AN ORDINANCE ESTABLISHING EMERGENCY AMBULANCE
SERVICE; PROVIDING FOR THE OPERATION THEREOF BY
THE CITY OF EULESS FIRE DEPARTMENT; PROVIDING FOR
THE ESTABLISHMENT OF FEES AND CHARGES FOR
EMERGENCY AMBULANCE SERVICE; PROVIDING AN
OFFENSE FOR A FALSE REQUEST FOR EMERGENCY
AMBULANCE SERVICE; PROVIDING AN OFFENSE FOR THE
HINDERING, INTERFERING OR OBSTRUCTING OF EULESS
FIRE DEPARTMENT EMERGENCY AMBULANCE PERSONNEL
IN PROVIDING EMERGENCY CARE OR TRANSPORT OF
INJURED OR ILL PERSONS; PROVIDING A PENALTY FOR
VIOLATION; PROVIDING AN EFFECTIVE DATE; PROVIDING A
SEVERABILITY CLAUSE; AND DECLARING AN EMERGENCY.
WHEREAS, the City Council of the City of Euless, Texas, has determined that it
would serve the best interests, health, safety and welfare of the citizens of Euless,
Texas, to provide emergency ambulance service to the citizens of such city; and
WHEREAS, the City Council has concluded that the most efficient and effective
emergency ambulance service would be provided by the city through the Euless Fire
Department; and
WHEREAS, the City Council desires by the enactment of this ordinance to
establish an emergency ambulance service and provide for the operation and
administration thereof.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
I.
The City of Euless, Texas, shall provide emergency ambulance service within
the corporate limits of the City of Euless, Texas, and outside such corporate limits
under such mutual aid agreements as may be from time to time established by and
between the City of Euless and other political subdivisions and as herein further
provided.
II.
The City Manager of the City of Euless, Texas, is authorized to provide for the
equipping, operation and administration of such emergency ambulance service, which
emergency ambulance service shall be operated by the Euless Fire Department and
shall be under the supervision and control of the Chief of the Fire Department,
subject to the guidelines herein established and under such rules and regulations as
the Chief of the Euless Fire Department shall, with the approval of the Euless City
Manager, from time to time promulgate for the proper c aeration thereof.
III.
The Euless City Manager shall designate an emergency ambulance medical
director who shall be a physician licensed to practice medicine in the state of Texas
and who shall advise the Chief of the Euless Fire Department in the administration,
equipping, training and operation of the Euless emergency ambulance service.
IV.
The Euless Fire Department shall provide only emergency ambulance service
and requests for emergency ambulance service shall be made to the Euless Police
Department and /or the Euless Fire Department. The Chief of the Euless Fire
Department and Chief of the Euless Police Department shall establish the
appropriate procedures, rules and regulations for the receipt and coordination of
requests for emergency ambulance service and the dispatch of Fire Department
personnel and equipment in response thereto. Euless Fire Department emergency
ambulance attendants shall have the authority to pick up and transport any injured or
sick persons found on public or private property as determined by such emergency
ambulance attendants to then and there have need for emergency care and /or
transport for such injury or illness. Emergency ambulance attendants, under rules
and regulations promulgated as herein provided, shall have the sole authority to
determine the medical facility to which the injured or ill person requiring emergency
medical transport shall be taken.
V.
Emergency ambulance service may be provided to injured or ill persons outside
the corporate limits of the City of Euless, Texas, when a mutual aid agreement
exists by and between the City of Euless, Texas, and the political subdivision wherein
such injured or ill person shall be located, or upon determination of the existence of
emergency circumstances by the Fire Chief of the City of Euless, Texas, or his
designate.
VI.

No person shall initiate, communicate or request the dispatch of emergency
medical or ambulance service of the City of Euless, Texas, knowing that such
request is false or baseless.
VIII.
No person shall, with intent, hinder, interfere or obstruct personnel of the
Euless Fire Department in providing emergency medical care or transport for any
person or persons.
IX.
No person, firm or corporation shall provide ambulance service for the transport
of persons from locations within the corporate limits of the City of Euless, texas,
except only for non — emergency calls, transfers or the transport of deceased persons,
except as may be specifically authorized under mutual aid agreements of the City of
Euless, Texas, or by the Fire Chief of the City of Euless, Texas, or his designate,
upon the determination of the existence of an emergency as provided in Article V.
above.
X.
Any person, firm or corporation violating any of the terms and provisions of this
ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof,
shall be fined in an amount not more than $1,000.00. Each such violation shall be
deemed a separate offense and shall be punishable as such hereunder.
XI.
This ordinance shall be in full force and effect from and after its passage and
publication as provided by the Euless City Charter and the laws of the State of Texas.
XII.
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
invalid or unconstitutional by the valid judgment cr decree of any court of
competent jurisdiction, such invalidity or unconstitutionality shall not affect any of
the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance,
since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such invalid or unconstitutional phrase, clause,
sentence, paragraph or section.

XIII.
By the affirmative vote of four or more of its members, the City Council
declares that this is an ordinance for the immediate preservation of the public
peace, property, health, and safety, and is an emergency measure within the meaning
of Article 11, Section 11 of the City Charter; and the requirement that it be read at
two meetings, as specified in Section 11, is hereby dispensed with.
PRESENTED AND PASSED on first and final reading on the 9th day
of August, 1988, at a regular meeting of the City Council of the City of Euless,
Texas, by a vote of 5 ayes, 0 nayes and 0 abstentions.
