AN ORDINANCE AMENDING ORDINANCE NO. 347, SAME
BEING THE COMPREHENSIVE ZONING CODE OF THE
CITY OF EULESS TO PROVIDE A FURTHER EXTENSION
TO THE PERIOD PROVIDED FOR COMPLIANCE WITH
LIMITATIONS ON THE TYPE AND LOCATION OF
CERTAIN SATELLITE TELEVISION RECEPTION DISHES
AS PROVIDED BY ORDINANCE NO. 827; PROVIDING A
PENALTY FOR VIOLATION THEREOF; PROVIDING AN
EFFECTIVE DATE; AND PROVIDING A SEVERABILITY
CLAUSE.
WHEREAS, the Euless City Council through the adoption of
Ordinance No. 827 established certain limitation upon the
type and location of satellite television reception dishes
within the City of Euless, Texas; and
WHEREAS, by such Ordinance the City Council required that
all satellite televisions reception dishes located within the
corporate limits of the City of Euless, Texas, on the
effective date of such ordinance, same being March 22, 1985,
be in compliance with the requirements of such ordinance or a
special exception obtained with respect thereto by two (2)
years from the effective date of such ordinance; and
WHEREAS, by adoption of Ordinance No. 925, the City
Council extended the date that pre- existing satellite
television reception dishes be brought into compliance with
the provisions of such Ordinance No. 827 to October 1, 1987;
and
WHEREAS, the City Council desires to further extend the
date that pre- existing satellite television reception dishes
be brought into compliance with such Ordinance No. 827,
inasmuch as the city has not completed its review of proposed
comprehensive revisions to the City of Euless Zoning Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EULESS, TEXAS:
I.
Article V of Euless Ordinance No. 827 is herewith amended
to hereafter be and read as follows:
"Unless a special use permit be earlier granted,
all satellite television reception dishes currently
located within the City of Euless, Texas, upon the
effective date hereof shall be required to be
brought into conformity with the provisions hereof
on or before March 1, 1988. All such satellite
television reception dishes located within the
corporate limits of the City of Euless, Texas,
therefor, unless otherwise permitted by a specific
use permit, shall be in compliance herewith on or
before March 1, 1988."
II.
Penalty for Violation. Any person, firm or corporation
violating any of the terms and provisions of this ordinance
shall be deemed guilty of a misdemeanor and, upon conviction
thereof, shall be fined in an amount not to exceed $200.00.
Each such violation shall be deemed a separate offense and
shall be punishable as such hereunder.
III.
Effective Date. This ordinance shall be in full force
and effect from and after its passage and publication as
provided by the Euless City Charter and the laws of the State
of Texas.
IV.
Severability Clause. That it is hereby declared to be
the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance
are severable, and if any phrase, clause, sentence, paragraph
or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court
of competent jurisdiction, such unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same
would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
PRESENTED AND GIVEN FIRST READING at a regular meeting of
the Euless City Council on the 8th day of September
1987; by a vote of 5 ayes, 0 nays and 0

abstentions; GIVEN SECOND READING AND APPROVED at a regular
meeting of the Euless City Council on the 22nd day of 1987; September
by a vote of _5_ ayes, _ 0 nays and 0 abstentions.
