firm or corporation
violating any of the terms and provisions of this ordinance
shall be deemed guilty of a misdemeanor and, upon conviction
thereof, shall be fined in an amount not to exceed
$1,000.00. Each such person shall be deemed guilty of a
separate offense for each and every day, or portion thereof,
during which any violation of any of the provisions of this
regulation is committed or continued. Each such violation
shall be deemed a separate offense and shall be punishable as
such hereunder.
IV.
Severability Clause. That it is hereby declared to be the
intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable,
and if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such
unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs and sections of this
ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
PRESENTED AND GIVEN FIRST READING at a regular meeting of
the Euless City Council on the 26th day of May, 1987; by a vote
of 4 ayes, 0 nays and 0 abstentions.
GIVEN SECOND READING AND APPROVED at a regular meeting of
the Euless City Council on the 9th day of June ,
1987; by a vote of 4 ayes, 0 nays and 0
abstentions.
