HomeMy WebLinkAbout936 08-11-1987NO. 936 AN ORDINANCE AMENDING ORDINANCE NO. 347, SAME BEING THE COMPREHENSIVE ZONING CODE OF THE CITY OF EULESS, TEXAS, TO PROVIDE FOR SPECIAL USE PERMITS FOR SEASONAL, PARKING LOT, SIDEWALK, TRUCKLOAD, AND OTHER TEMPORARY OUT SIDE SALES, WITH LIMITATIONS THEREON, IN NON - RESIDENTIAL ZONING DISTRICTS; PROVIDING A PENALTY FOR VIOLATION THEREOF; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, it is the desire of the Euless City Council to regulate certain out side sales within the City of Euless, Texas; and WHEREAS, while prohibiting such sales in residentially zoned districts, the Comprehensive Zoning Code of the City of Euless, Texas, does not specifically provide for the regulation and /or permitting of all such sales within non - residential zoning districts of the city. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS. I. Section 7 -1002 of Ordinance No. 347, same being the Comprehensive Zoning Code of the City of Euless, Texas, is herewith amended by the addition of the following new subsection (61) to be and read as follows: USE (61) Seasonal, parking lot, side walk, truckload and other out side temporary sales of mer- chandise II. PERMISSIVE DISTRICT By Special Resolution of the City Council in C -1, C -2, L -1, I -1, I -2 and Non -Resi- dential PD areas Penalty for Violation. Any person, firm or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in an amount not to exceed $200.00. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. III. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judg- ment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. IV. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 28th day of July, 1987, by a vote of 4 aves. 0 nays and 0 abstentions. GIVEN SECOND READING, PASSED AND APPROVED at a regular meeting of the Euless City Council on the 11th day of August, 1987, by a vote of 5 ayes, 0 nays and 0 abstentions.
