HomeMy WebLinkAbout941 08-25-1987ORDINANCE NO. 941 AN ORDINANCE AMENDING ORDINANCE NO. 347, SAME BEING THE COMPREHENSIVE ZONING CODE OF THE CITY OF EULESS TO AMEND THE SIDE YARD AND LOCATION OF ACCESSORY BUILDINGS REQUIREMENTS FOR MOBILE HOME DISTRICTS; PROVIDING A PENALTY FOR VIOLATION THEREOF; PROVIDING AN EFFECTIVE DATE; AND PROVIDING A SEVERABILITY CLAUSE. WHEREAS, the Euless City Council desires to amend the side yard set -back requirements and the permitted location of unenclosed carports within Mobile Homes Zoning Districts. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. Section 7 -909 entitled "Side Yard" of the comprehensive Zoning Code of the City of Euless is herewith amended to hereafter be and read as follows: 7 -909 Side Yard The minimum side yard for a mobile home or trailer shall be five (5) feet; however, if the side yard abuts a dedicated street or highway right -of -way, the set back shall be thirty (30) feet from the right -of -way of the dedicated street. Provided, however, that no mobile home or trailer shall be situated within fifteen (15) feet of another mobile home or trailer situated on an adjacent or abutting lot, plot, tract or stand. II. Section 7 -918 entitled "Location of Accessory Buildings" of the comprehensive Zoning Code of the City of Euless is herewith amended to hereafter read as follows: 7 -918 Location of Accessory Buildings No garage, storage building, office or caretaker's dwelling, laundry house, bath house or permitted structure may be located nearer than twenty -five (25) feet to any boundary line of an "MH" District nor shall any such structure be located nearer than ten (10) feet to any boundary line of a plot, lot, tract or stand, except that such structure may be located within three (3) feet of the side or rear lot, plot, tract or stand when such structures are located within the rear twenty -five (25) percent of the trailer lot, plot, or tract. Carports (unenclosed) may be located on a plot, lot, tract or stand, without regard to the front, side and rear yard set -back requirements, except that same may not be located nearer than twenty -five (25) feet to any boundary line of an "MH" district or within two (2) feet of the front property line of such plot, lot, tract or stand. SECTION III. Penalty for Violation. Any person, firm or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in an amount not to exceed $1,000.00. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. SECTION IV Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. SECTION V Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section.
