HomeMy WebLinkAbout969 05-24-1988ORDINANCE NO. 969 AN ORDINANCE AMENDING SECTION 10-52, "REGISTRATION" OF ARTICLE III, "OCCASIONAL OR GARAGE SALES" OF CHAPTER 10, "OCCUPATIONAL LICENSES AND REGULATIONS" OF THE CODE OF ORDINANCES, CITY OF EULESS, TEXAS; ADDING A REQUIREMENT OF A PERMIT FOR SUCH OCCASIONAL OR GARAGE SALES; PROVIDING FOR A FEE FOR SUCH PERMIT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council finds it in the best interest of the citizens of the City and of efficient administration of the functions of the City to require a permit for occasional or "garage" sales. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Euless, Texas: I. That Section 10 -52 of Article III of CHAPTER 10, "OCCUPATIONAL LICENSES AND REGULATIONS" of the Code of Ordinances, City of Euless, Texas, as amended, be hereby amended to hereafter be and read as follows: Sec. 10-52. Registration; Permit required; Fee. Any individual desiring to conduct an occasional sale shall obtain from the city manager, or his duly authorized representative, a permit to conduct an occasional sale. The application for such permit shall set forth the name, age and address of the applicant and shall contain a statement that the provisions of this article have been read by the applicant and that he agrees to comply with all the provisions contained therein and all other ordinances and regulations of the city. Such application shall further contain the address and location of the proposed site where the occasional sale is to be conducted and the dates of all previous occasional sales conducted by the applicant within the last preceding twelve (12) month period. Any person failing to comply with the requirements of this article and who acts in violation hereof shall be subject to the penalty imposed by section 10 -54. The applicant shall pay a fee for such permit as set forth in Chapter 1 1/2 of this Code. ORDINANCE NO. 969 II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. III. Saving Clause. That Chapter 10 of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. W Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas.
