HomeMy WebLinkAbout933 06-09-1987ORDINANCE NO. 933 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON CERTAIN PROPERTY OUT OF THE J. E. WHITENER ADDITION; PROVIDING FOR A CHANGE OF ZONING FROM C -2 W /SP (COMMUNITY BUSINESS DISTRICT) WITH A SPECIFIC USE PERMIT FOR A SKATING RINK TO PD (PLANNED DEVELOPMENT FOR ASSEMBLY AND WHOLESALE DISTRIBUTION OF SKATING EQUIPMENT); PROVIDING FOR A SEVERABILITY CLAUSE, PENALTY FOR VIO- LATION AND AN EFFECTIVE DATE. WHEREAS, the Planning & Zoning Commission has conducted a public hearing on May 5, 1987, in conjunction with Zoning Case No. 87 -07, and has rendered a recommendation to the City Council with respect to same; WHEREAS, City Council has conducted a public hearing on May 26, 1987, considered the recommendation of the Planning & Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: Oxi 011opkil THAT the official zoning district map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read so that the zoning district classification of that 1.5 acres, at 1001 S. Main Street, located south and adjacent to Spring Valley Apartments, north of South Pipeline Road and east and adjacent to South Main Street, more specifically described as Lot C, Block 1, J. E. Whitener Addition, be changed from C -2 w /sp (Community Business District) with a Specific Use Permit for a skating rink, to Planned Development for assembly and wholesale distribution of skating equipment, in accordance with the site plan labeled as Exhibit "A," (attached herewith and made a part hereof). Said property described as Lot C, Block 1, J. E. Whitener Addition, pursuant to Section 7 -1000 of the Euless Zoning Ordinance, shall be subject to all the safeguards and conditions set forth on said site plan described herein as Exhibit "A." Said site plan shall be applicable only to the property herein described. SECTION 2 SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent juris- diction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 3 PENALTY FOR VIOLATION. Any person, firm, or corporation vio- lating the terms and provisions of this ordinance, or the amend- ments to the City of Euless Charter hereby made, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed One- thousand Dollars ($1,000), and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Charter and the Statutes of the State of Texas. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. Its average skating equipment sales exceeds $1,000,000.00 annually. OPERATIONS Year -round operating hours are between 8 :30a.m, to 5 :30p.m. weekdays. Saturdays are made available for phone orders only. KC Skate Sales employs 8 persons full time for order- entry, assembly, shipping and receiving of made -to -order roller skates. ASSEMBLY consists of selecting styles, sizes and colors of roller skating shoes, chassis, wheels and bearings and completing a pair of made -to -order roller skates. The tools and machinery iused are common drill presses, hand drills and hand tools. The appearance of our assembly area is a combination of a shoe repair shop and a handy -man's work shop.
