AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTI-
FIED AS THE ZONING ORDINANCE OF THE CITY OF
EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING
DISTRICT MAP ON CERTAIN PROPERTY OUT OF THE
WESTPARX CENTRAL ADDITION; PROVIDING FOR A CHANGE
OF ZONING FROM COMMUNITY BUSINESS DISTRICT (C -2)
TO COMMUNITY BUSINESS DISTRICT WITH SPECIFIC USE
PERMIT (C -2 W /SP) ALLOWING INCREASED HEIGHT AND
SIGN AREA; PROVIDING FOR A CONDITION SUBSEQUENT; A
SEVERABILITY CLAUSE; PENALTY FOR VIOLATION AND AN
EFFECTIVE DATE.
WHEREAS, Planning and Zoning Commission conducted a public hearing on
the 19th day of July, 1988, in conjunction with Zoning Case No. 88 -11
and rendered a recommendation to the City Council with respect to
same;
WHEREAS, City Council conducted a public hearing on the 9th and 23rd
day of August, 1988, considered the recommendation of the Planning and
Zoning Commission, and determined that the proposed change is in the
best interest of the general welfare of the City of Euless;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS:
SECTION 1
THAT the official zoning district map of the City of Euless, Texas,
being a part of Ordinance No. 347, be amended to read so that the
zoning district classification of that 2.9 acres of land generally
located at 2201 West Airport Freeway, on Lot 4AR1, Westpark Central
Addition, now zoned Community Business District (C -2) is hereby
changed to Community Business District with a Specific Use Permit (C -2
W /SP), allowing increased height and sign area (840 square feet area
and 81 feet high), in accordance with the site plan described herein
as Exhibit A, bearing the City of Euless received date of August 5,
1988, (attached hereto and made a part hereof).
Said property described in Exhibit A, pursuant to Section 7 -1000 of
the Euless Zoning Ordinance, shall be subject to all the safeguards
and conditions set forth on said site plan described herein as Exhibit
A. Said site plan shall be applicable only to the property described
herein.
SECTION 2
CONDITIONS SUBSEQUENT. In accordance with the provisions of Ordinance
918, which amends Ordinance 347, Section 16 -102, being the Comprehen-
sive Zoning Code of the City of Euless, with the following condition:
THAT this specific use permit be applicable only to the Day's Inn
D /FW.
SECTION 3
SEVERABILITY CLAUSE. It is hereby declared to be the intention of the
City of Euless that the sections, paragraphs, sentences, clauses, and
phrases of this ordinance are severable; and if any phrase, clause,
sentence, paragraph, or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect any
of the remaining phrases, clauses, sentences, paragraphs, or sections
of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase.
SECTION 4
PENALTY FOR VIOLATION. Any person, firm, or corporation violating the
terms and provisions of this ordinance, or the amendments to the City
of Euless Charter hereby made, shall be deemed guilty of a misdemeanor
and, upon conviction thereof, shall be liable to a fine in an amount
not to exceed One-thousand Dollars ($1,000), and each day such vio-
lation shall be permitted to exist shall constitute a separate of-
fense, as provided by Ordinance No. 347, and subsequent amendments to
the Euless City Charter and the Statutes of the State of Texas.
SECTION 5
EFFECTIVE DATE. This ordinance shall be in full force and effect from
and after its passage, as provided by the Euless City Charter and the
laws of the State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless
City Council on the 23rd day of August, 1988, by a vote of 3 ayes, 0
nays, and 1 abstentions.
