AN ORDINANCE AMENDING ORDINANCE NO. 347,
IDENTIFIED AS THE ZONING ORDINANCE OF
THE CITY OF EULESS, TEXAS; A!ffiIDING THE
CITY OF EULESS ZONING DISTRICT MAP ON
CERTAIN PROPERTY OUT OF THE WILLIAMSBURG
ADDITION; PROVIDING FOR A CHANGE OF
ZONING FROM COMMUNITY UNIT DEVELOPMENT
(CUD) WITH MULTI- FAMILY DENSITY OF R -5
AT 22 UNITS TO THE ACRE TO NEIGHBORHOOD
BUSINESS DISTRICT (C -1) WITH A
DEVELOPMENT/OR SITE PLAN; PROVIDING FOR
A SEVERABILITY CLAUSE, PENALTY FOR
VIOLATION AND AN EFFECTIVE DATE.
WHEREAS, the Planning & Zoning Commission has conducted a public
hearing on March 2, 1988, in conjunction with Zoning Case No.
88 -05, and has rendered a recommendation to the City Council with
respect to same;
WHEREAS, City Council has conducted a public hearing on March 22,
1988, considered the recommendation of the Planning & Zoning
Commission, and has determined that the proposed change is in the
best interest of the general welfare of the City of Euless;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS:
SECTION 1
THAT the official zoning district map of the City of Euless,
Texas, being a part of Ordinance No. 347, be amended to read so
that the zoning district classification of that 7.228 acres of
land located on the northeast corner of Mid - Cities Boulevard and
Bear Creek Drive, being part of Lot 1, Block 1, Williamsburg
Addition, and being more particularly described in Exhibit A,
attached hereto and made a part hereof, be changed from Community
Unit Development (CUD) conforming to the R -5 Multi - Family Zoning
District limited to 22 Units per Acre To Neighborhood Business
District (C -1) in accordance with the development /or site plan to
be submitted and approved prior to issuance of any building
permit on the property.
SECTION 2
CONDITIONS SUBSEQUENT. Pursuant to Ordinance 918, the Euless
City Council hereby establishes as a condition of this rezoning
that prior to any building permit being issued on the subject
property that a detailed site plan meeting the requirements of
the Planned Development site plan requirements be submitted and
be approved by the City Council after receiving a recommendation
from the Planning and Zoning Commission. Said site plan shall
comply in all respects with the current C -1 zoning district
requirements.
SECTION 3
SEVERABILITY CLAUSE. It is hereby declared to be the intention
of the City Council of the City of Euless that the sections,
paragraphs, sentences, clauses, and phrases of this ordinance are
severable and if any phrase, clause, sentence, paragraph, or
section of this ordinance shall be declared unconstitutional by
the valid judgment or decree of any court of competent juris-
diction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs, or sections of
this ordinance, since the same would have been enacted by the
City Council without the incorporation in this ordinance of any
such unconstitutional phrase.
SECTION 4
PENALTY FOR VIOLATION. Any person, firm, or corporation vio-
lating the terms and provisions of this ordinance, or the amend-
ments to the City of Euless Charter hereby made, shall be deemed
guilty of a misdemeanor and, upon conviction thereof, shall be
liable to a fine in an amount not to exceed One- thousand Dollars
($1,000), and each day such violation shall be permitted to exist
shall constitute a separate offense, as provided by Ordinance No.
347, and subsequent amendments to the Euless City Charter and the
Statutes of the State of Texas.
SECTION 5
EFFECTIVE DATE. This ordinance shall be in full force and effect
from and after its passage, as provided by the Euless City
Charter and the laws of the State of Texas.

PRESENTED AND GIVEN FIRST READING at a regular meeting of the
Euless City Council on the 22nd day of March, 1988, by a vote of
3 ayes, 0 nays, and 0 abstentions.
PRESENTED AND PASSED ON SECOND AND FINAL READING at a regular
meeting of the Euless City Council on the 12th day of
April , 1988, by a vote of 4 ayes, 0 nays, and
0 abstentions.

BEING a tract of land situated in the Levi Franklin Survey,
Abstrac+, No. 573, City of Euless, Tarrant. County, Texas, and
being a part. of Lot 1, Block 1, Williamsburg, Addition recorded in
Volume 3RR -176, Page 21 and Page 2 ?, Plat Records, Tarrant
County, Texas, and being more particularly described as follows:
BEGINNING at a found "X" cut on sidevalk at. the Intersection of
the north right -of -vay of Mid- Cities Boulevard (a 120 -foot. ROW)
and the east right -of -vay of Bear Creek Drive (a 60 -foot ROW),
said "X" cut being, the beginning of a non - tangent curve to the
left, having a central angle of 2(1000'00 ", a radius of 479.16
feet, a tangent length of 84,49 feet., and whose long chord has a

THENCE along said curve with the east right-of-way of Bear
Creek Drive an arc length of 167.26 feet to a net 112"
